Dear Students,
Greetings from Kalyan Dombivli Branch!
After a very hectic schedule, once again most of you are back on
exam leaves. You have to manage your time effective and
efficiently for studies and also ensure you maintain a good health.
WICASA committee is organizing crash course on IDT for CA
Inter/ IPCC exams by expert faculty. I request all of you to enroll
for it and be benefitted. We look forward for your constructive
feedbacks and valuable suggestions. We are very thankful to all of
you for very good response for virtual ITT / Orientation and Advanced MCS batches. I

I am very happy to announce you that Kalyan Dombivli Branch of WIRC of ICAI jointly
with Global Indian Foundation distributed around 57000 boxes of Dabur Real Mix Fruit
Juice (15000 ltrs approx worth Rs 20 lacs). We are thankful to CA S B Asawa Ji ( Vice
Chairman Thane Branch), Naveen Jain ji (Chairman Global Indian Foundation), and Dr
Ravindra Ji from Pune for connecting us for this social initiative. I take this opportunity
to thanks my managing committee members, CA Manoj Shripati, CA Vinit Haria and all
the volunteers who actively participated in this initiative and as a token of love and
appreciation we distributed juices to Corona warriors; doctors, nurses, paramedical staff,
policemen and press media. We also provided juices in Vrudh Ashrams (for senior
citizens), slum areas, quarantine centres, industrial areas, etc.

WICASA Chairman Ke Dil ki Baat….
My dear friends, we are in the midst of the financial year.
September month is generally viewed as a Teacher’s Day month.
The theme of this month’s edition is Examination. Since the May
2020 exams have got merged with November 2020, there is a lot
confusion and doubt and worry in the minds of students – How is
it going to happen, whether it will happen in the current scenario
and many other. My message to the students who are already on
study leave to focus on their studies as these last two months are
critical before the exams.
Now that the offices have opened and the students are attending the offices, they have to
manage many things now and also take precautionary measures as well and so the
inclination of students attending the Webinars have gone down.
This month we had one unqiue session on Building the Linkedin profile, which was very
well appreciated by the participants.
Life teaches us things in many ways. This Covid has taught us to reset our life and
rebuild with new zeal.
Wishing you a happy reading and a healthy and safe days ahead.

Exam is just one month away and this is the crucial time when our actual study and

System Audit Framework Issued By SEBI
Audit Process
The following steps would be repeated annually to ensure that the process is
comprehensive & effective:
1. The Audit shall be conducted according to the Norms, Terms of References
(TOR), and Guidelines issued by SEBI.
2. Stock Exchange / Depository (Auditee) may
negotiate and the board of the Stock Exchange /
Depository shall appoint the Auditors based on the
prescribed Auditor Selection Norms and TOR. The
Auditors can perform a maximum of 3 successive
audits. The proposal from Auditor must be
submitted to SEBI for records.
3. The audit schedule shall be submitted to SEBI at-least 2 months in advance,
along with the scope of the current audit & previous audit.
4. The scope of the Audit may be extended by SEBI, considering the changes
which have taken place during last year or post previous audit report
5. Audit has to be conducted and the Audit report be submitted to the Auditee.
The report should have specific compliance / non-compliance issues,
observations for minor deviations as well as qualitative comments for scope for
improvement. The report should also take previous audit reports in consideration
and cover any open items therein.

6. The Auditee management provides their comment about the Non-Conformities
(NCs) and observations. For each NC, specific time-bound (within 3 months)
corrective action must be taken and reported to SEBI. The auditor should indicate
if a follow-on audit is required to review the status of NCs. The report along with
Management Comments shall be submitted to SEBI, within 1 month of
completion of the audit.
7. Follow-on audit, if any, has to be scheduled within 3 months of the Audit to
ensure that the corrective actions have been taken.
8. If follow-on audit is not required, the Auditee
management has to submit a report of actions taken
and evidence of corrections to the Auditors & SEBI
within 3 months. This report should include updated
Issue-Log to indicate the corrective actions taken,
verified by the auditors.
Auditor Selection Norms
1. Auditor must have minimum 3 years of experience in IT audit of Securities Industry
participants e.g. stock exchanges, clearing houses, depositories etc. The audit experience
should have covered all the Major Areas mentioned under SEBI’s Audit Terms of
Reference (TOR).
2. The Auditor must have experience in / direct access to experienced resources in the
areas covered under TOR. It is recommended that resources employed shall have
relevant industry recognized certifications e.g. CISA (Certified Information Systems
Auditor) from ISACA, CISM (Certified Information Securities Manager) from ISACA,
GSNA (GIAC Systems and Network Auditor), CISSP (Certified Information Systems

