Page 4 HAPPENINGS September 14, 2023 www.hap2it.com The West Wing and In Plain Sight alum Mary McCormack says Willie -- the minor-league, pro wrestling group manager she plays on Heels -- is thrilled to be heading a new women's division in Season 2 of the Starz drama. New episodes air Fridays. Set in rural Georgia, the show follows Willie as she shepherds wrestling stars and sibling rivals Jack (Stephen Amell) and Ace (Alexander Ludwig), who are trying to define success for themselves, while keeping the Duffy League afloat after the suicide of their father. Season 1 ended with the brothers brawling and Ace's valet and love interest Crystal (Kelli Berglund) jumping into the unscripted fray to claim the coveted championship belt for herself. "The family drama continues. The brothers are still up to their craziness," McCormack, 54, said in a recent Zoom interview conducted before the Screen Actors Guild strike in July. "Willie continues to be the thing that sort of keeps it together. She's the brains of the operation, on at least the management side of it." Introducing a women's division into the Duffy "promotion" or franchise grew out of Crystal's bold move and Willie's mentoring of her after it. "We're figuring out, 'Well, she has the belt now. She's the champ. How do we sustain that?'" McCormack said. "We can't have her beating up men every week. That's not believable and we can't have her being beaten up by men every week. That's not sustainable, either." Crystal's triumph shaped the Season 2 storyline and the attitudes of some of the male characters reluctant to welcome women into the ring. "Women's wrestling is everywhere and it's huge and it has a massive fanbase and is big business, so it would be unrealistic for us to not get into that world," McCormack said. It isn't difficult to believe it took the cash-strapped Duffy League this long to try something new, however, since all of its stars have day jobs and Willie is literally fighting to keep the lights on at the arena. "We have no resources. It's five local guys wrestling. It's a tiny independent league, trying to make ends meet. I love the way they introduce [a new division]," McCormack said. "Willie has been waiting in the wings. She didn't even ever consider [wrestling herself] as a possibility. She would have loved to have been Crystal. So watching her dreams fulfilled through her mentee is exciting." Willie is feeling important and fulfilled in her new role, even as Jack and Ace seem to be at a crossroads regarding their family dynamic and business partnership. "She was so into policing them in the past and, I think, in this moment, when Jack leaves to go find Ace and she is left to book matches and write [scripts] for the first time, she is more interested in that," she said. This explains why Willie appears detached when Ace takes off and Jack is "clearly destroyed" because he can't coax him home, the actress added. "I almost can't take him in," she said. "I'm so excited about a woman's division, so excited about Crystal, that I'm almost not registering him." The actress said she understands why Willie loves this circus-style life so much. "I've done a lot of research about people who love wrestling and it's no joke," she said. "I love it now, but when I see wrestlers, talk to wrestlers, watch interviews with wrestlers and fans, people don't take it casually. It's Willie's lifeblood." But viewers don't need to be big pro wrestling fans to find something to connect to in Heels. "I think everyone can relate to, if not life in a small town, then not having resources to make your dreams work and trying to make your dreams work anyway," McCormack said. "That's something everyone can relate to and, also, identity, I think, is something we all wrestle with all the time. Who am I? And who am I at different stages of my life? Who am I if my kids are gone? Who am I if I am divorced? I think it's really relatable." She likened viewers being surprised they have fallen in love with Heels to her own reluctance to sampling Friday Night Lights -- a drama about the lives of a high school football coach, his team and family in smalltown Texas -- on her husband's recommendation. "I couldn't care less about football. Hard pass!" she recalled telling her spouse, director Michael Morris. "And he was like, 'If you watch one and you don't want to watch anymore, you don't have to.' And I was in! Because it's not [only] about football. So, I don't think you have to be a wrestling fan to be invested in these characters." New research shows that in high-income countries, the obesity rate has slowed slightly. Rates are still rising, but not quite so fast. (Rates have tripled since 1976.) The less good news is that 42% of the adult U.S. population is obese, based on body mass index criteria. Grown-ups, however, don't get the credit directly. The most notable reductions in obesity rates have been among preschool children. Body of Knowledge The eyeball would seem to be particularly delicate. After