AKTA MAKANAN 1983
Peraturan-Peraturan Iradiasi Makanan 2011
Pada menjalankan kuasa yang diberikan oleh seksyen 34 Akta Makanan 1983
[Akta 281], Menteri membuat peraturan-peraturan berikut:

Bahagian I

PERMULAAN

Nama dan permulaan kuat kuasa
1. (1) Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan Iradiasi
Makanan 2011.
(2) Peraturan-Peraturan ini mula berkuat kuasa pada tarikh yang ditetapkan oleh
Menteri melalui pemberitahuan dalam Warta.

Tafsiran
2. Dalam Peraturan-Peraturan ini, melainkan jika konteksnya menghendaki makna
yang lain—
“dos yang diserap” ertinya tenaga yang diserap oleh makanan yang dirawat
dengan radiasi mengion yang dinyatakan dalam unit standard antarabangsa
dipanggil “Gray” (Gy) dan ditakrifkan sebagai 1 Joule tenaga diserap setiap
kilogram jirim;
“iradiasi semula” ertinya suatu proses di mana makanan yang telah diiradiasi
bagi suatu maksud khusus diiradiasi semula bagi maksud yang sama;
“makanan yang diiradiasi” ertinya apa-apa kelas makanan yang telah
diperlakukan dengan rawatan radiasi mengion bagi maksud khusus mengikut
peraturan 8;
“MeV” ertinya juta voltan elektron;
“premis iradiasi makanan” ertinya premis yang digunakan untuk merawat
makanan dengan radiasi mengion yang mana hendaklah didaftarkan dengan
Pengarah di bawah peraturan 4;
“radiasi mengion” ertinya semua radiasi yang berupaya mengeluarkan ion
secara langsung atau tidak langsung dalam perjalanannya menerusi apa-apa
jirim.

Bahagian II

PENDAFTARAN PREMIS IRADIASI MAKANAN

Premis iradiasi makanan yang hendak didaftarkan
3. (1) Tiada seorang pun boleh menggunakan mana-mana premis bagi rawatan
iradiasi makanan melainkan jika premis itu didaftarkan di bawah Peraturan-Peraturan
ini.
(2) Mana-mana orang yang tidak mematuhi subperaturan (1) melakukan suatu
kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit
atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-duanya.

Permohonan bagi pendaftaran
4. (1) Suatu permohonan bagi pendaftaran premis iradiasi makanan hendaklah
dibuat kepada Pengarah dalam bentuk dan cara dan disertai dengan apa-apa maklumat
dan butir-butir, sebagaimana Pengarah boleh nyatakan.
(2) Pengarah boleh, secara lisan atau bertulis pada bila-bila masa selepas
menerima permohonan itu menghendaki pemohon itu untuk mengemukakan
dokumen, maklumat atau butir-butir tambahan yang difikirkannya perlu bagi maksud
pendaftaran.

Perakuan pendaftaran
5. (1) Pengarah boleh, selepas menimbangkan permohonan di bawah subperaturan
4(1) dan setelah berpuas hati dengan maklumat dan butir-butir yang dikemukakan,
mengeluarkan suatu perakuan pendaftaran bagi premis iradiasi makanan sebagaimana
ditetapkan dalam Jadual Pertama.
(2) Fi bagi perakuan pendaftaran yang dikeluarkan di bawah subperaturan (1)
adalah satu ratus ringgit.

Tempoh sah perakuan
6. Suatu perakuan pendaftaran bagi premis iradiasi makanan hendaklah sah bagi
suatu tempoh tidak melebihi tiga tahun dari tarikh ia dikeluarkan.

Permohonan bagi pembaharuan perakuan
7. (1) Suatu permohonan bagi pembaharuan suatu perakuan pendaftaran bagi
premis iradiasi makanan hendaklah dibuat sekurang-kurangnya tiga puluh hari
sebelum tarikh tamat pendaftarannya dan permohonan itu hendaklah dibuat mengikut
peraturan 4.

(2) Mana-mana orang yang tidak mematuhi subperaturan (1) melakukan
suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh
ribu ringgit atau dipenjara selama tempoh tidak melebihi dua tahun atau kedua-
duanya.