Security Professional) from International Information Systems Security Certification
Consortium, commonly known as(ISC)².
3. The Auditor should have IT audit/governance frameworks and processes conforming to
industry leading practices like CobiT.
4. The Auditor must not have any conflict of interest in conducting fair, objective
and independent audit of the Exchange / Depository. It should not have been
engaged over the last three years in any consulting engagement with any
departments / units of the entity being audited.
5. The Auditor may not have any cases pending against its previous auditees,
which fall under SEBI’s jurisdiction, which point to its incompetence and/or
unsuitability to perform the audit task.

' IQ vs EQ vs MQ '
Probably we all have heard the name of IQ and many times we think that our IQ is high
or low or it should have been more. But very few of us know the term EQ i.e. Emotional
quotient and MQ i.e. Moral quotient .These terms are so much underrated still they play
equal role in the development of a person along with IQ.
Let us understand all the terms with a single example of a little child. Many a times we
notice that a child always try to do the things he sees. Like , when a child see that a
person is operating his phone ,he also tries to use the phone in the same manner he saw.
That defines his IQ. His ability to learn and grasp the things quickly. Some learn things
quickly and some takes time, this describes their level of IQ. With respect to EQ, lets say a
child is crying and his mother plays a song for him on the radio or mobile or tv but still
he is crying. But when his mother sings for him, he gets okay. Although the song she
played electronically is more melodious than mother's voice but still the child likes his
mother’s song because he has emotional connect with his mother. This describes his
emotional quotient i.e. the level of emotion for certain things or person and ability to
recognise their own emotions. With respect to Moral quotient, morality lies in the centre
of moral intelligence. How does a child behave with others or his parents describes his
moral intelligence. The integrity, respect, tolerance, fairness, self-control, conscience,
empathy etc. are the part of moral intelligence.
All the terms have equal importance in our personal and professional life. The effort
should always be there to focus on all the three quotients. Along with the intelligence,
morality and emotions are also vital for our better personal and professional life. Our
better IQ make others believe that we are not dumb but knowledgable, our better EQ
make others believe that we have emotions too and we know very well to recognise our
emotions and to differ between feelings. Our better MQ make others believe that we
know very well how to behave with others and we are honest with our work. Having all
the three quotient together can help us a lot in our daily life and helps to create better
future.

Advance Ruling Mechanism Under GST.
What is Advance Ruling?
As per Section 95(a) of CGST ACT,
Advance ruling means a decision provided by the Authority or the Appellate Authority
to an applicant on matters or on questions specified in sub-section (2) of section 97 or
subsection (1) of section 100, in relation to the supply of goods or services or both being
undertaken or proposed to be undertaken by the applicant.
Following are question for which advance ruling can be sought:-
1. Classification of any goods or services or both;
2. Applicability of a notification issued under the provisions of this Act;
3. Determination of time and value of supply of goods or services or both;
4. Admissibility of input tax credit of tax paid or deemed to have been paid;
5. Determination of the liability to pay tax on any goods or services or both;
6. Whether applicant is required to be registered;
7. Whether any particular thing done by the applicant with respect to any goods or
services or both amounts to or results in a supply of goods or services or both,
within the meaning of that term.
Introduction:-
An advance ruling helps the applicant in planning his activities which are liable for
payment of GST, well in advance. The law makes a comprehensive provision for advance
rulings to ensure that disputes are minimal. The aim is to provide certainty to the tax
payer with respect to his obligations under the GST Act and an expeditious ruling, so that
the relationship between the tax payer and administration is smooth and transparent and
helps to avoid unnecessary litigation.
A legally constituted body called authority for advance ruling (AAR) can give binding
ruling to applicant who is registered taxable person or desirous to be registered.
Advance ruling given by AAR can be appealed before an Appellate authority for advance
ruling (AAAR).
Objectives of Advance Ruling
1. Provide certainty in tax liability in advance in relation to an activity proposed to be
undertaken by the applicant,
2. Attract Foreign Direct Investment (FDI)
3. Reduce litigation
4. Pronounce ruling expeditiously in a transparent and inexpensive manner.

