privacy issues for teachers

Teachers/staff have been held accountable for
information & photos posted online regarding their
personal lives.

Friends may post messages & photos on their pages
without your consent!

Meta or exit data in photos

Meta Tags can be a very useful tool. Digital photos have bits of
information or tags imbedded into each photo. This information can be
the photo date and time, title, photographer, keywords, subject,
copyright and even GPS data.

Facebook strips meta data from photos

Photo DNA

Facebook is a huge support of law enforcement in the effort to stop
child pornography & help locate missing and exploited children.

They are using a technology called Photo DNA that computes hash
values of images in order to identify alike images. This technology is
resistant to alterations in the image, including resizing and minor
modifications.

Once your image is Tagged on Facebook, you are in the system. What
does this mean? What happens in Vegas no longer stays in Vegas!

Appropriate Behaviors

Employees must use appropriate discretion and good judgment when using
SNS for their own personal and professional communications, realizing that
adult behavior on SNS may be viewed by; students, parents, community
members, law enforcement .

Employees may not initiate or accept SNS friend requests with current students
or with former students under the age of 18. Professional discretion must be
used when “friending” alumni 18 and over. Employees who already have
students or alumni under the age of 18 involved, “liked” or “friended” on their
SNS are not “grandfathered” and must “de-friend” the minor student and
minor alumni.

Appropriate Behaviors

Other Friends; employees are discouraged from inviting or accepting
invitations from parents of current or prospective students to join their SNS
due to the inherent conflicts of interest that may arise.

Employees should also remind all other members of their SNS of their
positions in a school/educational setting. If any comments/photos are
posted/shared to your site by a friend and is inappropriate, you should remove
it ASAP, and consider your online friendship with that person.

Appropriate Behaviors

Groups in SNS; employees should support associations that are consistent with
that of the district: health, pro-social activities that support the mission and
reputation of the Long Branch Public Schools.

Employees should act with sensitivity and use good judgment, understanding
that in the context of a diverse educational environment, students and adults
practice tolerance and accept competing views. Do not use school e-mail
address when posting to SNS, this will avoid implying approval of the message’s
content by the LB BOE or district administration.

Appropriate Behaviors

Privacy Settings & Content: employees should exercise care with privacy settings and
profile content on personal SNS.

Use of district logos: employees are not permitted to use any school logo, trademark, or
any other intellectual property or proprietary materials in any personal SNS postings
without the consent of the administration. Photographs, videos and other digital content
identifying schools, students within the LBPS district or their families should not be
posted on any personal SNS without prior approval by the administration.

Self-Assessment 1

Each time you power up any digital tool (camera, computer, internet, cell phone) picture
a family member(s), friend, child, enemy, criminal, a deceased loved one, whomever
means, or meant the most to you in this world standing right over your shoulder.

If you are truly OK with the person who means the most to you in this world seeing and knowing what you are about to do, and
you are OK with what you are about to do becoming a part of your digital legacy – then go for it.

If you are NOT OK with the person that means the most to you in this world seeing and knowing what you are about to do, and
you are NOT OK with what you are about to do becoming a part of your digital legacy – then DO NOT DO IT!

If you are NOT OK with the person that means the most to you in this world seeing and knowing what you are about to do, and
you are NOT OK with what you are about to do becoming a part of your digital legacy – BUT – you do it anyway; then you are
abusing your digital tools and technologies and responsibilities!

Self-Assessment 2

When you leave your home with any digital tool whether it be a digital camera, cell
phone, MP3 player, anything with memory or that shoots video, be willing to hand that
digital device to anybody, any time and let them look at the memory card, photos, videos
in front of you.

If you are willing to do this, than you are using digital technology and digital tools with
responsibility.

Protect Password

Passwords are the keys to your personal online life. You should do everything
you can to prevent people from gaining access to your password.

When creating a password, make sure it is long and strong, with a minimum of
8 characters and mix of UPPER & lowercase letters, numbers & symbols.

You should also remember to:

Never share your password with others
Make password unique to your life & not something that is easily guessed
Have a different password for each online account
Write down your passwords and store it in a safe place away from your computer
Change your password several times a year

A form of sexual exploitation where people are extorted with a sexually explicit image or
video of themselves typically acquired by criminal through digital technology.

Impersonation – pretending to be another person or entity in order to deceive.

Phishing – in the field of computers security, it is the criminally fraudulent process of
attempting to acquire sensitive information such as usernames, passwords & credit card
details by masquerading as a trustworthy entity.

Outing & Trickery – the practice of publicly revealing personal information, usually
pertaining to an individual’s sexual orientation, without that person’s consent.

Case Law Discussion

Florida MS PE teacher, superintendent saw an inappropriate photo & text on the
teacher’s page and TERMINATED him.

School determined online content was not pornographic, but containing information
parents would not want their children to know about their teacher.

Teacher claimed someone obtained his password and posted the offensive material on his
SNS without his knowledge.

Teacher said he removed the material AS SOON AS HE SAW IT

District stated teachers are allowed to have personal sites, but not allowed to post
inappropriate material. Administration also stated they have discretion in determining
what is considered inappropriate.

