Page 4 HAPPENINGS March 16, 2023 www.hap2it.com It's Always Sunny in Philadelphia and Hacks actress Kaitlin Olson says she hopes her new sports comedy, Champions, shows how success can be redefined and joy found in unexpected places. Directed by Bobby Farrelly and in theaters now, the film stars White Men Can't Jump and Semi-Pro actor Woody Harrelson as Marcus, a hottempered minor league basketball coach who, after a drunk-driving arrest, is courtordered to manage a team of young-adult players with intellectual disabilities. Olson plays Alex, a Shakespearean actress who devotes her life to her brother, Johnny (Kevin Iannucci,) one of the players, even though he is ready to be more independent. "I love that, in this movie, the Friends team are underdogs, but also Marcus is an underdog," the actress said in a recent Zoom interview. Alex and the players challenge Marcus' idea of success and "his blindness to what's really going on in front of him," Olson said, referring to how the teammates hone their skills in the game while also working together as a team and facing their individual fears. "I love that Alex and the Friends are the ones who help Marcus understand. Who knows if they win in the end or not? Ultimately, it doesn't matter. There are tiny wins along the way," she added. "Little wins are what make up a happy life." Olson described Alex as independent, but also "fiercely loving and loyal." "I love how well-rounded she is and I love that it is different from anything I've done on camera in a while," she said. The Champions cast and filmmakers avoided tropes that could turn a well-intentioned story into one that feels inauthentic or overly sentimental. "You could easily screw up comedy and vulnerability, and this script was really written so beautifully. I thought it was legitimately funny. I thought the character was legitimately funny," Olson said. "It doesn't hammer 'heart' down your throat. It just happens to be a really beautiful, lovely, feel-good movie." Scenes in which Marcus and the team pile into Alex's van to go to away games were among Olson's favorites to shoot. "Those were fun because we were all together. We were all in one space," she said. "Those costars were so fun and so silly, and they had strong opinions about their characters." Trapped in "freezing-cold Winnipeg," Olson said the cast members developed an affection and respect for each other that extended past when the cameras stopped rolling. "Madison Tevlin, who plays Constantino, she had a birthday. Her mom threw her a big party and we all went. It was a huge dance party and we had so much fun. We had meals together. We went out together," the actress said. Olson called Harrelson "a wonderful scene partner." "We did some tricky scenes together," she said. "It was nice to have him on the other end giving me back all of those feelings that I really needed to feel in order to perform." Comedy legend Cheech Marin appears in the supporting role of Julio, manager of the recreation center at which the Friends team practices. As the team advances to the finals, Alex and Julio spend considerable time in the bleachers cheering them on. "I saw a lot of his camera roll on his phone and heard a lot of stories. They were all fantastic," Olson said of Marin, laughing. "We had a lot of time in the stands with the cameras not on us, and those were really fun days." After college, she moved to Los Angeles to pursue an acting career. Olson started as a member of the improv troupe The Groundlings along with Dax Shepard. She began landing guest appearances in shows such as “Curb Your Enthusiasm,” “The Drew Carey Show” and more. In 2004 she was cast as Dee Reyonlds in the FX sitcom “It’s Always Sunny in Philadelphia.” The role was initially filled by actress Jordan Reid, who was dating show star and co-creator Rob McElhenney, but was recast after the two broke up. Pre-production of the show’s 16th season began earlier this year. In 2017, she starred and executive produced her own show with the Fox sitcom The Mick. Olson received solid reviews for her role, but the show was ultimately cancelled after two seasons. Olson married her “Always Sunny” co-star Rob McElhenney in 2008. The two started dating secretly during the second season of the show. They remain together today and are now the parents of two boys. www.hap2it.com March 16, 2023 HAPPENINGS Page 5 Medicaid Update The Affordable Care Act, originally passed in 2010 and sometimes called Obamacare, created access to health care for millions of Americans. In less than two months, states that had expanded Medicaid under new ACA provisions will be able to return to regular Medicaid renewal processes, as a part of the unwinding of COVID-19-related coverage requirements. A survey by the Urban Institute says 64% of adults in Medicaidenrolled families are unaware of the pending renewals, suggesting many may not have completed the necessary steps to maintain coverage or, if no longer eligible, find health coverage elsewhere. The blame, said surveyors, appears to largely lie with states and agencies that have not engaged in widespread education outreach efforts. "The end of the public health emergency's continuous coverage requirement means millions of people are at risk of losing continuous coverage in Medicaid, which they have relied upon for nearly three years," said Gina R. Hijjawi, senior program officer at the Johnson Foundation. "States and the federal government must quickly