The Authority for Advance Ruling (AAR) & the Appellate Authority for Advance Ruling
(AAAR) is constituted under the respective State/Union Territory Act and not the
Central Act. This would mean that the ruling given by the AAR & AAAR will be
applicable only within the jurisdiction of the concerned state or union territory. It is also
for this reason that questions on determination of place of supply cannot be raised with
the AAR or AAAR.
Procedure for obtaining advance ruling:-

Other points related to Advance ruling:-
1. AAR and AAAR can amend their order to rectify any mistake within 6 months
from date of order. If rectification has effect in increasing tax liability or decrease
in input tax credit, applicant must be heard before order is passed.
2. Advance ruling is limited to person who has applied for an advance ruling.
Ruling shall be applicable only on applicant, concerned or jurisdictional officer
in respect of applicant. Advance ruling shall be binding till the period when the
law, facts or circumstances supporting to advance ruling have not changed.
3. Advance ruling obtained by applicant by fraud or suppression of material facts,
by order it can be declared as void-ab-initio, only after hearing the applicant.
4. Advance ruling can be obtained on proposed transaction or transaction already
undertaken.
Example of advance ruling:-
1. Simmple Shukla Tutorials (ARA-06/2017/B-05 Dated 09/03/2018)
The applicant runs a private institute Simple Shukla’s Tutorials and is engaged in
providing the service of teaching to the students of Class XI and XII science. The
Coaching Centre prepares the students for entrance examinations related to MBBS,
Engineering and other related examinations.
The applicant claims that as per a Notification issued by the Central Government,
services provided by an educational institution to its students will be taxed at Nil rate. He
argued that the word “Education” and “Institution” has not been defined in the GST Act
and as per the dictionary meaning educational institution means an organization formed
to impart educational services.

Advance ruling:-
Notification 12/2017- central tax (rate):- specific definition is provided for educational
institution in clause 2 (y) of above notification:-
Educational institution means an institution providing services by way of:-
1) pre-school education and education upto higher secondary school or equivalent;
2) education as a part of a curriculum for obtaining a qualification recognised by any law
for time being in force
3) education as part of an approved vocational education course;
So, Simmple Shukla tutorials is in no way covered in definition of educational institute as
given above in notification. The Authority found that the private institute doesn’t have
any specific curriculum and does not conduct any examination or award any
qualification recognized by any law which would be covered in the above notification.
“The activity of the appellant is not covered under by the specific definition provided for
interpretation of exemption notification. We find that the education service provided in
the case is taxable at the rate of 9% under CGST Act and 9% under SGST Act.”

Adil - Short Motivational Story
“Adil!”
It was Ammi.
“Adil, wake up beta.”
Adil was awake. Lying on the bed, he stared at the ceiling fan. It was not much
use, it did not cool the room as it once did. But it was switched on every night,
almost like a ritual. No one knows what’s happening or why, but it is done
anyway. It was the same. The fan was useless, yet it dutifully went round and round
and round, with no one gaining anything.
“How symbolic”, thought Adil. His life was pretty much the same. It was going
down in spirals. He did not know what was he doing or why, but he was pretty sure
that like the fan, all he was bringing to the room was disappointment.
Thoughts were the only thing Adil had. All throughout his life, all Adil had ever
done was think and plan and imagine all of those in his head. It was said that great
thinkers went really ahead, but where can only thoughts take you. Well, down. At
least he had thatanswer.
Adil was stuck. From the beginning, Adil had seen Abbu slave every day. They
were not poor, no. They lived quite comfortably. Everything Adil and Nikhat
every desired was dutifully provided for by Abbu. But he worked very hard. Every
day, for 12 hours, Abbu transformed into That Chaiwalla. That was it. Nobody
probably knew his name, he was the Chaiwalla. The Chaiwalla who stood and
served tea to hundreds in a day, standing over the boiling pot for hours and hours.
And yet when he returned home every night, he was Abbu. Abbu who loved Adil
and Nikhat more than his life.
Even when Abbu was diagnosed with heart ailment a few years back, he did not let
that deter him. He worked day and night to ensure that both his children could
have the liberty of choosing their lives, unlike he had.
Adil always knew what he had to do. He wanted to work and work until he had
achieved everything that he had ever dreamt of. He wanted to ensure that none of
Abbu’s sacrifices had to go to waste. But he had not done that. He was not even close.
He hadn’t even started. This lack of start could be blamed on Adil’s tendency to
overthink. The consequences if Adil failed to be the person that he wanted to be
would be severe. It was precisely this that scared him. He was afraid. So afraid of
falling that he never started walking.
“Adil, get up.” Ammi’s voice cut into his thoughts.

