Interlocutory Application in respect of Transfer Petition

Nos.750-752 of 2013; 753-754 & 755-758 of 2013

1) Our Federation has advised that an Interlocutory Application has
been filed on 25th July 2014 in Delhi High Court (Annexure-I) requesting
de-linking our W.P.No.1875/2013 from the W.P.No.970/2010 transferred
from Jharkhand High Court to Delhi High Court and for advancing the date
of hearing from 25th September 2014 to an earlier date.

2) Federation has also filed an Interlocutory Application on 24th July
2014 in the Supreme Court (Annexure-II) requesting for separate hearing
of our W.P.No.1875/2013 by Delhi High Court without clubbing any other
W.Ps covered by the Transfer Petitions pending before the Supreme
Court.

We are appending hereunder the Prayers (Annexure-I and
Annexure-II) made by us in our above mentioned Interlocutory Applications
for information of members as Annexure-I and Annexure-II.

We note to advise further developments in the matter in due course.

Annexure – I

Prayer made in respect of Jharkhand High Court Case

It is most humbly prayed that this Hon’ble Court may graciously
be pleased to;

(i) allow this application and advance the date of posting of
their W.P. for final hearing to an earlier date instead of on
25-09-2014;

(ii) direct the Registry not to post Writ Petition No.2353/2014
transferred from Jharkhand High Court along with the
present Writ Petition No.1875/2013 transferred from the
Hon’ble Supreme Court;

(iii) hear the Writ Petition No.1875/2013 for Final Hearing
separately; and

(iv) Any other relief which this Hon’ble Court deems fit and
proper in the facts and circumstances of the case.

Annexure – II

Prayer made in respect of Transfer Petitions

It is humbly submitted that this Hon’ble Court may graciously be
pleased to :

(i) allow this application;
(ii) issue directions for hearing the W.P. 1875/2013 of Hon’ble

Delhi Court (W.P.No.184/2011 transferred from this Hon’ble
Court) without clubbing with or hearing together with any other
W.Ps transferred to Hon’ble Delhi Court, in case this Hon’ble
Court orders the transfer of the W.Ps covered by the above
T.Ps to Hon’ble Delhi High Court;
(iii) not to post any other writ petition along with W.P.No.1875/2013
of Delhi High Court for hearing and adjudication;
(iv) issue an appropriate order to Hon’ble Delhi High Court to hear,
adjudicate upon and to dispose of W.P.No.1875/2013 of Delhi
High Court separately and independently and;
(v) pass such other orders or further order as this Hon’ble Court
may deem fit and proper in the facts and circumstances of the
case.