Bahagian III

OPERASI PREMIS IRADIASI MAKANAN

Operasi dan pengendalian premis iradiasi makanan
8. (1) Tiada seorang pun yang boleh menjalankan operasi premis iradiasi makanan
dan mengendalikan proses iradiasi makanan melainkan jika ia mematuhi kehendak
yang dinyatakan dalam Jadual Kedua, di mana berkenaan.
(2) Tiada makanan melainkan kelas makanan yang dinyatakan dalam ruang
(1) Jadual Ketiga boleh dirawat dengan radiasi mengion bagi maksud yang
dinyatakan dalam ruang (2) dan dos iradiasi yang dibenarkan untuk rawatan
sedemikian tidak kurang daripada dos yang dinyatakan masing-masing dalam
ruang (3) dan lebih daripada dos yang dinyatakan dalam ruang (4) Jadual yang
dinyatakan.
(3) Bagi maksud subperaturan (2), rawatan radiasi mengion hanya boleh
dikendalikan di mana rawatan itu—
(a) memenuhi keperluan teknologi; atau
(b) perlu untuk suatu tujuan berkaitan dengan kebersihan makanan;
dan rawatan itu adalah bukan prosedur pengganti untuk amalan pengilangan
yang baik.
(4) Mana-mana orang yang melanggar subperaturan (1) dan (2) melakukan
suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi dua
puluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi lima tahun
atau kedua-duanya.

Rekod
9. (1) Mana-mana orang yang menjalankan operasi premis iradiasi makanan
hendaklah menyimpan dan menyenggara suatu rekod untuk setiap kelompok
makanan yang diperlakukan dengan rawatan iradiasi mengion.

(2) Rekod yang dinyatakan dalam subperaturan (1) hendaklah meliputi—
(a) tarikh iradiasi;
(b) jenis makanan yang dirawat;
(c) kuantiti makanan yang dirawat;
(d) identifikasi lot;
(e) nombor kelompok pengilang;
(f) tujuan rawatan;
(g) dos minimum dan maksimum yang diserap;
(h) punca radiasi mengion;
(i) nama dan alamat premis iradiasi makanan;
(j) nombor lesen dan pendaftaran premis iradiasi makanan;
(k) nama dan jawatan anggota yang diberi kuasa dalam premis iradiasi

makanan;
(l) nama dan alamat pengilang;
(m) jenis bahan pembungkusan yang digunakan semasa rawatan iradiasi;
(n) semua kawalan dan pengukuran yang dibuat semasa rawatan itu,

terutamanya yang berkaitan dengan dos minimum dan maksimum
yang diserap; dan
(o) apa-apa kejadian atau lencongan yang diperhatikan semasa rawatan.

(3) Mana-mana orang yang melanggar subperaturan (1) melakukan suatu
kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu
ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-
duanya.

Punca radiasi mengion

10. Tiada makanan boleh dirawat dengan radiasi mengion melainkan jika
rawatan itu menggunakan salah satu punca berikut:

(a) sinar gamma daripada radionuklida Cobalt-60 dan Caesium-137;

(b) sinar-X yang dihasilkan oleh peralatan iradiasi yang dikendalikan pada
atau di bawah paras tenaga 5 MeV; atau

(c) elektron yang dihasilkan oleh peralatan iradiasi yang dikendalikan
pada atau di bawah paras tenaga 10 MeV.

Bahagian IV

PERAKUAN IRADIASI

Perakuan iradiasi

11. (1) Tiada seorang pun boleh mengimport, mengilang, mengiklan bagi jualan
atau menjual apa-apa makanan yang telah dirawat dengan radiasi mengion
melainkan jika perakuan iradiasi sebagaimana ditetapkan dalam Jadual Keempat
telah diperakui oleh premis iradiasi makanan.

(2) Mana-mana orang yang tidak mematuhi subperaturan (1) melakukan
suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh
ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau
kedua-duanya.

Bahagian V

KEHENDAK PEMBUNGKUSAN DAN PELABELAN

Kehendak pembungkusan

12. (1) Semua makanan yang hendak diiradiasi hendaklah dibungkus
dalam—
(a) bahan pembungkus yang sesuai mengikut kualiti gred makanan; dan
(b) keadaan kebersihan yang boleh diterima.