It was noon when Adil stepped out of the house, ignoring Ammi’s please to stay for
lunch.
“I’m not hungry Ammi,” Adil had said.
“But you must eat Adil, it is never a good habit to skip meals. And where are you
going anyway?”
“I’m going to the library Ammi. Don’t wait for me”, and he left without waiting for
a reply.
Phew. That was close. It was the day of the results and Adil
did not want to see his life fall apart yet one more time at
home. He was pretty sure he was not going to make it
through, and he could not bear the thought of looking into
Abbu’s and Ammi’s eyes. There was never
disappointment, and no contempt every time Adil fell.
There was just belief, and hope and trust.
Abbu had always trusted him, and he believed that every
time that Adil had fallen, he had risen up with new
experiences and a new outlook. Except that it wasn’t the
case. He had betrayed Abbu every single time, and now he
did not have the courage to look him in theeyes.
Adil checked the time. 12:07.The results were expected around noon.
“Should be out any time now.”
He had no idea what he were to do if he failed this time too. With his history, he
could not even land a decent job. And a decent job was not even the beginning of
his dreams. But it could give him financial stability, and capital for his future. But
with the way things were going, the chances of that happening were bleak.
Ding. His phone buzzed just then. It was a message from his friend – ‘They are out!’
With trembling hands Adil logged on to the site, and punched in his seat number.
While the page loaded, Adil prayed to every deity known to mankind. He prayed
for light. He prayed for hope. And just then he glanced on the screen.
‘FAIL’.
His fate was sealed.

Adil sat on a bench in the park he used to frequent in his childhood. It was dusk. He
watched the light fade into the dark. To his mind, dusk was the hour of the fallen.
The time when the defeated, the lonely came out because the dark helped their
broken eyes from being recognised.
All throughout his life, Adil had never really watched the sun set. Sure, he had
seen a lot of them, but never watched the phenomenon. But he watched this evening.
As he watched the final few traces of daylight descend into the dark sky, he was hit
by a profound feeling of loneliness.
The loneliness hurt, it was a burden really. But it helped him focus today. His life
was flashing by in front of his eyes, and he recalled everything. Every single thing
that made Adil into what he wastoday.
Adil used to come to this park as a child. Every week, Abbu used to take out his
scooter, with him driving, Ammi sitting behind, Nikhat parked between the two of
them and Adil standing in the front. Those were happy times, unburdened by the
weight of life.
But now the time was different. Adil was breaking. The weight of his dreams was
crumbling him.
Everything was falling apart. The most important thing in his life right now was his
career, without which he would be unable to give Abbu the life he wants. But his
career was going off tracks, which meant Abbu would slave and slave for his family,
without Adil contributing anything. Further, he had his own dreams, his own
ambitions. All of them would have to be abandoned. He would be letting everyone
down – Abbu, Ammi, Nikhat, but most importantly, himself. It was this that was
killinghim.
Adil always knew the consequences of his failure. It scared him. And that was
precisely why he never even tried, he always gave up before he could even get
started. Fear. A strange feeling. Fearing something just enough can be the factor of
motivation in some. But anything more than that will trap you so that you can
never move forward.
‘I am a failure. I have let everyone down. And Abbu.. He sacrificed his entire life for
me, even though I am worthless……
“Abhi.. look where we are now.
Adil looked in the direction of the voice. A young couple had entered the garden
with a little baby. Not more than a year old. The man carried the baby, and once
they came in, the man put him down. He started crawling as soon as he was put
down, and moved towards his father.

Seeing them triggered a lot of memories for Adil. He continued watching them.
The baby was now trying to walk, his father held his hands while he took baby
steps. But each time he took a step, his legs wobbled and he fell down.
Then he would rise up and take another step and fell each time he did that,
laughing all the while. But he got up every time. Every single time.
Days of self talk and motivational speeches couldn’t get to Adil, yet this little thing
did. The whole incident tugged at his heart. The baby probably did not even know
it was going to fall, but he walked anyway. He took each step, however small.
Fear of falling had not kept him from trying. And that was what Adil saw. That
was what Adil understood.
The single thing that matters the most are your efforts. Results will follow,
sometimes soon, sometimes eventually. But they do come to you. If you don’t
get up, you wont learn how to walk. If you don’t walk, how will you run.
Adil felt free. As if a load had been taken off from his mind.