raise awareness that many families will soon need to take steps to maintain or find new health coverage." Stories for the Waiting Room In movies and novels, the scene is inherently dramatic: a doctor telling a sick patient that they have just months, maybe a year, to live. In reality, such prognoses almost never happen, or more precisely, they are rarely accurate. By some estimates, even terminal prognoses reluctantly made in intensive care units housing the sickest patients are only accurate around 20% of the time. A physician might refer to an estimated survival rate, usually referencing the percentage of people with a condition who are alive five years after diagnosis. But that's a very general number based on a large sample size. Some people in the sample will have died before five years, some will have lived much longer. After decades of improvement, Americans now live, on average, their shortest lives in nearly 20 years. To test the market, the product was sold in 18 retail stores to see how consumers would react to frozen foods. Inventor Clarence Birdseye got the idea after watching Canadians thawing and eating naturally frozen fish. For seven years, he worked on freezing processes, first fish and then other foods. The initial Birds Eye line featured 26 items, including 18 cuts of frozen meat, spinach and peas, a variety of fruits and berries, blue point oysters and fish fillets. Page 6 HAPPENINGS March 16, 2023 www.hap2it.com Josh Segarra said his two upcoming roles -- Scream VI, now in theaters, and Apple TV+ series The Big Door Prize, streaming March 29 -- show how he distinguishes each role he plays. "I want all my characters to look different," Segarra said in a recent phone interview. "I like hiding behind my characters' masks." In the Scream sequel, Segarra, 36, plays Danny, a neighbor with whom survivor Sam (Melissa Barrera) has a secret relationship. When new Ghostface killers pursue her and her sister, Tara (Jenna Ortega), Danny becomes embroiled in the horror, too. Big Door Prize casts Segarra as Giorgio, the owner of an Italian restaurant in a small town. A machine mysteriously appears in the town corner store, which tells users their purpose in life. Learning their presumed purpose affects each character in town differently. Homework for 'Scream VI' "One of my favorite things to do when I get a script is try to find what makes the character I'm playing tick," Segarra said. "What is their heart? What makes them feel?" His Danny character is new in the Scream series, but he has a history with Sam, who is returning to the franchise. Segarra said he welcomed the opportunity to fill in the gaps. After surviving the events of 2022's Scream, Sam is wary of any strangers, including those in her sister's life. The fact that she trusts Danny says a lot, even though she won't tell any of her friends about him. "I think he understands the secrecy," Segarra said. "There's part of her that she's probably still protecting, just to be safe, and he understands that sometimes those walls take time to knock down." Danny is involved in some of Scream VI's harrowing killer scenes. In one, he extends a ladder between his apartment and Sam's so she and her friends can crawl across to escape Ghostface. "That's me pulling that ladder," Segarra said. "I opened that ladder and chucked it across the alleyway probably 100 times, so I got my workout in." Segarra said the ladder scene took five days to film on a set in Montreal that doubled for the film's New York setting. The sequence exhausted all of his costars, too. "By day five, we were all sitting off set, nursing these wounds, drinking our water and Gatorade," Segarra said. In another scene, Danny accompanies Sam and her friends onto the subway. As they evade Ghostface, they wind up on a train to Halloween parties with passengers dressed as Ghostface and other horror movie characters. "A bunch of Easter eggs on that train reminded me of many Halloween nights that I've had in New York City," Segarra said. "So hopefully, now we're putting a little bit of fear into folks next time they get on the train." 'The Big Door Prize' The Big Door Prize introduces Giorgio with a lot of swagger. He retired as a New York Rangers goalie after an injury, but keeps sports memorabilia at his restaurant and continues to wear athletic tracksuits. Segarra said Giorgio's athletic persona allowed him to play with "his layers, figuratively and literally, his layers." Giorgio is Italian and Puerto Rican on The Big Door Prize. Segarra is Puerto Rican, having grown up in Florida and moving to New York to study at New York University. He said he wanted to make the Italian side of Giorgio accurate. "When he drops certain Italian phrases, I definitely wanted to make it as authentic as possible," Segarra said. "I hope to do it justice. I hope people giggle along the way." While Danny kept his relationship a secret out of respect for his partner, Giorgio keeps secrets to project a certain image to his neighbors. Segarra said the 10 episodes of The Big Door Prize allow him to reveal what's beneath Giorgio's surface. "You'll realize that he's all heart," Segarra said. "He's all love. He's full of passion." 