OTHERS CONCERNED.

SUBJECT : POLICY GUIDELINES ON THE CREATION, MODIFICATION, CHANGE
AND REGISTRATION OF CORPORATE SEALS OF LOCAL

GOVERNMENT UNITS.

Pursuant t o Sect io n 22(b), Chapt er 2, Tit le One, Bo o k I o f t he L o cal Go vernment Co de o f
1991, as implement ed by Art icle 48, Rule IX, o f it s Implement ing Rules and Regulat io ns, lo cal
go vernment unit s (L GUs) may co nt inue using, mo dify, o r change t heir exist ing co rpo rat e
seals pro vided t hat t he newly-est ablished L GUs o r t ho se wit ho ut co rpo rat e seal may creat e
t heir o wn co rpo rat e seals which shall be regist ered wit h t he Depart ment o f Int erio r and L o cal
Go vernment (DIL G) and pro vided furt her t hat any change o f co rpo rat e seal shall also be
regist ered wit h t he DIL G.

In view, t hereo f, t he fo llo wing pro cedural guidelines are hereby issued fo r t he pro per
guidance o f t he L GUs.

Any creat io n, mo dificat io n, o r change o f co rpo rat e seal shall undergo fo ur (4) phases,
namely: Designing, Review, Approval, and Registration before such seal becomes and
o fficial inst rument fo r public use o r purpo se.

Designing
. T he co rpo rat e seal depict s t he sent iment s and aspirat io ns o f t he peo ple and by it s nat ure,
designing t hereo f shall, as much as po ssible, invo lve a bo ard sect io n o f t he L GU co ncerned.
T he L GU may spo nso r a co rpo rat e seal designing co nt est which is o pen t o any int erest ed
part y wit hin t he L GU.

. To guide t he co nt est ant o r designer, as t he case may be, t he fo llo wing designs and
specificat io ns prescribed by t he Nat io nal Hist o rical Inst it ut e (NHI) shall be st rict ly o bserved.

T he co rpo rat e seal o f t he L GU shall feat ure eit her visual, abst ract , o r nat ural emblems
represent ing significant charact erist ics o r aspect s o f it s geo graphy, t o urist spo t s, o r
hist o rical landmarks, eco no mic o r cult ural aspect s o r event s relat ed t o it s hist o ry, i.e. Mayo n
Vo lcano o f t he Pro vince o f Albay, pine t rees o f t he Cit y o f Baguio , rice t erraces o f t he
Municipalit y o f Banaue, Pro vince o f Ifugao , Baraso ain Church o f t he Municipalit y o f Malo lo s,
Province of Bulacan.

Pict o rial suggest io ns shall co nfo rm wit h basic heraldic t radit io n such t hat heraldry is t he
basic language and science o f art s, signs and symbo ls. T he L GU may select o ne significant
aspect t o be inco rpo rat ed in t he seal t hat will serve t he purpo se, e.g. fish o r crust acean
st ands fo r aquat ic reso urces, rat t an o r bambo o fo r co t t age indust ry. Refer t o Annex “A” fo r
t he Signs and Symbo ls.

Since t he shield is t he mo st impo rt ant part o f t he co rpo rat e seal, t he seal o f all co mpo nent
municipalit ies shall ado pt t he shape o f t he shield o f t he pro vincial seal. In t he case o f
barangay, t he cit y o f municipal seal shall be ado pt ed in t o t o . Ho wever, t he name o f t he
barangay shall o ccupy t he t o p po rt io n o f t he ring bo rder while t he bo t t o m shall indicat e t he
name o f t he cit y o r t he municipalit y and pro vince where t he barangay belo ngs. See Annexes
“B” and “B-1,” “C” and “C-1” for samples.

. To meet t he dimensio n o f t he st andard design as prescribed by t he NHI, t he det ails o f t he
det ails must be reco gnizable even when t he seal is reduced t o it s no rmal required sizes as
engraved in met al fo r dry seal and as print ed fo r let t erheads, i.e. 2.54 cent imet ers fo r
st at io neries, 1 cent imet er fo r envelo pes, 3.08 cent imet ers fo r dry seal.

. T he fo llo wing limit at io ns in designing t he seal shall likewise be o bserved:

T he use o f t he fo reign heraldic o bject is disco uraged. T he co mpo nent o f t he seal must
feat ure t he F ilipino sense o f nat io nalism, e.g. sampaguit a o r narra leaves in lieu o f laurels,
Philippine eagle inst ead o f American bald-headed eagle;

T he use o f t he seal o r co at -o f-arms o f t he Republic o f t he Philippines as co mpo nent o f t he
L GU seal is pro hibit ed. T he use o f t he Philippine nat io nal flag is also disco uraged except
where t he flag has beco me part o f t he L GU’s hist o ry like t he Municipalit y o f Kawit , Pro vince
o f Cavit e as t he sit e o f t he declarat io n o f Philippine Independence and t he Municipalit y o f
Samal, Pro vince o f Bat aan as t he defender against fo reign aggressio n; and

T he co rpo rat e seal o f t he L GU is a sign o f aut ho rit y and t herefo re, it shall no t be used as

perso nal seal o f t he lo cal chief execut ive, e.g. t he t ext Municipa l Ma yo r, Cit y Ma yo r, o r
Pro vincia l Go ve rno r indicat ed wit hin t he ring bo rder o f t he seal is no t allo wed. F o r
municipalit ies, t he name o f t he municipalit y shall be emblazo ned o n t o p and t he name o f t he
pro vince at t he bo t t o m.

