Instructions for an Application

The Residential Tenancies Act, 2006 (s.70)

You should try to settle your dispute before applying to us. If you need to have
the Office of Residential Tenancies (the ORT) resolve a residential landlord/
tenant dispute, complete this form and deliver, mail, fax or email it to the ORT,
together with the applicable fee.
The ORT will send you a Hearing Notice. The Hearing Notice will have a date,
time and place for a hearing, usually 30 to 45 days after you applied. All
possession applications are treated as urgent and hearings will be scheduled
sooner. When applying for possession, you must provide a copy of the Notice to
Vacate and proof of service on the tenant. On the Hearing Notice, you will
provide details of your claim so that the other party and the Hearing Officer will
know exactly what you are claiming. After you have explained your claim on the
Hearing Notice, you will have to deliver a copy of the Hearing Notice to the other
party and provide proof that you have done so. Instructions are on the Hearing
Notice.
Orders may be registered with the Court of Queen’s Bench and enforced by the
Sheriff. There are fees for registration and enforcement.
