>Product Warranty

Ten Degree Lighting LLC warrants each LED product sold to be free
from defects in materials and workmanship, and to operate within 36
months from the date of delivery to the purchaser, subject to these
Terms and Conditions.

TERMS AND CONDITIONS

This warranty only applies when the LED products are properly installed
and used in accordance with the published specifications. The LED
products must be used in lighting fixtures which are designed and ap-
proved for the purpose and within the specified normal operating range
(including temperature, humidity, rated voltage).

This warranty does not apply to any abnormal use of the LED products
or use in violation of any applicable standards, codes or instructions for
use in installations.

Subject to LED product availability, an outright replacement will be pro-
vided if an LED product fails to operate within the specified warranty
period. Ten Degree may, at its option, replace or repair the product at no
cost or grant the purchaser a credit for future LED product purchase.
The unit credit is calculated as follows:

Purchase Price x Unexpired warranty period (months)
Warranty period (months)

Ten Degree will not be responsible for labor costs of removal or installa-
tion of the LED products.

>Return of Defective Product

The LED products considered by the purchaser as defective can be
shipped to the nearest Ten Degree office at the cost of the purchaser.
Ten Degree reserves the right to (i) examine all failed LED products to
determine the cause of failure and patterns of usage and (ii) be the sole
judge as to whether an LED product is defective and covered under this
warranty. Replacements for the LED products proven to be defective by
Ten Degree will be shipped to purchaser at no cost.

>Limitation of Liability

THE FOREGOING SHALL CONSTITUTE THE EXCLUSIVE REMEDY OF
THE PURCHASER AND THE SOLE LIABILITY OF TEN DEGREE FOR LED
PRODUCTS. NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE IS MADE OR IMPLIED. IN NO EVENT SHALL
TENDEGREE BE LIABLE FOR ANY OTHER COSTS OR DAMAGES IN-
CLUDING LOSS OF PROFITS OR REVENUES, INCIDENTAL SPECIAL OR
CONSEQUENTIAL DAMAGES.