. T he winning o r select ed ent ry shall t hereaft er be submit t ed fo r react io n t o a co nsult at ive
meet ing part icipat ed in by represent at ives o f vario us int erest gro ups o r no n-go vernment
o rganizat io ns wit hin t he L GU. T he winning o r select ed ent ry may be mo dified as a result o f
t he said part icipat ive meet ing.

Review
. T he L GU shall submit it s pro po sed co rpo rat e seal t o t he Bureau o f L o cal Go vernment
Supervisio n (BL GS), DIL G, t hro ugh t he DIL G Regio nal Office co ncerned. T he DIL G
Regio nal Office shall review as t o co mplet eness o f do cument at io n. T he pro po sed co rpo rat e
seal shall be suppo rt ed by t he fo llo wing do cument s:

Transmit t al let t er o f t he lo cal chief execut ive addressed t o t he Chairman o f t he NHI
request ing review o f t he pro po sed co rpo rat e seal;

Sanggunian Reso lut io n endo rsing t he pro po sed co rpo rat e seal t o t he NHI fo r appro priat e
act io n.

Brief hist o rical backgro und o f t he L GU; and

Pho t o graphs o f exist ing st ruct ure, o bject s, o r scenic spo t s inco rpo rat ed in t he pro po sed
seal, t o get her wit h narrat ive descript io n fo r pro per visual represent at io n, i.e. t errain, building,
bridge, bell, et c.

. T he L GU shall see t o it t hat a co py o f t he pro po sed seal, t o get her wit h t he suppo rt ing
do cument s, is pro perly kept in t he o ffice o f t he secret ary t o t he sanggunian.

. T he DIL G Regio nal Office shall t ransmit t o t he BL GS a co mplet e set o f t he pro po sed
co rpo rat e seal wit hin t hree (3) wo rking days fro m receipt . Ot herwise, t he L GU co ncerned
shall be info rmed pro mpt ly o f any lacking do cument (s).

. Immediat ely upo n receipt o f t he pro po sed seal, t he BL GS shall co nduct an init ial t echnical
review o f t he do cument s submit t ed and t hereaft er t ransmit t he same t o t he NHI.

. T he NHI shall review t he pro po sed seal t o det ermine whet her it co nfo rms wit h basic heraldic
st andards and specificat io ns. When necessary, t he NHI shall mo dify t he pro po sed seal in
acco rdance wit h it s prescribed designs and specificat io ns bu ret aining in t he pro cess t he
dist inct ive signs and symbo ls inco rpo rat ed in t he said seal.

Approval
. Aft er t he review pro cess and t he necessary mo dificat io ns, t he NHI shall fo rward t o t he
Chairman o f t he Nat io nal Co mmissio n o n Cult ure and Art s (NCCA) t he mo dified co rpo rat e
seal reco mmending appro val t hereo f.

. Immediat ely aft er t he appro val by t he Chairman o f t he NCCA, t he appro ved co rpo rat e seal
shall be ret urned t o t he Chairman o f t he NHI, who shall t ransmit t he appro ved seal t o t he
lo cal chief execut ive co ncerned, co py furnished t he BL GS.

. T he lo cal chief execut ive shall reco mmend t o t he sanggunian fo rmal ado pt io n o f t he
co rpo rat e seal t hro ugh a reso lut io n.

Registration
. T he lo cal chief execut ive shall regist er t he appro ved seal wit h t he DIL G aft er t he appro ved
seal is fo rmally ado pt ed by t he sanggunian.

. F o r regist rat io n purpo ses, t he L GU shall submit t he fo llo wing do cument s:

Transmit t al let t er o f t he lo cal chief execut ive;

Co py o f t he sanggunian reso lut io n ado pt ing t he seal duly appro ved by t he Chairman o f t he
NCCA; and

Cert ified pho t o co py o f t he co rpo rat e seal as appro ved by t he NCCA.

. A Cert ificat e o f Regist rat io n shall be issued by t he Secret ary t o t he lo cal chief execut ive
co ncerned, co ursed t hro ugh t he DIL G Regio nal Office, and co py furnished t he NHI.

. T he DIL G, t hro ugh t he BL GS, shall regist er t he co rpo rat e seal and acco rdingly ent er t he
same in a Regist ry Bo o k indicat ing amo ng o t her t hings, t he name o f t he L GU, number and
dat e o f t he sanggunian reso lut io n ado pt ing t he appro ved seal, and act ual dat e o f regist rat io n
as sho wn in t he dat e o f t he cert ificat e o f regist rat io n signed by t he Secret ary.