'The Other Two' Segarra filmed The Big Door Prize before Scream, but both after his role on Marvel's She-Hulk: Attorney at Law. However, Segarra said both Scream VI and Big Door Prize's filmmakers were inspired to cast him by the comedy The Other Two. The Other Two premiered on Comedy Central in 2020 and moved to HBO Max for Season 2. Segarra said Season 3 wrapped two months ago. The Other Two stars Drew Tarver and Helene Yorke as Cary and Brooke Dubek. The Dubeks are struggling with their place in the entertainment industry when their younger brother, Chase (Case Walker), becomes a famous recording star. Segarra plays Lance Arroyo, Brooke's ex-boyfriend who remains in the Dubeks' life. Lance even has nicknames for all of them. "There's no way Lance is leaving the Dubeks," Segarra said. "He loves Chase too much, he loves Care Bear too much, he loves Cook Brooke too much. Mom Dubek, that's his girl." Molly Shannon plays matriarch Pat Dubek, who got her own talk show in Season 2. Lance is an aspiring shoe designer, but originally worked at a restaurant, one Segarra knew from his own dining experience. "When I originally read the script, Lance worked at Medieval Times," Segarra said. "I've been many a time to the Medieval Times, so I knew exactly what they were going for." When The Other Two changed Lance's job to Foot Locker, with his own design aspirations, Segarra said he didn't miss a beat. He worked at a shoe store in Orlando and said he drew on his sales experiences pushing Buy One, Get One Free deals. Outside of his shoe business, Segarra thinks Lance is a positive influence in Brooke's life. However, Segarra won't reveal if they end up together in Season 3. "He loves Brooke for the parts of her that maybe she doesn't even love about herself but he tells her it's all okay," Segarra said. "We all could use a little bit of Lance in our life." Strolling across the square with Carlos, my guide, we passed a young man walking alone who suddenly burst into song. I asked Carlos why and he said, “Doesn’t it happen where you live?” Northwest of Madrid (1.5 hours by high-speed train), Salamanca is youthful and untouristy, displaying its mighty monuments, clusters of cloisters, and magnificent square with quiet pride. Carlos and I sat down at a table with a prime view of the square and all its people-action. Carlos ordered us a simple but elegant meal: a plate of cured ham, patatas bravas (chunks of potatoes with tomato sauce), and glasses of robust local red wine. When the ham arrived, he told of his grandpa thinly carving a jamón, supported in a jamonero (ham holder) during Christmas, painting a holiday image that reminded me of my dad carving the turkey at Thanksgiving. Our view was filled with people. Plaza Mayor has long been Salamanca’s community living room. The most important place in town, it seems to be continually hosting some kind of party. Spaniards love their paseo (evening stroll) – it’s like multigenerational “cruising” without cars. While the old-timers gossiped and “tsk-tsked” at the young people, those young singles were out to see and be seen. Carlos explained that historically, the square was a big viewing arena where the men circulated one way and the women circled the other so everyone got a chance to check everyone out. Flirting still rages, as the boys are on a quest for the perfect queso (cheese), meaning a cute dish. Perhaps the best time of all for people-watching is Sunday after Mass, when the grandmothers gather here in their Sunday best. The Plaza Mayor is just the starting point for a Salamanca visit. Salamanca’s University, the oldest in Spain (1218), was one of Europe’s leading centers of learning for 400 years. Columbus came here for travel tips. Today many Americans enjoy its excellent summer program. The old lecture halls around the central cloister, where many of Spain’s Golden Age heroes studied, are open to the public. Some of the rooms are still used by the university for prestigious academic ceremonies. The entrance portal of the university is a great example of Spain’s Plateresque style (Spain’s version of Flamboyant Gothic) – the style named for masonry so intricate it looks like silverwork. In the University’s Hall of Fray Luis de Leon, the tables and benches are made of narrow wooden beams, whittled down by centuries of studious doodling. The professor used to speak from the church-threatening cátedra, or pulpit. It was here that freethinking Fray Luis de Leon angered Inquisition forces by bringing the scriptures to the people in their own language. After being jailed and tortured for five years, he returned to his place and started his first postimprisonment lecture with, "As we were saying…" Near the university stands the Church of San Esteban, dedicated to St. Stephen (Esteban) the martyr. The church contains impressive cloisters, a pantheon of tombs, and a museum with illustrated 16th-century choir books. But everything is overwhelmed by the church’s Churriguera altarpiece, a textbook example of the style named after the artist. Quietly ponder the goldplated cottage cheese as tourists shake their heads and say "too much" in their mother tongue. For a fun meal, do the tapa tango. Salamanca bars offer a great selection of tapas, or appetizers, featuring a tasty variety of treats – seafood, salads, meat-filled pastries, deep-fried goodies, and so on. Wash down your tapa with iced gazpacho (spicy tomato soup), a cool treat on a hot day. Don’t miss the charms of the sunny sandstone city of Salamanca – with Spain’s grandest plaza, its oldest university, and a fascinating history all swaddled in an affordable and fun-loving collegetown ambience. By Rick Steves travel Transportation Department urges Congress to ban airline