all, it's essentially a bag of water (more precisely, a liquid called vitreous humor). But eyeballs are surprisingly resilient. Researchers at the Institute of Human Anatomy, a private human cadaver lab, dropped cow eyeballs (pretty similar in structure to human ones) from the top of a five-story flight of stairs. The care of the infants was paid for by the exhibit admission fee. Med School Q: Why does swimming seem to provoke the urge to urinate? A: There's a medical term for the phenomenon: immersion diuresis. When the body is submerged in water, blood vessels constrict, moving blood to the internal organs, which raises blood pressure and can increase activity in the kidneys because the body wants to release fluid to compensate for the arterial changes. The kidneys can also signal it's time to pee based on increased water pressure, which climbs as you dive deeper. Immersion diuresis is quite common, and unfortunately, so is the phenomenon of people not getting out of the pool to take care of business. A 2017 study surveyed a 110,000-gallon community pool for specific markers indicating the presence of urine. The researchers concluded that over a three-week period, swimmers released almost 8 gallons of urine. If it helps, that technically translates to just 0.000079% of the liquid in the pool. Page 6 HAPPENINGS September 14, 2023 www.hap2it.com I’m up early in my favorite village on the Italian Riviera, as the morning sun touches the tip of Vernazza’s bell tower and greets a peaceful world. The air is damp, cool, and refreshing as I wander downhill, passing underneath the train tracks. I enjoy the fact that the town is essentially traffic-free, and realize that many of my favorite Italian towns — like Venice, Siena, Tuscany’s Volterra, and Lake Como’s Varenna — are all this way. Fiat-free Italy…just the way I like it. Located in northern Italy between Pisa and Genoa, this stretch of five towns along the Italian Riviera is called the Cinque Terre…and it’s the lowbrow, underappreciated alternative to the French Riviera. There’s not a museum in sight, just sun, sea, sand (well, pebbles), wine, swimming, hiking, and pure, unadulterated Italy. Each town fills a ravine with a lazy hive of human activity — calloused locals and sunburned visitors. While the Cinque Terre is now well discovered, I’ve never seen happier, more relaxed travelers. Until the advent of tourism in this generation, these towns were poor and remote. Today, tourism stokes their economies, and each is well connected by hourly trains. But traditions are resilient, there’s not a chain store anywhere, and each of the five villages comes with a distinct dialect and its own proud heritage. To preserve the Cinque Terre’s natural and cultural wonders, Italy has declared the region a national park — towns and all. Visitors buy an inexpensive day pass to hike the scenic trail that laces together the unique communities. Riomaggiore — the most substantial non-resort of the five towns, and the farthest south — is a fascinating tangle of pastel homes that lean on each other like drunken sailors. A cliff-hanging trail offers sweeping coastal views, passing castle ruins and two churches before leading to the town’s tiny harbor. The next town up, tiny Manarola, is a picturesque tumble of buildings bunny-hopping down its ravine to a wild little harbor. The trail ringing the town’s cemetery, on the peninsula north of the main harbor, affords some of the most strikingly beautiful town views anywhere in the region. Find a cliffside café and enjoy tasty treats born right here: pesto on your focaccia, washed down by a glass of crisp local wine that glistens with the reflection of the Mediterranean. Talk about going local. Corniglia, with its mellow main square, is the quiet town — the only one of the five not on the water. From the train station, a footpath zigzags up nearly 400 stairs to the hilltop town. According to legend, a Roman farmer originally settled Corniglia, naming it for his mother, Cornelia (which is how Corniglia is pronounced). Locals claim that its ancient residents produced a wine so widely exported that jars have been found at Pompeii stamped with the town name. Still, today, wine remains the town’s lifeblood. Following the pungent smell of ripe grapes into an alley cellar, I find a local who lets me dip a straw into his keg. Monterosso al Mare, the Cinque Terre’s only resort town, comes with a few cars, lots of hotels, rentable beach umbrellas, crowds, and a thriving late-night scene. Its historic center cradles Old World charm within crooked lanes and hole-in-the-wall shops. Strolling the waterfront promenade, you can pick out each of the other Cinque Terre towns decorating the coast. After dark, they sparkle. With the closest thing to a natural harbor — overseen by a ruined castle and an old church — Vernazza is the jewel of the Cinque Terre. Its action is at the harbor, where you’ll find restaurants, a bar hanging off the edge of the castle, a breakwater