(2) Bagi maksud subperaturan (1), tiada seorang pun boleh menggunakan
atau menyebabkan atau membenarkan penggunaan apa-apa bahan pembungkusan
yang bersentuhan secara langsung dengan makanan kecuali yang dinyatakan
dalam ruang (1) Jadual Kelima dan dos yang dibenarkan hendaklah tidak
melebihi dos yang dinyatakan dalam ruang (2) Jadual tersebut.

(3) Walau apa pun subperaturan (1), semua kehendak yang berhubung
dengan pembungkusan bagi makanan di bawah Bahagian VI Peraturan-Peraturan
Makanan 1985 [P.U. (A) 437/1985] hendaklah terpakai.

(4) Mana-mana orang yang melanggar subperaturan (2) melakukan suatu
kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu
ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-
duanya.

Kehendak pelabelan
13. (1) Tiap-tiap bungkusan yang mengandungi makanan yang diiradiasi untuk
jualan hendaklah mempunyai di atasnya—
(a) pernyataan bertulis—
(i) berdekatan dengan nama makanan tersebut;
(ii) dalam penghurufan tidak kurang daripada 10 poin, dalam salah

satu bentuk berikut:
(A) “DIRAWAT DENGAN RADIASI MENGION”;
(B) “DIRAWAT DENGAN IRADIASI”;
(C) “DIRAWAT OLEH IRADIASI”; atau
(D) “DIIRADIASI”.
(b) simbol iradiasi makanan antarabangsa sebagaimana dalam Jadual

Keenam.
(2) Jika sesuatu makanan yang diiradiasi digunakan sebagai ramuan dalam
makanan lain dan kandungannya melebihi 5 peratus daripada jumlah kandungan
makanan itu, suatu pernyataan mengenai adanya makanan diiradiasi dalam
makanan itu, hendaklah dinyatakan dalam senarai ramuan dalam bentuk
“DIIRADIASI”.
(3) Jika makanan diiradiasi dipamerkan bagi jualan runcit selain daripada
dalam bungkusan, apa-apa maklumat yang dikehendaki terdapat pada label
makanan di bawah subperaturan (1), hendaklah dipamerkan di atas atau
berkaitan dengan makanan yang dipamerkan.
(4) Walau apa pun subperaturan (1), (2) dan (3), semua kehendak pelabelan
di bawah Bahagian IV Peraturan-Peraturan Makanan 1985 hendaklah terpakai
bagi semua bungkusan yang mengandungi apa-apa makanan diiradiasi untuk
jualan.
(5) Mana-mana orang yang melanggar subperaturan (1) dan (2) melakukan
suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh
ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau
kedua-duanya.

Larangan terhadap iradiasi semula
14. (1) Tiada sesuatu makanan yang telah diiradiasi boleh diiradiasi semula
kecuali makanan berikut:
(a) makanan yang mempunyai keaktifan air yang rendah yang tidak melebihi

0.85 aw bagi maksud mengawal infestasi semula serangga;

(b) makanan yang mengandungi kurang dari 5 peratus ramuan yang
diiradiasi; atau

(c) makanan yang telah diiradiasi sebahagiannya kepada jumlah dos yang
diserap yang kurang daripada dos yang diperlukan untuk mencapai
kesan yang dikehendaki.

(2) Walau apa pun subperaturan (1), hanya makanan yang disediakan
daripada bahan yang diiradiasi pada paras dos yang rendah tidak melebihi 1
kGy boleh diiradiasi semula untuk tujuan teknologi yang lain.
(3) Mana-mana orang yang melanggar subperaturan (1) dan (2) melakukan
suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi dua
puluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi lima tahun
atau kedua-duanya.

Food Irradiation Regulations 2011
In exercise of the powers conferred by section 34 of the Food Act 1983
[Act 281], the Minister makes the following regulations:

Part I

PRELIMINARY

Citation and commencement
1. (1) These regulations may be cited as the Food Irradiation Regulations
2011.
(2) These Regulations come into operation on such date as the Minister
may appoint by notification in the Gazette.

