Never in human history the whole world goes into total locked down all at the same time. Year 2020 was
a big test to all human being. We have to adjust to the challenges thrown at us such as wearing mask
whenever you are with a group of people and learning the new way of life.

FLPC Board directors realised that we have to do something to keep our members active not only in
selling but at least continuous learning to enhance our knowledge virtually. This also act (contributed) as
a way to make everyone to keep in touch virtually.

We started with short 1-2 hours virtual tea talks. The response was very encouraging then slowly classes
were organised to conduct our signature FCLP courses.

During this challenging time, students had to learn new ways of using
computers, tablets or handphone to attend virtual classes. Likewise, it
is even more challenging for the moderators as materials had to be
converted fully into soft copies. The uphill task was operating the
computer, switching between so many different gadgets, opening
folders and accepting that you are talking to yourself all alone in your
own room for few hours and not sure whether the students
understood or were receiving the knowledge properly. Finally,
everything went well and today we are having our graduation
ceremony.

I wish to thank NAMLIFA National Council and FLPC board for giving
this opportunity to organize the graduation.

My heartfelt appreciation and thanks to all the staff in NAMLIFA and
others whom has put in tremendous effort to make sure the
event is a success.

Lastly, I would like to wish everyone good health.
May your 2022 be one of the best ever.

Thank you very much for inviting me to serve as the Guest of Honour at the National Association of
Malaysian Life Insurance and Family Takaful Advisor (NAMLIFA)'s 7th Financial and Life Practitioners
Council (FLPC) Graduation Ceremony. Since its establishment in 1996, Bank Negara Malaysia has
observed the FLPC growing from strength to strength, gradually enhancing the breadth and depth of its
academic programmes towards fostering the highest level of professionalism, ethical conduct and
technical excellence among its graduates and industry practitioners.

We are now living in world of increasing insecurity and heightened challenges. No matter how well we
plan and how many precautions we take, we can never rule out when an unforeseen event or medical
emergency may befall us. In such an environment, having the right insurance plan is key to ensuring such
calamities do not result in further financial distress to ourselves or
our loved ones. Even as we see the emergence of new channels
for promotion of basic insurance products to a new generation
of consumers, there will always be constant demand for
responsive and highly skilled agents who offer
personalised services and prompt assistance to help
their clients weather through the worst of storms.

It has been said: "The grace of God is like insurance.
It will help you in your time of need without any
limit". In which case, an insurance agent is like
an Angel! You are responsible for persuading
your clients to purchase the right policies at
the right times to ensure they can pursue their
dreams and live their best lives with peace of
mind. You appear like a miracle to guide your
clients or their beneficiaries through the
darkest moments and help them
find the light again. Agents who
take pride in their profession, who
continually enhance their skills and
ensure they always have the
consumer's best interest at heart,
are assets not just to the industry
but to the consumers they serve as
well.

It is my honour and privilege to

sharpening the axe.”An axe is a strength multiplier. You can be the strongest lumberjack in the world, but
with a dull axe, you are in trouble. A lumberjack needs to always keep his axe sharpen for the next
chopping. Likewise, as Financial Advisors, it is needful for us to make sure our knowledge and skills are
kept up to date and sharpen always!And you have done just that by successfully completing and
graduating from your respective courses! My heartiest congratulations to you!It has not been easy for you
to be here today. The last two years have been especially tough because of the COVID-19 situation. You
preserve and you finally make it here! I am proud of your tenacity and the resilience that you have
displayed. And indeed, we are not defined by circumstances, but how we choose to respond to
circumstances. Our role as a Financial Advisor is a process of continuous learning. It is not about
how much we know, but how fast we learn, unlearn and relearn that matter
.Learning and our job as Financial Advisors are like the double helix
of our DNA. They are closely intertwined, and we should always
remember to put into practice in our job what we have
learned, and at the same time, continue to pick up skills. That
really is the essence of lifelong learning.Many of you already
exemplify this spirit of lifelong learning. You chose to enrol in
your respective courses not just in pursuit of the title and/or
designation that it might afford you. Instead, I believe it
reflects your lifelong pursuit to upgrade your skills and
knowledge so that you can better contribute to yourself, your
clients, your company and the financial services industry.You
will have the opportunity to come back to NAMLIFA and
APFinSA throughout your career. Please do come back and
continue to pick up new skills and share with your colleagues
what you have gathered and learned in the journey of your career
as a Financial Advisor. As you journey forward in your career and
benefit from the experience of NAMLIFA and APFinSA, I hope one
day, you will look back and define your success not just by how well
you have done for yourself. Remember that your success is
defined not just by taking care of yourself or your family,
but also by your contribution to your clients,
Industry, society and country.I wish you all
the very best and continue success. Be the
alumni who will always remember to pay it
forward for future batches of graduates to

I wish to thank and congratulate the Organising Chairman, Mr Victor Kho, FLPC Board Chairman, Mr SK
Samy and the FLPC Board members for successfully organising the Graduation ceremony.