with a promenade, and a tailgate-party street market every Tuesday morning. While the old men putter with their tough little boats, the day’s last bit of sunshine seems to sweep the old women and children into a warm corner in front of the church. Leisure time is devoted to the passeggiata (evening stroll), as locals do their vasche (laps), wandering lazily together up and down the main drag. After three days in town — sitting on a bench, gelato in hand, enjoying the endless “ciaos” and parade of neighbors — I feel a part of the scene. Here, I live the phrase “la vita pigra di Vernazza” (the lazy life of Vernazza). I cap my Cinque Terre days on the breakwater with a glass of Sciacchetrà dessert wine. At midnight, the Mediterranean is darker than the sky — except for bobbing lanterns on the horizon. By night, old-school fishermen are seducing anchovies into their nets. By day, the same guys are seducing me with a way of life that refuses to give in to the modern world. MGM Resorts International said that it was investigating "a cybersecurity issue" that forced it to shut down some of its computer systems as Las Vegas guests reported locks on hotel doors not working and a slew of other issues. "MGM Resorts recently identified a cybersecurity issue affecting some of the company's systems," it said in a statement published Monday evening to X, the social media platform formerly know as Twitter. "Promptly after detecting the issue, we began an investigation with assistance from leading external security experts. We also notified law enforcement and took prompt action to protect our systems and data, including shutting down certain systems." It said the investigation into the assumed cyberattack was ongoing and that it was working to understand its scope. An FBI agent with the Las Vegas field office confirmed to KSNV only that it was assisting in the investigation. The announcement came as slot machines at MGM locations on the Las Vegas Strip were reportedly offline and that some guests at its resorts said neither their digital hotel keys nor the properties' ATMs were working. As of late Monday, MGM Resorts's website was still down, and a splash page was directing people to call its specific locations to make a hotel reservation. BetMGM's website was also down as of late Monday, and it asked customers for patience. "Please know that our teams are working hard to get everything up and running," it said. The presumed attack comes as the United States has suffered from a number of cyber-related incidents, including ransomware attacks targeting key infrastructure during the early years of the Biden administration. Page 8 HAPPENINGS September 14, 2023 www.hap2it.com One of the greatest joys of having adult children is knowing I now have the freedom to criticize other parents and their disciplinary methods. OK, maybe “criticize” is too harsh; “actively observe and silently disagree” might be a better phrase. My children are 26 and 21, independent (more or less) and free to make their own decisions without my guidance. Which leaves me with plenty of free time to notice, in grocery stores, airports and other public facilities, millennial and Gen Z couples who have chosen to have children instead of dogs and now realize you can’t cage a child if it acts up. Like my parents, I find myself cringing at what this new breed of procreators consider to be acceptable punishment. I don’t envy today’s parents and the challenges they face. Suffice it to say none of the other parents in my daughters’ kindergarten carpools would have marched into their schools and demanded their severely underpaid teachers stop reading “The Little Engine That Could” because it’s too “woke.” Well, come to think of it, a mother of seven who lived on my block and attended church several times a day may have if she’d been familiar with the word and its meaning. Social media was a novelty in my daughters’ middle and high school years and certainly not the harmful behemoth that, today, is the gateway to bullying, ostracization and, in some cases, suicide. Yes, they both had cellphones at young ages and there were moments I had to lecture them about proper phone etiquette. Was I too lenient in certain situations? My father certainly thought so and wasn’t shy about voicing his opinions, usually at holiday gatherings. I would fruitlessly explain that he may have a different view if cellphones had existed when I was under his tutelage. So maybe I’m overstepping my bounds when I question today’s parents about their punishment tactics. But I am generally curious. At the very least, can somebody with children please answer the following three questions? 