Interpretation
2. In these Regulations, unless the context otherwise requires—
“absorbed dose” means the energy absorbed by the food treated with ionizing
radiation expressed in standard international units called “Gray” (Gy) and is
defined as 1 Joule of energy absorbed per kilogram of matter;
“re-irradiation” means a process whereby food which has been irradiated
for a specific purpose is irradiated again for the same purpose;
“irradiated food” means any classes of food that has been subjected to
ionizing radiation treatment for specific purposes according to regulation 8;

“MeV” means million electron volts;
“food irradiation premises” means premises used to treat food with ionizing
radiation which shall be registered with the Director under regulation 4;
“ionizing radiation” means all radiations capable of producing ions directly
or indirectly in their passage through any matter.

Part II

REGISTRATION OF FOOD IRRADIATION PREMISES

Food irradiation premises to be registered
3. (1) No person shall use any premises for food irradiation treatment unless
the premise is registered under these Regulations.
(2) Any person who fails to comply with subregulation (1) commits an
offence and shall on conviction be liable to a fine not exceeding ten thousand
ringgit or to imprisonment for a term not exceeding two years or to both.

Application for registration
4. (1) An application for registration of food irradiation premises shall be
made to the Director in such form and manner and be accompanied with such
information and particulars, as the Director may specify.
(2) The Director may, orally or in writing at any time after receiving the
application, require the applicant to submit additional documents, information
or particulars as he considers necessary for the purpose of the registration.

Certificate of registration
5. (1) The Director may, after considering an application under subregulation
4(1) and on being satisfied with the information and particulars submitted,
issue a certificate of registration for food irradiation premises as prescribed
in the First Schedule.
(2) The fee for the certificate of registration issued under subregulation
(1) shall be one hundred ringgit.

Validity of certificate
6. A certificate of registration for food irradiation premises shall be valid
for a period not exceeding three years from the date of its issuance.

Application for renewal of certificate
7. (1) An application for renewal of a certificate of registration for food
irradiation premises shall be made at least thirty days before its expiry date
and such application shall be in accordance with regulation 4.
(2) Any person who fails to comply with subregulation (1) commits an
offence and shall on conviction be liable to a fine not exceeding ten thousand
ringgit or to imprisonment for a term not exceeding two years or to both.

Part III

OPERATION OF FOOD IRRADIATION PREMISES

Operating and conducting food irradiation premises
8. (1) No person shall operate food irradiation premises and conduct food
irradiation processes unless it complies with the requirements specified in the
Second Schedule, wherever appropriate.
(2) No food except classes of food specified in column (1) of the Third
Schedule shall be treated with ionizing radiation for purposes specified in
column (2) and the irradiation doses permitted for such treatment shall not be
less than the doses specified in column (3) and more than the doses specified
in column (4) of the said Schedule respectively.
(3) For the purpose of subregulation (2), ionizing radiation treatment shall
only be conducted where such treatment—
(a) fulfils a technological need; or
(b) is necessary for a purpose associated with food hygiene;
and such treatment is not a substitute procedure for good manufacturing
practice.
(4) Any person who contravenes subregulations (1) and (2) commits an
offence and shall on conviction be liable to a fine not exceeding twenty
thousand ringgit or to imprisonment for a term not exceeding five years or
to both.

Records
9. (1) A person who operates food irradiation premises shall keep and maintain
a record of each batch of food subjected to ionizing radiation treatment.
(2) Records specified in subregulation (1) shall include—
(a) date of irradiation;
(b) type of food treated;

(c) quantity of food treated;
(d) lot identification;
(e) manufacturer batch number;
(f) purpose of treatment;
(g) minimum and maximum absorbed dose;
(h) source of ionising radiation;
(i) name and address of the food irradiation premise;
(j) license and registration number of the food irradiation premise;
(k) name and designation of the authorized personnel in the food irradiation

premise;
(l) name and address of manufacturer;
(m) the type of packaging materials used during the irradiation

treatment;
(n) all controls and measurements performed during the treatment, particularly

those related to the minimum and maximum doses absorbed; and
(o) any incidents or deviation observed during the treatment.

(3) Any person who contravenes subregulation (1) commits an offence and
shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or
to imprisonment for a term not exceeding two years or to both.