family seating fees Transportation Secretary Pete Buttigieg urged Congress to pass the necessary laws to guarantee families are allowed to sit together while traveling by plane, without incurring extra fees. In a letter released, Buttigieg called on lawmakers to mandate the fee-free family seating on all American carriers. "Upon review of the airlines' seating policies, DOT remains concerned that airlines' policies do not guarantee adjacent seats for young children traveling with a family member and that airlines do not guarantee the adjacent seating at no additional cost," Buttigieg said in the letter. Buttigieg proposed legislation that would include a provision that would "explicitly state that U.S. and foreign airlines shall seat young children adjacent to at least one accompanying adult at no additional cost, subject to certain conditions such as the family being booked in the same class of service." This comes a week after the Department of Transportation opened a new online family seating dashboard to assist passengers searching for which airlines will allow them seat their families together without extra fees. The Department of Transportation then encouraged all airlines to join the portal. Airlines often require additional fees in order for families to sit together on a flight. Alaska Airlines, Frontier Airlines and American Airlines, the country's biggest carrier, guarantee fee-free group seatings for families. Pushing back against those charges has been a priority of President Joe Biden's administration. Biden called on Congress to pass legislation to ban the fees during his recent State of the Union. Epic agreed to pay $245 million in fines, the FTC said in its order. The commission contends the North Carolina-based game maker used dark patterns to trick players into purchases. Children ended up getting billed for unauthorized charges without parental consent. Once finalized, money from the settlement will go toward refunds to game players. "Fortnite" is free to download and play but offers numerous in-game upgrades for a fee. Consumers can apply for refunds through the FTC's website. Maryland man collects $50,000 lottery prize - - his fourth big win A Maryland man bought a scratch-off lottery ticket and ended up visiting lottery headquarters to collect his fourth prize of at least $50,000. Kenneth Weinberg told officials he chose the $50,000 Cash scratch-off ticket from a local store because of recent good experiences with the game. The $20 ticket turned out to be a $50,000 top prize winner. "It directed me to go to the lottery office, so I knew it was too big a winner for the store to pay," he said. Weinberg previously visited lottery headquarters on three occasions to collect prizes of $50,000 or more. His largest prize was $100,000. Weinberg said his latest winnings will go toward home remodeling projects. 8.2M tune in for 'Last of Us' finale About 8.2 million people tuned in to watch Sunday's The Last of Us Season 1 finale on HBO Max and its linear platforms. "The series is now averaging 30.4 million viewers across its first six episodes, with the first episode approaching 40 million viewers in the U.S," HBO said in a press release. "DOT has made clear to Southwest that it must provide timely refunds and reimbursements and will hold Southwest accountable if it fails to do so. A study from the University of Houston found that those living in the country were not more satisfied with their lives than people who lived in urban areas. Rural U.S. residents didn't feel like their lives were more meaningful, and they also tended to be more anxious, depressed and neurotic. Among the reasons for this are a shortage of mental health professionals, and the researchers noted a surge in rural hospital closures since 2010. Almost 85% of all rural counties have a mental health professional shortage, even though rural residents appear to need more psychological services, according to the study. "It will be critical to improve access to psychological services in remote areas, and to identify how characteristics and values of rural communities can be leveraged to promote positive psychological health," said researcher Olivia Atherton, an assistant professor of psychology at the University of Houston. Atherton and her colleagues looked at whether there were different levels and changes in extraversion, agreeableness, openness, conscientiousness and neuroticism. They also examined whether there were differences or change in psychological wellbeing and life satisfaction across adulthood. "Given the far-reaching consequences of rural health disparities for individuals, families and communities, there is a pressing need to identify the psychological, social and structural mechanisms responsible for disparities and the ways in which to intervene upon those mechanisms to improve the health of rural Americans," Atherton said in a university news release. He'll be going on the road with 21 Savage in support of their joint album Her Loss featuring the hit "Rich Flex." The tour kicks off June 16th in New Orleans and includes two nights, July 5th and 6th, at the United Center in Chicago. This is Drake's first tour since Aubrey & The Three Amigos tour in 2018. The app, which has become increasingly influential in connecting musicians and fans, was Sheeran's choice to release an acoustic version of the single. Ariel wants to know more about the creatures above the sea, so she makes a deal with sea