1. Have you ever actually gotten to ”three”? Time and again, I see children misbehaving, only to silently snicker as their mom or dad says, “Logan, I am going to count to three.” What follows is the slowest, most drawn out recitation of “one” and “two” that I have ever heard. If I were a professional boxer, got knocked down in the ring and had 10 seconds to get to my feet, I would want one of Logan’s parents to be the referee. The Logans of the world aren’t stupid; they know they still have at least 20 seconds to do whatever has drawn their parents’ ire before backing off 2. What exactly are “privileges”? Because I am always looking for future comedic material and column ideas, I recently started driving for Uber. While taking a couple and their two children to the airport, I heard the dad telling his son if his behavior didn’t improve, he would lose all “privileges.” It’s not the first time I’ve heard that, and now this inquiring mind wants a definition. Maybe it’s because I don’t remember having any “privileges” when I was growing up. In my father’s eyes, being born was a privilege. 3. What, and where, is the “Circle of Trust”? I first heard that phrase when Robert DeNiro famously uttered it to Ben Stiller in “Meet the Parents.” But that was a fictitious movie. When the Uber dad reminded his son that he was approaching a Circle of Trust violation, I wanted to stop my vehicle and ask if I could view the circle some time. Is it actually drawn somewhere in the house? What are the dimensions? These circles must exist somewhere, because I have heard multiple parents refer to them. Parents of young children, if I receive the answers to these questions, perhaps I will no longer roll my eyes or mumble under my breath when your little darlings are throwing tantrums at the bank or the hardware store. Even though my father never understood my concept of parenting, I want to understand yours. So I eagerly await your replies. Don’t make me count to three. Taking a close look how Americans are moving, they reviewed data from both outbound moves and inbound moves to determine migration patterns happening across the country. The past year has revealed some interesting trends, as people nationwide reprioritized what matters to them, grappled with inflation and made moves for meaningful, life-affirming reasons, whether it was to be closer to loved ones or to enjoy a lifestyle they once only dreamed of. Taking a look back at last year’s study — there were some interesting trends we continue to see. For one thing, there was a notable decline in those who moved for a new job or job transfer year-over- year between 2018 and 2021. Although in 2022 United Van Lines did see a slight increase in those making long-distance moves for a job transfer (33.3%) compared to last year (32.5%), that percentage hasn’t come close to the 41.7% seen in 2020 — or the 49.2% of those who moved for job reasons in 2019. Look back even further and those numbers stood at 51.4% in 2018 and 60.1% in 2015. Overall, job transfer-related moves are down more than 21 points compared to 2015, in part due to pandemic-fueled remote work. Although there has been some potential stabilization from pre-pandemic numbers, odds are this overall trajectory will continue. Not surprisingly given the current state of inflation, financial reasons also factored into the drivers for moving in 2022. So, states like South Carolina (14.3%), North Carolina (10.28%), Delaware (16.7%), South Dakota (29.2%) and Alabama (14.5%) proved enticing. Looking at those numbers nationally overall, it was those age 55-64 who appear most impacted by cost of living (10.21%), followed by respondents ages 45-54 (9.47%). The studio shared a teaser trailer for the movie featuring Jason Momoa and Yahya Abdul-Mateen II. Aquaman and the Lost Kingdomis a sequel to the 2018 film Aquaman, which is based on the DC Comics character. The new film follows Aquaman (Momoa) as he protects Atlantis from David Kane (Abdul-Mateen), aka Black Manta, a pirate seeking revenge for the death of his father in the first movie. The teaser trailer shows Black Manta vow to kill Aquaman and "destroy everything he holds dear." Page 16 HAPPENINGS September 14, 2023 www.hap2it.com No common cause found for horse deaths at Churchill Downs & Saratoga The new national organization charged with safety in horse racing announced an extensive investigation has not determined an overriding issue leading to the deaths of 12 horses at Churchill Downs and fatalities at other top tracks. The Louisville, Ky., track shut down its spring race meeting ahead of schedule in the wake of the spate of fatalities leading up to the Kentucky Derby and shifted operations to nearby Ellis Park, which it also owns. Highly regarded Havnameltdown was fatally injured during a race on Preakness Stakes Day at Pimlico and previously undefeated New York Thunder fell just before the finish, while holding a big lead in a major race on Travers Day at Saratoga. Both breakdowns occurred in front of packed grandstands and nationally televised audiences and both horses were euthanized on the track. HISA said its investigation, which was based in large part on work by the tracks involved, state regulators and other agencies, "evaluated three primary factors: 1. the potential role of Churchill Downs' racetrack surfaces