Consumer awareness along with complex needs on financial risk management demands best advice
from Life Practitioners. The FLPC program was carved to equip Life Practitioners with the necessary
knowledge, skills and exposures to provide best advice and suitable products that fulfils consumers’
needs.

Ladies and gentlemen, the ever-evolving Life Insurance & Takaful industry demands for greater creativity
in reaching out to the uninsured or under-insured population, the demand for
highly knowledgeable and professional Practitioners has never been
greater. We at Namlifa propagate “life-long learning” and would
continue providing our members with relevant education programs
through the FLPC Board.

Namlifa is also ready to play a significant role in assisting Bank
Negara and ITOs to help professionalise the Agency Force through
the LP101 (Personal Insurance) module that inculcates professional
approaches in Sales Cycle. We are proud to announce that our
graduates sustain longer in their business, thanks to NAMLIFA’s
education programs.

At this juncture, I wish to commend all our students who volunteered to
invest in themselves, seeking to upgrade their business excellence and
to continue their relevance in the Life Insurance and Takaful industry.

The COVID19 pandemic affected the whole world. Despite signs of recovery, this crisis continues to
challenge the notion of financial stability.

We, in the business of life insurance and financial planning are first-in-line recipients of insecurities and
apprehensions of clients over their future. More than ever before, the trust we worked so hard to earn,
must prove its worth through the sound advice and valuable information we dispense, that could make a
lot of difference in the lives of our clients.

It is therefore our responsibility to be trustworthy and well-informed, so that what we may share and pass
on, valued advice to our customers. This is our professional mandate.

In NAMLIFA, continuing education by completing FChFP is the badge of professionalism. Indeed, all the
awards that we may reap from companies do not make or guarantee you to be a
successful financial advisor and life insurance intermediary. But the trust and
confidence of your clients speak a world of difference in your personal
success.To all graduates and many others who are in the midst of
completing FChFP, keep marching on through a spirit of professionalism

Establishing a Trust Fund using Insurance or Takaful Funds

01 Objective: To create a fund upon the death of a policy owner (PO) or
participant (P), whereby the moneys are professionally managed by trust
company. It is to be gifted to the beneficiaries over a period of time, according
to the wishes and intention of the PO or P.

02 The PO or P must create the fund by purchasing a suitable life insurance policy
or family takaful contract. The initial sum assured will represent the basic fund
value.

03 Discussions must be held with a chosen trust company (trustee) as to the
intentions of the PO or P (settlor) and all the relevant terms and conditions of
the trust which will be stated in the trust deed which will be prepared by the
trust company.

04 A trust deed is therefore an agreement between the settlor and the trustee.

05 A trust deed is therefore an agreement between the settlor and the trustee.

06 There are initial fees and expenses to be paid to the trustee and when the
claim arises, management fees and expenses will be charged. This will depend
on the trust company.

07 The trust funds thus established, will not be considered as part of the estate of
the policy owner.

08 The trust created will usually be an irrevocable trust ie. it cannot be revoked
without the consent of the trustees.

09 The fund established may only be deemed “creditor proof” only if it satisfies
the relevant bankruptcy rules – as an example and in simplest terms, the trust
should be created at least 5 years prior to any bankruptcy proceedings com-
menced against of the settlor.

10 The documents required for this arrangement include an absolute assignment,
a trust deed, a power of attorney and others as required by the trust company.

Social guarantors and
bankruptcy…

01 When a person takes a loan from a bank, it will
usually require one or more persons to be
guarantors.

02 If the borrower defaults on the loan, the bank
may eventually proceed to take legal action to
recover the debt. If it succeeds, it will obtain a
judgement order from the courts.

03 Upon obtaining the judgement order, the bank
will proceed to enforce it against the borrower
or the guarantor or the both of them. Very
often, when it is determined that the borrower is
unable to repay the loan, the bank will seek to
enforce the judgement against the guarantor.

04 There are several ways to enforce the
judgement and if the debt exceeds the
minimum amount of RM 100 000 effective 23rd
October 2020, (previously RM 50 000 and prior
to that RM 30 000), the bank may initiate a
creditor’s petition for bankruptcy against the
guarantor.

05 In the past, many individuals were declared
bankrupt because of such circumstances.
However, after 6th October 2017 when the
Bankruptcy Act amendments came into effect,
creditors are prohibited from commencing
bankruptcy proceedings against “social
guarantors”.

06 Social guarantors are persons who are said not
to have profited from the loans taken by
borrowers, for which they stood as guarantors
including education loans, hire purchase loans
for personal or non-business uses, and housing
loans for personal dwelling.