REGULATING THE MANUFACTURE, SALE, DISTRIBUTION, AND USE OF PNP
UNIFORMS, INSIGNIAS, AND OTHER ACCOUTREMENT

WHEREAS, t he PNP unifo rms, insignias and o t her acco ut rement are symbo ls o f a
discipline and an image which po rt ray t he charact er and being o f every po liceman mo st
represent at ive o f a pro fessio nal Philippine Nat io nal Po lice;

WHEREAS, t he use o r wearing o f PNP unifo rms, insignias, and o t her acco ut rement
pro ject s at t he very first inst ance an ident it y t hat est ablishes a dist inct ive reco gnit io n
exclusive t o every po liceman and t he Philippine Nat io nal Po lice;

WHEREAS, t he PNP unifo rms, insignias, and o t her acco ut rement are easily available
and/o r pro cured fro m an manufact urer, seller, dist ribut o r, o r supplier by any perso n, including
unscrupulo us and lawless individuals who make a mo ckery o f t heir use fo r perso nal gain,
unlawful purpo ses and/o r o t her designs t o degrade t he po liceman and t he Philippine Nat io nal
Police;

WHEREAS, while art icle 179, “Illegal use o f unifo rms o r insignia” o f Republic Act 3815,
o t herwise kno wn as t he Revised Penal Co de o f t he Philippines penalizes any perso n who
shall publicly and impro perly make use o f insignia, unifo rms, o r dress pert aining t o an o ffice
no t held by such perso n o r t o a class o f perso ns o f which he is no t a member, it do es no t
include t he illegal manufact ure, sale, and dist ribut io n o f t he same;

WHEREAS, while Republic Act No . 493 was also enact ed pro hibit ing, amo ng o t hers t he
wearing, use, manufact ure, and sale o f insignia, deco rat io ns and medals, badges, pat ches,
and ident ificat io n cards prescribed fo r t he “Armed F o rces” o r “Co nst abulary,” it do es no t
apply t o t he Philippine Nat io nal Po lice;

WHEREAS, t here is no law t hat go verns and regulat es t he manufact ure, sale dist ribut io n
and use o f unifo rms, insignias and o t her acco ut rement o f t he Philippine Nat io nal Po lice;

WHEREAS, t o ensure t hat PNP unifo rms, insignias, and o t her requirement s are
manufact ured, so ld, dist ribut ed o r supplied o nly by aut ho rized manufact urer dist ribut o r,
supplier and/o r seller and used exclusively by unifo rmed perso nnel o f t he PNP, t here is a
need fo r regulat io n.

NOW, T HEREFORE, I, JOSEPH EJERCIT O EST RADA, President of t he Republic of t he
Philippines, by t he po wers vest ed in me by law, do hereby o rder:

SECT ION 1. The unaut horized manufact ure and dist ribut ion of PNP uniforms, insignias, and
o t her acco ut rement is hereby pro hibit ed. Any vio lat io n o f t his rule shall, aft er due no t ice and
hearing, result in immediat e clo sure o f t he est ablishment , plant and/o r o ffice where t he
unifo rms and o t her it ems are manufact ured, st o red, so ld and/o r dist ribut ed, t he cancellat io n
o f it s business license o r permit , t he co ndemnat io n, seizure and fo rfeit ure o f all paraphernalia
used o r int ended t o be used fo r t he manufact ure, sale, and/o r dist ribut io n and t he impo sit io n
o f reaso nable administ rat ive fines, wit ho ut prejudice t o t he filing o f administ rat ive, civil,
and/o r criminal act io ns.
SECT ION 2. The use of PNP uniforms, insignias, and ot her accout rement by a person who
is no t a member o f t he unifo rmed Philippine Nat io nal Po lice perso nnel is also pro hibit ed. Any
vio lat io n o f t his rule shall, aft er due no t ice and hearing, be penalized by public censure which
shall be published at least o nce in a newspaper o f general circulat io n wit ho ut prejudice t o t he
filing o f administ rat ive civil and/o r criminal act io ns.
SECT ION 3. The Philippine Nat ional Police shall adopt it s own uniforms, insignia, and ot her
acco ut rement fo r t he exclusive use o f it s unifo rmed perso nnel. T he unifo rm and o t her it ems
shall be subject t o inspect io n and accept ance pro cedures o f t he Philippine Nat io nal Po lice
wit h each design and specificat io n appro ved by t he PNP Unifo rm and Equipment
St andardizat io n Bo ard (UESB). As such, o nly t ho se accredit ed by t he PNP and t he Nat io nal
Hist o rical Inst it ut e are aut ho rized t o manufact ure, sell o r dist ribut e t he same.
SECT ION 4. The Chief, Philippine Nat ional Police shall issue rules and regulat ions for t he
effect ive implement at io n o f t his Execut ive Order.
SECT ION 5. All orders, issuances, rules and regulat ions or part s t hereof inconsist ent wit h
t his Execut ive Order are hereby repealed o r mo dified acco rdingly