in the breakdowns; 2. veterinary records, including the necropsies of each of the 12 horses; and 3. any potential rules violations or procedural deficiencies that may have contributed to the fatalities. "Despite extensive investigation and analysis, HISA did not identify any singular explanation for the fatalities at Churchill Downs. The absence of a singular explanation underscores the urgent need for further action and analysis to mitigate risk stemming from several factors potentially contributing to equine fatalities," the authority said. Mysterious yellow line appears on 23 miles of Florida highway Drivers on a stretch of highway in the Jacksonville, Fla., area reported a mysterious yellow line weaving through lanes, and officials said they are still trying to determine its origins. The yellow line was discovered on a 23-mile stretch of southbound Interstate 95. Drivers said the yellow line, which would usually denote a barrier vehicles aren't supposed to cross, weaves in and out of lanes. Some travelers raised concerns about safety. "It's a yellow line with a yellow line on the other side," Richard Albandy told WJXT-TV. "Most people like, especially if they are out of town, they're not really too much looking at if that's the line that goes where they're supposed to go. They are trying to get to their destination." Florida Department of Transportation officials said they believe the line is the result of paint spilling from a truck, but they have yet to identify the source. FDOT officials warned operators of self-driving vehicles to switch the feature off while traveling in the area to avoid their vehicles becoming confused. Lottery numbers inspired by husband bring woman 'gift from heaven' A Missouri Lottery winner described her $199,000 prize as a "gift from heaven" after using a set of numbers related to her deceased husband. The Missouri Lottery said the Springfield woman bought her ticket from the Kum & Go store in Springfield. The ticket turned out to be a $199,000 winner. "I lost my husband several years ago and the numbers are all related to him," the winner told lottery officials. "I think I'm still in shock. It was like a gift from heaven." The winner did not reveal whether she had any immediate plans for her winnings. Many seniors don't know they have glaucoma, study shows New Swedish research suggests that up to 5% of 70-year-olds have glaucoma, and half of those diagnosed didn't even know they had the disease. "Of those who were diagnosed with glaucoma via the study, 15 people -- or 2.7% of all participants -- were unaware that they had the disease before being examined," said study author Lena Havstam Johansson, a PhD student at the University of Gothenburg and a specialist nurse at Sahlgrenska University Hospital, both in Gothenburg, Sweden. "So half of those who turned out to have glaucoma were diagnosed because they took part in the study." Those who received this diagnosis were able to start treatment with daily eye drops that lower the pressure in the eye and slow optic nerve damage. Researchers noted that those with glaucoma had similar levels of physical activity and did not smoke more or drink more alcohol than those without the disease. Their overall quality of life was as good as the others. They were not more tired or more depressed. "This was a positive surprise, and was a finding that I hope can bring comfort to many people who have been diagnosed with glaucoma. It's hard to live with a disease that gradually impairs vision, but life can still be good in many ways," Havstam Johansson said in a University of Gothenburg news release. Yet, those who had glaucoma did report that their vision-related quality of life was poorer. "It's harder to climb stairs, see curbs in the evening and notice things in your peripheral vision. This means that people with glaucoma may avoid visiting others, or going to restaurants or parties, and instead stay at home. They lose their independence, and may feel frustrated about it," Havstam Johansson noted. coast to coast Climate disasters cost U.S. $2.6 trillion since 1980 The United States has sustained more than $2.6 trillion in estimated total costs due to hundreds of climate disasters over the past 40 years, according to a new report from a subsidiary of the National Oceanic and Atmospheric Administration. The comprehensive disaster cost assessment found 371 extreme weather events since 1980 that each exceeded $1 billion in damage. Costs were incurred through physical damage to residential, commercial, and municipal buildings, and damage to material assets and equipment. Business interruptions and loss of living quarters were taken into consideration, as well as damage to vehicles and boats; public roads, bridges, levees; electrical infrastructure and offshore energy platforms; agricultural assets including crops, livestock, commercial timber; and wildfire suppression. This year alone there have been 23 confirmed climate disasters in the United States, with 253 people