witch Ursula (Melissa McCarthy) who will allow her to become human for a trial period as long as Ariel is willing to give up her voice. Ariel's underwater world is beautifully represented in the 2-minute, 20- second trailer, which also features Bailey singing the theme song "Under the Sea." The trailer was introduced by McCarthy and Bailey during Sunday's Oscars telecast, taking advantage of its broad global audience. "It has been such an honor stepping into the iconic role of Ariel," Bailey said. "It was an extraordinary experience, a dream come true for me." The cast also includes Daveed Diggs, Awkwafina, Jason Tremblay and Lin-Manuel Miranda. The sellers had started to remove and remediate some old underground oil storage tanks. The seller’s attorney and our attorney ended up recommending that we take a credit for the remediation estimate rather than have the seller finish the job. We closed and then found out our attorney did not read the remediation estimate correctly. The attorney never sent us the estimate either. The estimate was for only one of the three areas that needed to be remediated and did not include the transportation charge for any contaminated soil. Our attorney has taken no responsibility for his actions. The sellers refused to do anything because the estimate was accepted and the closing had occurred. We were never given a chance to review documents, lab results, etc., with our attorney. The attorney never warned us of the consequences associated with buying a property with contamination and our attorney never requested any money be put into escrow in case the remediation cost was inaccurate. Our attorney specifically stated he would get documents relating to the remediation started by the sellers but never finished. Now we have a nightmare on our hands with remediation estimates up to $100,000. We have looked into hiring an attorney but have had no luck. Our attorney’s position is that we accepted the seller’s estimate so there is nothing he can do. All of these issues could have been avoided if our attorney had kept us informed and had sent us the documents to review. What should we do? A: What an expensive, unfortunate mess. From what you have described, it does not appear that you received the representation you deserved and, presumably, paid for. We are sorry you are in this situation. When it comes to environmental matters, Sam always advises his clients to not close on the property (commercial, industrial or residential) until the issue is resolved. In some parts of the country, buyers typically hire a real estate attorney to represent them in the purchase of a home. That attorney will work for the buyer and has a duty to represent the buyer and advocate for the buyer. In states where a buyer hires an attorney to act as a settlement agent, the attorney does not have a duty of loyalty to the buyer. The buyer has to make sure that they understand what they are getting into before sending money to close or agreeing to close on a purchase of a home. We believe that whether you live in a state where buyers typically hire attorneys to help close house deals or not, you should hire a real estate attorney if you have a serious environmental issue with the home you want to purchase. What kind of environmental issue would give us pause? Lead paint, asbestos tiles or insulation, elevated levels of radon gas, and mold issues are the top environmental issues you’ll find in homes. While environmental issues can be a cause for alarm, there are different degrees of harm: Where there are elevated levels of radon gas, you may be able to remediate the problem by installing a radon mitigation system for less than $2,000. Lead pipes are a big concern and can be costly to replace. A main water supply line may cost up to $20,000, or more. Mold is always problematic. But if the mold (and the water infiltration causing the problem) is contained, it might be an easy fix. However, if mold is everywhere in a home, it can be a huge problem. Asbestos tiles or insulation requires specialists who are licensed to remove and dispose of the material. It can be an expensive job depending on the size of the problem. In all of these cases, you can get a handful of estimates for the remediation, and those will generally be on target. When it comes to underground storage tanks, the problem can be minor or huge. A minor problem is a small residential tank that needs to be removed but there is no evidence that the tank leaked. Multiple tanks and leaking tanks raise the price for removal. You may even have to pay to clean the soil. But you won’t know for sure until you investigate further. Depending on the situation, you may not know the true extent of the problem until you begin the process of removing the tank. Your attorney should have kept you in the loop on the negotiations with the seller. He should have discussed the risks involved with undertaking the removal of the tank based on an estimate. And, he should have sent you the estimate(s) and kept you advised of what was happening with them in the transaction. Hindsight is 20/20. Had the environmental company done the work in line with the estimate, you would not be complaining even if the attorney had not kept you informed. But the situation got way out of hand, and you’re now left footing an expensive bill. Here are some issues to think through: What amount of disclosure on the tank issue was required of the sellers under the laws of your