Ahmad yani Km. 6 Banjarmasin, South Kalimantan gustishofia@gmail.com Abstract. Ta’zir is a sanction for a customer who deliberately violates the contract and the acquisition cost is determined as a social fund, while Ta’wid is compensation for losses that can be calculated and become bank income. This paper aims to find out and describe the implementation of ta’wid and ta’zir for troubled financing customers in Islamic banks and to find out how the force majeure criteria and parameters for financing customers affected by Covid-19 are applied in determining ta’wid and ta’zir instruments. This research is qualitative research using library sources. The method used is descriptive-analytical, from the results of the research, it is known that the application of ta’wid and ta’zir is an anticipatory action and is aimed at making customers disciplined in carrying out their contracts. This instrument cannot be applied to customers who experience force majeure conditions and the provisions are contained in articles 1244 and 1245 of the Civil Code. The condition of the Covid-19 pandemic can be used as an excuse for a force majeure condition, due to the 2020 Regulation of the Minister of Health no. 9 concerning restrictions on community activities.
