County Counselor:
John Watt, county counselor, discussed with commissioners the current State Statutes regarding
excess trash/junk on properties within Pottawatomie County. Commission directed Watt to research
current laws, and look into drawing up a resolution that could address these types of issues.

Other Discussion:

Commissioner Hartwich informed John Watt the City of Havensville had contacted him, concerning
the purchase of one of the County’s used motor grader. Watt said, all graders need to be disposed of

through a public offering.

Public Works:
Jim Jenkins presented the current week’s department work schedule, and requested authorization to
allow the Boy Scott Troop 97 to donate a tree, and plant it as a service project. McKee moved to
authorize the planting under direction of the County. Hartwich seconded, carried 3-0.

Jenkins gave an update on the evaluation of additional GPS systems in county vehicles. The benefits
from the information will range from who has been where, to tracking the speed of the drivers. Jim
informed the commission he is looking at four companies for this service. Additional service could be
added to track real time activities during a major event. Commissioners agreed to have Jenkins
report back next week with cost estimates.

Board of Health:
Hartwich moved to adjourn as Board of County Commissioners and convene as Board of Health.
Leslie Campbell, health director, gave an overview of all grants, and requested approval of the July 1,
2015 – June 30, 2016 grant application, requesting $160,654.35. McKee moved to authorize the
Chair to sign and submit the application. Hartwich seconded, carried 3-0. (Document signed)
Commissioners reviewed and approved sliding fee scale as presented by Campbell for the
Pottawatomie County Health Department based on 2015 Federal Guidelines. Hartwich moved to
authorize the Chairman to sign the guidelines as presented. McKee seconded, carried 3-0. (Document

signed)

Leslie Campbell, health director, continued with department update, and upcoming events. Hartwich
moved to adjourn as Board of Health and convene as Board of County Commissioners. McKee
seconded, carried 3-0.

New Business:
Commissioner Weixelman presented a request from St. Marys Area on Aging requesting $1,500, for
help with the funding of two garage doors, and openers. The doors need replaced for security
reasons, they currently house vans used to deliver meals. Commissioners reviewed the pictures and
request. Hartwich moved to approve the request, with funding transferred from unclassified. McKee
seconded, saying as long as this does not set a precedents. Reece said each senior center requests
funding for varies projects annually, the county contributes based on population. After continued
general discussion, motion carried 3-0.

Hearing:
At 10:15 a.m., Weixelman moved to adjourn as the Board of County Commissioners and convened
as the Blue Township Sewer Board. Hartwich seconded, carried 3-0.
Chair declared the hearing open for the annexation of certain real estate into the Blue Township
Sewer District, asking for any comments. Lowrey said all property owners have signed the petition,
and he would recommend the annexation. Chair requested discussion from the floor once, twice and
three times; with none, the hearing closed at 10:20 a.m. Hartwich moved and McKee seconded to
adjourn as the Blue Township Sewer Board and convene as the Board of County Commissioners.
Motion carried 3-0.

Hartwich moved to adopt Resolution 2015-10, annexing certain real estate into Blue Township Sewer
Benefit District. McKee seconded, carried 3-0. (Document signed)

Bids: 10:30 a.m. Weixelman declared the bidding closed for the Nelson’s Ridge Addition, Unit Three,
street, water and sewer improvements. Public Works Director Leu Lowrey, and Greg Fief from
Schwab Eaton, opened and read the bids:

o Nowak: $559,210.43
o J & K Contractor: $468,247.95
o Bayor Construction: $506,167.60
o Larson Construction: $460,258.95
o Carlson Utility: $542,830.99
o Engineer’s Estimate: $605,307.00

Lowrey will review the bid documents and return with a recommendation next Monday.

Bids: 11:00 a.m. Weixelman declared the bidding closed for the Elbo Creek Estates, Unit Four,

street, water and sewer improvements. Public Works Director Leu Lowrey, and Greg Fief from

Schwab Eaton, opened and read the bids:

o Carlson Utility: $549,052.05
o Nowak: $549,535.96
o Larson Construction: $439,312.20
o Bayor Construction: $517,570.45
o J & K Contractor: $454,552.40
o Engineer’s Estimate: $660,450.00

Lowrey will review the bid documents and return with a recommendation next Monday.

Commissioners thanked all the bidders.

New Business:
Hartwich moved to set a notice of public hearing on March 9, 2015 at 10:00 a.m., for annexation into
the Blue Township Sewer District, for Lots 51-88 of Whispering Meadows Subdivision, Unit 3.
Weixelman seconded, carried 3-0.

General Discussion:

Reece asked the commissioners to consider a request from Dave Nelson, reducing the letter of credit
from the engineer’s opinion to the approved bid amount plus 10%. Commissioners agreed to

consider, no action taken. John Watt will redraft the resolution establishing the 100% irrevocable
letter of credit for the commission’s consideration.

Commissioner McKee motioned to have authorization to work with Reece to draft a letter concerning
the State withholding fuel taxes from Counties. Hartwich seconded, carried 3-0.

Department Update:

Lois Schlegel, county appraiser, informed commission the Brown County Appraiser had passed

away. Commissioners authorized Lois to help Brown County if she could. Lois requested approval to

hire an outside Counselor if needed; Wamego Country Club will be seeking a Board of Tax Appeal,

(BOTA) hearing to exempt their golf carts as commercial machinery and equipment. John Watt may

not be able to be the acting attorney due to conflict of interest. Commissioners said to keep them

informed of the situation.

Final

Schlegel continued with a 2014 end of year report/sales, and gave an overview of current office and
field activity. Schlegel said the annual renewals of all EDX and IRB properties applications are due by
March 1, 2015 to continue with their exemptions, and asked the commission if they would like to set
up an appointment for a tour of Liberty Inc. to review that status of exemption. Commissioner McKee
agreed to visit the facility.

Proclamation:
Hartwich moved and Weixelman seconded to sign a proclamation declaring the month of April as Fair
Housing Month in Pottawatomie County. Motion carried 3 to 0.

Executive Session:
Hartwich moved to recess to executive session to begin at 12:15 p.m. for up to 10 minutes under:
personnel matters of individual non-elected personnel. Weixelman seconded, carried 3-0. Others in
attendance were Nancy McCarter, and Robert Reece. Regular session resumed at 12:25 p.m. with
no action taken.

Updated Information:
Lois Schlegel informed commission the total tax abatement for the Wamego Country Club would be
$718.05 for tax year 2014. Commissioners all agreed to authorize Schlegel to negotiate the
abatement.

Commission recessed for lunch at 12:37 p.m. meeting will restart at 1:25 p.m.

Zoning:
Gregg Webster, zoning administrator, requested direction on how to proceed with the Manhattan
Urban Area Comprehensive Plan printed materials; would the commissioner like all 218 pages or
certain pages for the upcoming meeting. McKee would like the link emailed, Weixelman wanted
specific pages that pertained to Pottawatomie County.

Webster, requested direction on how to proceed with new subdivisions; go ahead and issue building
permits, or wait until the water issues if resolved. Weixelman said, running the lines are nothing
major, but would like to talk with Rural Water. Reece would like an updated calendar for construction
and would like to talk with Rural Water at the next meeting.

Agreement:
Weixelman moved to renew the agreement with First Class Cleaning Service. Hartwich seconded,
carried 3-0. (Document signed)

Resolutions:
Reece presented three resolutions for adoption; clerical errors were found with the legal description in
the original ones. Hartwich move to accept the waivers and adopt Resolutions 2014-29-A, 2014-30-
A, and 2014-31-A. McKee seconder carried 3-0. (Documents signed)