Pandemic
Sitting by the window, I hear birds chirping,
constant cooing and melodious singing,
It all takes me back to the good old days,
When we all were not in this house arrest,
When our world was healthy, limitless and free,
Basking in the glory of numerous opportunity,
I vividly remember the fun and laughter we had,
After a day of hard work and facing challenges bad,
Today we all are following the protocols, maintaining the rules set,
For saving our lives and of our dearest...
Caged in our own homes, away from the so-called perfect world we built,
All our hopes and dreams lay in ashes as we see our castles ruined...
The world has lost its charm they say, for every city we built is at halt today...
I wonder if this is true? As I saw them gleaming with joy,
The silence which annoys us, they enjoy.
I saw the world in its purest form...
The one which was meant to be perfect but which was modified by our endless greed,
where we tried to make the planet our slave indeed...
Busy building City of our dreams, we obliviated the most precious gift to care,
As the world comes to halt we realize the damage caused is beyond repair,
Call it a pandemic or biological war or any name you think fair,
But this is the retribution for simply demanding more than our share,
Hope we'll get back our World as before,
One thing must not be forgotten for sure,
The planet not only belongs to us but also to plenty of living beings,
As for a mother all her children are equal and no one is supreme..

Born and raised in a small town of Jharia - a part of Jharkhand,
we lived a simple yet contented life. Every time I crossed the
narrow lanes of Jharia, there was this dream of making it big in
those starry metro cities. It was Mumbai, where I was destined
to make it big.
Mumbai is a testing platform for your dreams, persistence, and
perseverance. Life isn’t easy here, right from traveling to
seeking a job. I started a part-time job with a CA firm during
my vacations. This is where I realized my passion. The power
and prestige of being a CA started to fascinate me and I
decided to take it up as a career.
I cleared CPT and IPCC levels in the first attempt and felt as if I
was just a step away to conquer the world. Like thousands of
students, I too studied day in and out for finals, worked hard,
and was ready to rock the exams. But when the results came
out, it was Fail!
CA course has taught me many things, e.g.: hard work,
determination, and dedication. But it has also made me taste
failures and taught me to bounce back with more strength. I
re-appeared and finally cleared the exams. Now working with
one of the big-4. I have travelled across countries for work and
experienced things that are beyond words because of CA.

"TO BE ACHIEVER, BE A LEARNER".
"Learning" is the only thing the mind never exhausts, never fears
and never regrets. If you are determined and ready to be a learner
you can achieve every milestone. Coming to achieving CA as a
caption is indeed a journey to be learner from the day of being
enrolled in this course till the day of achieving CA title and
further pursuing CA as a career, learning and implementing
attitude is the key to success.
From the first day of my articleship preparation for CA Finals was
started, don't just wait for preparation leave to study, start
learning from each and every work and experience.
For writing and clearing exams what I followed is conceptual
clarity, cumulative revisions, summarizing notes for day before
exam revision, memorizing key words, adequate sleep (7 hours),
break of around 10 minutes after 3 hours of study, writing
practice, most importantly avoiding distraction like social media
and stay focused. If you genuinely want something don't wait for
it, teach yourself to be impatient. The Starting point of all
achievement is desire.
Lastly welcome to the world of {Doctor of Finance} this is what I
have named Chartered Accountant as. All the best future
Chartered Accountant's.

Challenge it & Achieve it !!!!
Folks!!! I hope you feel worth reading about my Mantra :)
1) At time of Classes -
Be Regular to classes and take sufficient breaks every
weekend (Free up mind)
Maintain hand notes and be sure that before going to bed you
must complete revision of daily notes .
2) At time of Preparation -
Decide – Both or Single groups
Attend the mock test series every week
While preparing for mock-test, new points like Amendments /
shortcuts / other points which you tend to forget, mark it in
different colour so when you turn pages you notice them.
After mock test then self-evaluation to be done, (self-evaluate
your own answers) and update the notes with new points
(Mistake should be made only once)
Give one Semi Final.
3) At time of Final Exams –
You will be left with only few hours, start with very well
known and good weightage topics (Aim -70% to 80% coverage)
Ample sleep
During the exam – Prioritize in such a way ‘Less time –
Optimizing to score high’, don’t get stuck with any question if
you are not aware (100 % attempting is myth”)
Post Exam –Move on for next exam.