state? Did the sellers give you sufficient disclosure of the issue? Since the seller started the removal, did the sellers have a duty to complete the removal? Does your agreement to complete the removal absolve the seller from issues that were not disclosed in the estimate? Lastly, we remind our readers that if you haven’t hired an attorney to specifically represent you in a closing, you do not have legal representation. If something goes wrong in the transaction, that may have financial consequences. In these areas of the country where attorneys are not used to help buyers or sellers close their deals, any attorneys in or around the deal act as settlement agents or closing attorneys or are attorneys representing the lender. These attorneys merely work to close the transaction but do not represent the seller or the buyer in the closing. They do not owe you any fiduciary duty. The seller and buyer are left to make their own decisions and judgments, including whether to proceed and close on the home. This saga transpired over the past six weeks, and I feel it contains a valuable lesson that could save you thousands of dollars, allow you to sleep at night, and go to dinner with your remodeling contractor at the end of the job. This is a tale about trust, honor and betrayal. Perhaps you’ve been betrayed in the past by a friend, a lover or a contractor. No matter who it is, it’s always painful. Weeks ago, a woman who lives in Ontario, Canada, purchased one of my short phone call consultations. She was upset about a new exterior door that was installed in the basement of her home. She called to ask me if it looked OK or if she was just being too persnickety. As I always do, I asked her to send me as many photographs as possible so I could get a handle on the situation. Fortunately, she sent great ones that allowed me to see every aspect of the job. This job was very complex. The homeowner had decided to build a new patio beneath a deck. The basement of the house was only partially below grade, and the door was installed in the exterior wall in the basement under the outdoor deck. To make the whole scheme work, the contractor had to excavate the ground beneath the deck to be able to install the patio. This patio extended to the columns supporting the outer edge of the deck. The contractor may or may not have known this, but the footing piers under these columns would have to be sunk lower into the ground, as they no longer would have enough soil cover to protect against frost heave. I immediately saw a grave error in one of the photographs. The contractor had cut a notch in the house foundation to accommodate the new door. But the top of the notch was 6 inches above the basement floor! Other photos indicated that he had already installed the new patio outside, and that was also above the basement floor. I couldn’t tell if the patio was sloped away from the house so as to direct water away from the basement. The notch in the foundation was not wide enough. This meant it was impossible to position the door far enough back in the wall in line with the wall framing that sat on top of the foundation wall. But it gets worse. The contractor had not created a slope on the horizontal part of the notch in the foundation. This slope is necessary to shed water away from the underside of the door threshold. Without this slope, there is a very good chance water will leak into the basement under the threshold. I told the distraught woman that I could make a simple color drawing showing exactly where the door frame should be in relation to the exterior of the concrete foundation and the existing wood-frame exterior wall. I also sent her several links to great illustrations and cross sections that I found on the websites of leading manufacturers of exterior doors. Furthermore, I sent her links to several YouTube videos, including one of mine, that showed how to install a new exterior door in an existing wall. I believe she watched them, but it’s possible she didn’t comprehend all the information. The good news is that she is still in possession of well over $30,000. I told her under NO circumstances to release another dollar to the contractor until the door is installed correctly. She followed this advice. But just a week ago she texted me to say that the contractor was putting all sorts of pressure on her to pay him a large sum of money, even though nothing had been done to correct the door installation. This woman also got a call from the contractor’s family divorce lawyer demanding money from her. Can you believe that? You might now understand why the contractor was trying to get his hands on money. The bad news is that the woman told me she was about to hire an attorney to sue the contractor. I told her in no uncertain terms NOT to hire a lawyer. I wrote a column about why not to do this two years ago. You can find that column at my website, AsktheBuilder.com. The simple reason is you have better odds of winning at blackjack in Las Vegas than winning a judgment against a contractor and getting paid. First and foremost, we already know this contractor has no money! How could all of this been avoided? The woman should have had superb drawings showing exactly how everything was to be installed. There should have been detailed and crystal-clear written specifications. She should have then talked to the general manager of the best traditional lumberyard in her city to find out the names of the contractors the GM