killed and estimated losses topping more than $1 billion in each catastrophe, including two floods, 18 severe storms, one tropical cyclone, one major wildfire, and one blizzard. Due to those events, the $3.4 billion that remained in FEMA's Disaster Relief Fund was expected to be exhausted in the coming weeks. In January, NOAA issued a report saying there had been 18 billion-dollar weather disasters in 2022 as climate change was increasingly fueling severe weather nationwide. On average, the nation was experiencing about eight disasters per year, and an average of about 18 disasters every five years, the report said. The report comes amid several recent climate studies that warn of worsening conditions in the decades to come and as the planet experienced the hottest threemonth period in its history this summer, punctuated by new heat records across the globe.

www.hap2it.com September 14, 2023 HAPPENINGS Page 23 Q: I own five acres of land with two other people. Two of us have paid all of the property taxes on the property for 30 years. Is it possible for the two owners who have paid the taxes to take ownership of the property? The third owner was deeded his share of the property about 30 years ago but has never paid anything. Now that owner has filed for the judicial sale of the land. Doesn’t paying property taxes give us the rights of ownership? Do you have any advice for us? A: We receive similar questions of yours from time to time, and our answer is generally the same. You don’t automatically become the owner of a property simply because you paid the real estate taxes and maintenance costs. You might have heard the term “adverse possession.” Adverse possession does allow you to become the owner of a property if you openly and notoriously make use of someone else’s land, you pay the real estate taxes on that land, and you use the land exclusively for at least 21 years. (In some situations, it may be less time depending on the laws of your state.) Here’s how it might work. First, you claim the property as your own. You don’t let others use the property — even the rightful owner. And, you do everything an owner would do with that property including maintaining it and paying the real estate taxes. In this scenario, the rightful owner is likely nowhere to be found. They may have forgotten about the property. Or, they may have unknowingly inherited it. Or, they simply stopped looking after it because they couldn’t afford it. You step in and start using the property. You treat it as your own and even let everyone else know that it’s yours. In your case, we don’t think you pass the adverse possession test. First, you acknowledge the third owner’s right to the property. Next, while you make reference to that owner’s failure to pay expenses, you don’t assert that you used the property exclusively as your own. You don’t say, for example, whether you kept him from using or accessing the property. We bet that you reached out to him over the years requesting reimbursement for expenses. Even if you never got an answer back, reaching out means you were acknowledging that owner’s interest in the property. Let’s say you find that you did have ownership of the property for the required period of time in your state (the number of years varies somewhat by state), and can claim adverse possession. You’d still need to go to court to prove your case and get sole ownership of the property. So, adverse possession is a real long shot. That said, there may be a way for you to get reimbursed for some or all of the money you and the other owner shelled out over the years. From your letter, it looks like you and the other owner paid all the expenses for the property over 30 years. We don’t know if you lived there or rented it out. If you lived there and got the benefit of the use of the property, then it’s fair for you to pay for the real estate taxes and other maintenance expenses for the property. If you and the other owner rented the home, did you share the rent with the third owner? If so, then you could have deducted his share of the maintenance and taxes from the income generated by the property. If not, then it’s fair for you two to pay those expenses (like repainting or replacing appliances) out of the rent generated. When it comes to long-term improvements to the property, those might fall into a different category. Say you put on a new roof, a new heating and cooling system, new bathrooms and a new kitchen in the last couple of years and now you sell the home. You can claim that you and the other owner should get reimbursed for the improvements you made to the home out of the sale proceeds. And this line of thinking shows how you and the second owner might get reimbursed for your expenses over time. Let’s say that you and the second owner never rented the property and maybe never used it. You just paid the expenses for 30 years. We don’t think it’s fair that the third owner gets the benefit of the money you put into the home when the home