The teacher was FIRED.

Charlotte, NC. Teacher SUSPENDED for comment on her Facebook page.
TV News station did a search on Facebook for those claiming to be staff
members of the district
She claims her postings were intended to be READ ONLY BY FRIENDS
District determined firing was too strong a punishment
Teacher was Suspended.

Massachusetts teacher’s assistant was first suspended—then fired for his posting which
included “sexually suggestive” photographs, videos of drinking alcohol and inappropriate
references to women.

MTA took the case to arbitration

March 2009, arbitrator rules teacher be reinstated with back pay, seniority and benefits

Arbitrator concluded teacher did engage in misconduct that warranted discipline be it
was 1st offense, he didn’t know minors could access his site and he immediately removed
the site as soon as school informed him it was inappropriate.

Determined discipline to be a 3 day suspension.

Florida band director fired after school officials viewed his SNS postings about sex, drugs
and depression.

Colorado English teacher fired after composing & posting sexually explicit poetry on her
SNS.

Nashville teacher fired after posting racy photos of herself along with candid photos of
her students on her SNS.

Ohio, reporters contacted a school after finding a teacher posted that she’s “An
Aggressive Freak In Bed,” “Sexy” and “An Outstanding Kisser” Fired.

Another Ohio teacher wrote on her page she had recently “Gotten Married, Gotten
Drunk, Smoked Cigarettes, Taken Drugs, and Gone Skinny-Dipping” Fired.

Ohio Education Association warned members that such profiles and posting “Can be used
as evidence in disciplinary hearings which could not only affect a teacher’s current job,
but his/her teaching license as well.”

Delaware: Teacher posted sexual & violent information on his SNS where he
communicated with students.

A month after he was reprimanded by a school administrator for his online
activity, he was arrested and convicted for having sex with a student.

He is currently in prison.

While in college, a future teacher posted a picture on SNS of herself two years earlier
drinking with a pirate hat on her head. The caption read “Drunken Pirate.”

She also posted comments criticizing her supervising teacher.

The photo did not show her drinking alcohol but the caption led one to believe that there
was alcohol involved. The district terminated her assignment.

Because she did not complete her teaching assignment, she was denied her teaching
degree. The university gave her a degree in English instead.

She sued the university claiming her freedom of speech & privacy were violated.

Federal Court upheld the university refusal of teaching degree and ruled her First
Amendment Rights were not violated.

Connecticut school district fired the probationary teacher because of her postings on her
SNS.

Her page included “Inappropriate” student conversations considered “Disruptive to
school activities.”

Court said online exchanges “Show potentially unprofessional rapport with students and
the court came to see how a school administrator would disapprove of and find disruptive
a teachers discussion with a student.”

Court also stated it was reasonable for officials to expect a teacher with supervisory
authority over students to maintain a professional, respectful association with students.

The teacher communicated with students as if she was a peer and not their
teacher…disrupting the learning atmosphere.

Denver, March 23, 2014 a man who coached after-school basketball at Bromwell
Elementary School was fired after photos of drug paraphernalia was posted on his public
Facebook page.

A concerned citizen who viewed the photos, which were set to “public” on his page and
posted in June and September of 2013, contacted 7News TV. The photos had a caption;
“Early morning sesh, f@*# I’m turnt up!! For you dumb haters that’s over a $1,000 worth
of glass for your b@*# a@*, and don’t get me started.”

Another photo showed what appeared to be drugs on brown paper surrounded by bongs,
with the caption, “Shatter Sunday.”

Residents and community became outraged that the district had not done a better job of
checking or doing something to “vet” employees on social media.

Facebook gaffe cost former school official $80,000

Florida, March 2014. Patrick Snay, former head of Gulliver Preparatory School, filled an
age discrimination lawsuit when his 2010-2011 contract wasn’t renewed.

The school settled: paid $10,000 in back pay, an additional $80,000 as a “1099” and
covered all Snay’s legal fees. They made him and his wife sign a confidentiality
agreement, promising not to discuss the case with anyone other than legal counsel.

Their daughter then posted on Facebook they were taking a vacation to the Caribbean
thanks to Gulliver Preparatory School for screwing over her dad.

Snay had to pay back all the money!

Portland, Ore. April 15, 2014. A mother sued her son’s school district for suspending the boy for calling
a teacher a “bitch” who “needs to be shot” on his Facebook page.

Braeden Burge, 16, through his mother Kelly Burge, sued Colton School District 53, alleging First and
Fourteenth Amendment violations.

Family admits the boy made the posting from the privacy of his home, outside of school hours. And
that the district overreached its authority.

Veronica Bouck, health teacher, gave Burge a C on a test and his mom grounded him as a result. While
he was home and angry over his punishment, he posted on Facebook that he wanted to start a petition
to get Mrs. Bouck fired, “she’s the worst teacher ever,” he wrote.

When a friend wrote back and asked what she had done, Burge replied “she’s just a bitch hahah” and
added “Ya hahah she needs to be shot.”