would use to remodel his house! I find it odd that this house has been contingent for over six months! I want to submit a backup offer. How can I find out if their deal is rocky or just slow to go through? A: The residential real estate market continues to befuddle most buyers these days. Millions of homeowners are locked into extremely low interest rates and have no desire to sell. Meanwhile, hedge funds and private equity groups have bought tens of thousands of homes to keep as rental properties. This has led to far fewer properties being listed for sale. Meanwhile, between rising interest rates and the high cost of homes, many buyers are finding they can’t qualify for loans. You found a property that shows as “under contract” in the multiple listing service. The listing also shows that the sale is “contingent.” Let’s start with what “contingent” might mean in this context. Real estate agents generally use a multiple listing service for their properties. The goal is to get as much information out about a property to other agents, so those agents will bring their buyers (and hopefully an offer). Once the seller signs a contract with a buyer, the property is considered to be “under contract.” However, buyers may have certain conditions they need satisfied before they proceed to close on the property. Some of these conditions or contingencies may involve the buyers obtaining financing, inspecting the property to ensure they understand the property’s physical condition, and the ability (in some states) for the buyers’ attorney to review and approve the contract. These three conditions are the most common, but there are others. In some areas of the country, common contingencies include a wood-boring insect inspection, septic system inspection, well water inspection, and radon inspection, among others. If a home is of a certain age, there may be a lead paint or water inspection. Or, a home buyer may want to inspect for mold or structural defects. Less frequently, a buyer may put a bid in for a home with the anticipation of tearing it down or renovating and expanding the home. When this happens, the buyer may add a contingency to the contract giving the buyer the right to apply for permits, zoning changes or to satisfy other municipal requirements before completing the purchase of the home. Sometimes sellers want to remain in their home for an extended period of time before closing and moving. The seller may be building a home and needs to delay closing until the new home is finished. The seller may want to move to an assisted living facility and has to wait for space to open up. Or, the seller is waiting for the buyer to obtain financing, and the buyer has been unable to obtain it. There could be other matters on the buyer’s side that have delayed the buyer’s purchase of the home including the buyer’s ability to sell their existing home. In any case, you can always reach out to the listing agent and put in a backup offer. We doubt the listing agent will give you any information as to the details of the transaction. Still, if you submit an offer, one of several things might happen: the seller can ignore it, thank you for it, negotiate with you on the offer, or accept the offer subject to terminating the existing contract. In some cases, they may terminate the existing contract and simply accept your offer. You never know until you try. We don’t think the situation you’ve described is that odd. We know a number of people who have lucked into a property simply by submitting a back-up offer and then checking back regularly with the listing agent. If you don’t put in an offer, you’ll never know if the seller is just sitting there, waiting for a better offer to come along. If you’re working with a real estate agent, that agent could submit the offer. Another option is to continue to monitor the property to see if the original deal falls through. If it does, you can put in your offer then. But there may be more competition for the property, as other buyers are likely watching it as well. One possible risk: Submitting your offer may prompt the current buyer to close quickly on the property because that buyer doesn’t want to lose it. In that case, though, you’re not really losing out, since the property was already under contract. Let us know how things turn out. Every action scene in John Wick: Chapter 4 could be the climax of any other movie. There is no small fight in this movie. One battle incorporates martial arts and gunplay with vehicular traffic. There surely are special effects to blend all the elements together and make it feasible to execute such a sequence, but it looks and feels like cars and people are interacting, a quality missing from many recent movies. With all the embellishments the John Wick universe has added to its reality,Chapter 4still creates stakes for John. He has a time limit, and even if he can take on all comers, it still takes time to defend himself, so he still may not make it to his destination. The characters in authority positions speak such cryptic dialogue that it makes John's simple affirmative responses refreshing. John isn't going to try to doubletalk you. He'll tell you straight if he's going to kill you. The John Wick movies are the best in the genre because it looks like the filmmakers care about every detail put into every frame. The revolutionary could become standard after four films, but John Wick: Chapter 4 takes cinema to the next level once again.