is sold. You’d likely need to determine what you put into the home and how those improvements increased the value of the home so that on the sale of the home, you could get reimbursed for one-third share of the expenses over time and the second owner could get reimbursed for their one-third share. If you and the second owner used the property exclusively for 30 years, and you were friendly with the third owner, then perhaps you’d share the profit equally. If there was a mortgage outstanding, then you’d share the profits after paying that off. Of course, we understand that there may be other complicating factors involved that could change these parameters. But it doesn’t sound like a friendly situation. The third owner wants to force the sale of the home by going to court. Given this situation, you’ll need to sit down with your attorney and figure out first whether you qualify for adverse possession. If you don’t, then you need to figure out how much money you and the second owner put into the home through the years. You also need to look at the value you received and decide what will make you whole. Then, you can propose a split with the third owner. One final thought: If the property in question is vacant land and you never leased or received any benefit from owning the land, you have a good case to claim that the taxes you paid over all those years were your investment into the land and you are entitled to a return on that investment ahead of the owner that never put any money in. We hope the court would allow you to recover the money you put into the property along with a fair return on that money. Then, if there is a profit, dictate how to split that profit between the three of you. Good luck and let us know what happens. Does paying property taxes give you the rights of ownership? I agree with you that a parent should hesitate to put a child on the deed to the parent’s residence for all the tax reasons you cite. But another reason against putting a child on the deed to Mom’s residence is that it makes Mom’s house a target for any creditors of the child. It could also make the property subject to claims of the spouse of the child if the child and the child’s spouse are divorcing. For example, suppose the child is faced with an IRS lien. If the child is an owner of the house, the IRS could force a sale of the house. And, then Mom may have to move. Whereas if the child’s name is not on the title, the mom could, but would not be legally required, to pitch in to solve the child’s IRS debt. A similar scenario arises if the child is involved in a divorce. Mom could choose to help her child come to a financial settlement with a divorcing spouse. But if the child’s name were on the deed, the divorcing spouse may have the right to threaten Mom that she must sell her residence to satisfy her child’s spouse’s claim to a portion of the child’s interest in Mom’s house. Ilyce and Sam respond: You make a very good point. We frequently get questions from our readers about this issue. Sometimes a parent writes about adding one of their children to the title of their home. Other times, children write about wanting to put their name on the title of their parents’ home. In both of these instances, the reason the parents or kids want to do this is to make it easier for the home to go from parent to child upon the death of the parent. When two people own a home as joint tenants with rights of survivorship, if one of them dies, the other automatically becomes the sole owner of the home. There is no need to do anything. The process is automatic. When it comes time to sell the home, the surviving owner would need to provide proof of the death of the co-owner. Then, the sale could proceed. In some states, the survivor might need to provide the closing attorney or settlement agent some additional paperwork. But that paperwork is usually quite minimal compared to having to go through probate and get the probate court to approve the sale of the home. Another problem with having a child on title to the home with a parent relates to the Internal Revenue Service. There are taxes the parent would owe when the home is sold or that the child might have to pay when the child sells the home after the death of the parent. When a parent owns a home and dies as the sole owner, the child inherits the home at the home’s value around the time of the parent’s death. Say the parent purchased the home for $50,000 many years ago. And if the home is worth $500,000 at the time of the parent’s death, the parent’s estate will likely not have any taxes to pay the IRS unless the parent was very, very wealthy. And, the child could move to sell the home within a year after the death of the parent and keep the proceeds from the sale without paying any taxes on the profit. Since the child “acquired” the home and sold the home for the same value, the child would have no tax liability. The sales price would dictate the value for both the value at the time of the parent’s death and