SAND RACING (GENERAL PROVISIONS)
(JERSEY) ORDER 19591
THE HOME AFFAIRS COMMITTEE, in pursuance of Article 2 of the
Motor Vehicle Races (Jersey) Law 19462, orders as follows –

In this Order –
“Course” means such sea beach, or part thereof, as may be authorized by
the relevant special Order to be used for the races;
“promoters” means the persons defined as such in the relevant special
Order;
“special Order” means any Order made by the Minister under the Motor
Vehicle Races (Jersey) Law 1946 declaring that any sea beach, or part
thereof, may be used for races with motor vehicles or for the purpose of
practising therefor.

The following provisions shall form part of every special Order hereafter made
save so far as it may otherwise expressly provide.

(1) The promoters shall take all reasonable steps to ensure that, when the
Course is closed, access to the Course shall be prevented and, for this
purpose, may declare any part of the beach adjacent to the Course to be a
prohibited area.
(2) The promoters shall, in particular, ensure that access to the Course from
any adjacent slipways shall be prevented by means of proper and
sufficient barricades and that, in so far as any parts of the beach adjacent

to the Course are not declared under paragraph (1) to be prohibited areas,
access to the Course shall be prevented by means of rope barriers.

The promoters, subject to the approval of the Minister for Economic
Development, may enclose areas of the beach adjacent to the Course, and may
make charges for the admission of spectators thereto.

No spectators or other unauthorized persons shall, on the dates and during the
times specified in any special Order, use any part of the Course, or any area
adjacent to the Course declared, under Article 3(1), to be a prohibited area.

The promoters shall give notice of their intention to close the Course –
(a) by posting, and keeping posted throughout the 14 days preceding the date
on which the races are due to be held, in prominent positions in the
neighbourhood of the Course, placard notices specifying approximately
the whereabouts of the Course, the date on which the races are due to be
held, and the hours during which the Course will be closed;
(b) by publishing, on one occasion between the 10th and 4th days preceding
the date on which the races are due to be held, an advertisement giving
similar information in a newspaper circulating in Jersey, such
advertisement being certified by the Greffier of the States as an
advertisement published in pursuance of this requirement.

(1) The promoters shall appoint a sufficient number of responsible persons to
act as marshals and all such persons shall be authorized to assist in
conducting the races.
(2) The promoters shall provide each marshal with an armlet of a design
approved by the Minister.

Not later than 14 days before the date on which the races are due to be held, the
promoters shall produce to the Minister satisfactory evidence that they are
adequately covered by insurance, with an insurance company approved by the
Minister, against any liability which may be incurred by them, their officials,
agents or servants, or by any competitor in the races, in respect of damage to
property, or in respect of the death of, or bodily injury to, any person, caused by
or arising out of the races, and such policy shall include a recognition of the
jurisdiction of the Royal Court to decide upon any question of any liability
arising under the policy.3

Construction Provisions No. 7) (Jersey) Regulations 2005. The
2 amendments replace all references to a Committee of the States of Jersey
with a reference to a Minister of the States of Jersey, and remove and add

committee system of government to a ministerial system of government