Sources of ionizing radiation

10. No food shall be treated with ionizing radiation unless such treatment
uses either one of the following sources:
(a) gamma rays from the radionuclides Cobalt-60 and Caesium-137;
(b) X-rays generated from irradiating apparatus operated at or below an

energy level of 5 MeV; or
(c) electrons generated from irradiating apparatus operated at or below

an energy level of 10 MeV.

Part IV

CERTIFICATE OF IRRADIATION

Certificate of irradiation

11. (1) No person shall import, manufacture, advertise for sale or sell any food
that has been treated with ionizing radiation unless a certificate of irradiation
as prescribed in the Fourth Schedule has been granted by a food irradiation
premise.

(2) Any person who fails to comply with subregulation (1) commits an
offence and shall, on conviction, be liable to a fine not exceeding ten thousand
ringgit or to imprisonment for a term not exceeding two years or to both.

Part V

PACKAGING AND LABELLING REQUIREMENTS

Packaging requirements
12. (1) All food to be irradiated shall be packed in—
(a) suitable packaging material according to food grade quality; and
(b) acceptable hygienic condition.
(2) For the purpose of subregulation (1), no person shall use or cause
or permit to be used any packaging material which is in direct contact with
the food except those specified in column (1) of the Fifth Schedule and the
doses permitted shall not exceed the doses specified in column (2) of the said
Schedule.
(3) Notwithstanding subregulation (1), all requirements in relation
to the packaging of food under Part VI of the Food Regulations 1985
[P.U. (A) 437/1985] shall be applicable.
(4) Any person who contravenes subregulation (2) commits an offence and
shall on conviction be liable to a fine not exceeding ten thousand ringgit or
to imprisonment for a term not exceeding two years or to both.

Labelling requirements
13. (1) Every package containing irradiated food for sale shall bear on it—
(a) a written statement—
(i) proximately close to the name of the food;
(ii) in not less than 10 point lettering, in one of the following

forms:
(A) “TREATED WITH IONIZING RADIATION”;
(B) “TREATED WITH IRRADIATION”;
(C) “TREATED BY IRRADIATION”; or
(D) “IRRADIATED”.
(b) the international food irradiation symbol as in the Sixth Schedule.
(2) Where irradiated food is used as an ingredient in another food and it
constitutes more than 5 percent of the content of that food, a statement as to
the presence in that food of such irradiated food, shall be declared in the list
of ingredients of that food in the form “IRRADIATED”.
(3) Where irradiated food is displayed for retail sale other than in a package,
any information required on the label of the food under subregulation (1),
shall be displayed on or in connection with the display of the food.

(4) Notwithstanding subregulations (1), (2) and (3), all labelling requirements
under Part IV of the Food Regulations 1985 shall be applicable to all packages
containing any irradiated food for sale.
(5) Any person who contravenes subregulations (1) and (2) commits an
offence and shall, on conviction, be liable to a fine not exceeding ten thousand
ringgit or to imprisonment for a term not exceeding two years or to both.

Prohibition against re-irradiation

14. (1) No food that has been irradiated shall be re-irradiated except for the
following food:

(a) food with low water activity not exceeding 0.85 aw for purposes of
controlling insect re-infestation;

(b) food containing less than 5 per cent of irradiated ingredients; or

(c) food irradiated fractionally to a total absorbed dose less than that
required to achieve the desired effect.

(2) Notwithstanding subregulation (1), only food prepared from materials
that have been irradiated at low dose levels not exceeding 1 kGy may be
re-irradiated for another technological purpose.

(3) Any person who contravenes subregulations (1) and (2) commits an
offence and is liable, on conviction, to a fine not exceeding twenty thousand
ringgit or to imprisonment for a term not exceeding five years or to both.

Citation and commencement
1.  This order may be cited as the Customs (Values) (Crude Petroleum
Oil) (No. 8) Order 2011 and shall have effect for the period from 21 April
2011 to 4 May 2011.

Levy and payment of customs duties
2.  For the purpose of the levy and payment of customs duties, in accordance
with the provisions of the Customs Duties Order 2007 [P.U. (A) 441/2007],