the value when sold. Frequently, parents or children get into financial trouble or make mistakes. When that happens, you don’t want to become embroiled in your parent’s or children’s financial problems, simply because you thought you’d do something good and put your name on your parent’s home. There are so many thorny issues that could creep up. You mentioned Internal Revenue Service liens and divorce issues. But you can also have Medicaid issues, where money is owed for the care of the parent. And you can have litigation situations where the parent becomes involved in unfortunate circumstances and the child then becomes part of the same. Likewise, if the child does something that results in litigation, the parent’s home could become part of the case as well. Thank you for your comment. If you've been around long enough, you can spot ones that have lots of sizzle but most likely won’t stand the test of time. I had that feeling 40 years ago when I first saw colored concrete paving bricks. It turns out my gut feeling was correct. The evidence is all around you that concrete paving brick can’t lace the boots of true clay paving brick. Here are just a few of the reasons. You might have a patio paved with concrete bricks, or you might walk on them at a park or outdoor shopping mall. These pavers come in many shapes, sizes and colors. Several years ago, my wife wanted an instant outdoor patio, and I could only satisfy her desire by using largeformat concrete patio stones that came in different sizes. They interlocked in a random ashlar pattern. The large pavers I used were made the same way as the concrete brick you may have. Concrete companies mix small stone chips, coarse sand, Portland cement and dry pigments together with a precise amount of water. The mix is poured into molds to make the brick or larger pavers. They’re cured to gain maximum strength, and the colors are rich when the products leave the manufacturing plant. The color you see is created by the ultra-thin pigmented cement paste covering the sand and gravel at the surface. By contrast, real bricks are made from clay. The clay is cut into the final brick shapes and then fired in a huge kiln. The high-temperature firing process produces a chemical change in the clay, creating an artificial rock of sorts. Clay paving bricks don’t change color over time. Concrete paving bricks fade and change color. The thin-colored cement paste in concrete pavers wears off with normal wear and tear; you can blast it off using your power washer. After one or two cleanings, the color of the stone chips and sand starts to dominate the surface appearance. Another issue with concrete paving bricks is the way they’re set. Almost all are set in a bed of sand. Burrowing animals can and do tunnel through the sand. The bricks can settle and tilt, and they look horrible in short order. I know this because it happened at my own home. I didn’t build the house I live in, and I inherited two walkways made of concrete paving brick when I bought this home. One walkway looks better than the other, but both no longer are as flat as they were when installed. Weeds and concrete paving bricks are like peanut butter and jelly. You can count on weeds growing up in between the bricks if you live where you get enough water to support the growth. A weed hacker can be used to trim the visible growth, but days later the weeds sprout new green growth. Ants love concrete paving brick. They transport the sand underneath the brick up to the surface as they create comfy nests. You can broom or blow the sand away with little effort, but it’s just another nuisance to deal with. The gaps between concrete paving bricks are typically filled with fine sand. Some pavers have tiny bumps on the sides so a wider joint between each brick is created once installed. My largeformat pavers had this. Manufacturers have known for decades that people love to clean their concrete pavers with a power washer. The issue is no matter how careful you are, the high-pressure stream digs out the sand. The manufacturers responded by inventing polymeric sand. This is just sand that comes with a water-activated adhesive. When I first saw this product, I was skeptical. I simply couldn’t believe that a water-based adhesive could withstand Mother Nature. Once again, my gut instinct was spot on. I used polymeric sand between the pavers of the patio I built for She Who Must Be Obeyed, knowing that it was doomed to fail. I followed the instructions to the letter, and the sand looked fantastic for two years. Then it slowly succumbed to the harsh New Hampshire winters. I have weeds growing on my patio, some of the sand is missing, and it all needs to be redone. If you want a trouble-free brick patio, my suggestion is to do what I’m starting to do at my son’s house. We’re installing thin split clay paving brick on a steelreinforced concrete slab. The space in between each brick will be filled with mortar that will test out at 12,000 pounds per square inch.
