I. RATIONALE/BACKGROUND

Section 3 of the 1987 Philippine Constitution states that "the Congress shall
enact a local government code which shall provide for a more responsive and
accountable local government structure instituted through a system of decentralization
with effective mechanisms of recall, initiative, and referendum, allocate among the
different local government units their powers, responsibilities, and resources, and
provide for the qualifications, election, appointment and removal, term, salaries,
powers and functions and duties of local officials, and all other matters relating to the
organization and operation of the local units." On this constitutional mandate is
enshrined the wisdom of the passage of Republic Act No. 7160, otherwise known as
the Local Government of 1991.

With the passage of such a law, it is now a state policy that local government
units should enjoy genuine and meaningful local autonomy to enable them to become
self-reliant communities.

One of the powers vested to local government units to ensure the attainment of
such local autonomy is local legislation or local legislative power.

It is defined as the power to make, alter, and repeal laws (League of Cities of
the Philippines (LCP) vs. Comelec, G.R. No. 176951, February 15, 2011, 643 SCRA
150). The authority to amend, change or modify a law is thus part of such legislative
power (Yazaki Torres Manufacturing, Inc. vs. CA. G.R. No. 130584, June 27, 2006).

It is good to note that the policy of ensuring the autonomy of local governments
was not intended to create an Imperium in Imperio and install intra-sovereign political
subdivisions independent of the sovereign state. (City of Batangas vs. Philippine Shell
Petroleum Corporation and Chell Philippines Exploration B.V., G.R. No. 195003, June
07, 2017).

Thus, local legislative bodies exercise only delegated legislative powers
conferred on them by Congress. Local governments are vested with the power of
subordinate legislation (Magtajas vs. Pryce Properties Corp., Inc., 234 SCRA 255
[199]).

The local sanggunian, laden with the local legislative power and function, can
pass resolutions and ordinances to exercise such delegated authority. Resolutions are
expressions of sentiment or opinion for private or propriety purposes and are
temporary. On the other hand, ordinances have the force and effect of law for public
or governmental purposes and are more or less permanent.

Ordinances are presumed valid in the absence of evidence showing that it is
not in accordance with the law (Leynes vs. COA, G.R. No. 143596, December 11,
2003, 418 SCRA 180). Ordinances are presumed to have regularity of governmental
acts and the presumption of constitutionality (Tano vs. Socrates, G.R. No. 110249,
August 21, 1997, 278 SCRA 154).

However, municipal ordinances are inferior in status and subordinate to the
laws of the State (Batangas CATV, Inc. vs. C.A., G.R. No. 138810, September 29,

2004, 439 SCRA 326). It means that ordinances cannot undo the act of Congress
(Lina, Jr. vs. Paño, G.R. No. 129093, August 30, 2001, 364 SCRA 76).

Furthermore, a municipal ordinance must not contravene the Constitution or
any statute; otherwise, it is void (Tan vs. Pereña, G.R. No. 149743, February 18, 2005,
452 SCRA 53).

Nevertheless, by resolution, local government units may express their views
contrary to the national government. It is part of the local government's autonomy.
However, the freedom to exercise its contrary view does not mean it may enact
ordinances that go against the laws duly enacted by Congress (Lina vs. Paño, supra).

The Department of the Interior and Local Government (DILG) under Republic
Act No. 6975, otherwise known as the Department of the Interior and Local
Government (DILG) Act of 1990, is vested with the powers to assist the President in
the exercise of general supervision over local government units.

Thus, it is part of the mandate of the Department to ensure that the legislative
powers exercised in and of the local government units are consistent with the premise
of the Constitution, the Local Government Code of 1991, and other applicable statutes.

The Component II: Supervised Field Work (SFW) of the Apprenticeship
Program for LGOOs II and III – Batch 54 is designed to hone the skills of the
apprentices, the next generation of DILG Field Officers, to exercise appropriate

general supervision and provide apposite technical assistance and capacity building
interventions for local government units through competency building exercises.

One of these exercises and component output requirements is observing the
local legislation process in their assigned City or Municipality.

The exercise is designed so that the apprentices can check whether or not the
Local Sangguinian is attuned with the provisions of the Constitution, the Local
Government Code, and other applicable statutes. Apprentices are also expected to
detect the congruence of the Sangguniang's Internal Rules and Parliamentary
Procedures with their actual dispense of functions during a session.

Hence, this observation of the local legislative process of the Sangguniang
Panlungsod of Tandag by the undersigned apprentice is herein presented following
the above premises.

II. OBSERVATION

The apprentice, along with the rest of the members of "The Nomad ELMs" the
apprentices of Supervised Field Work in Tandag City which is composed of LGOO II
Marlon C. Monterola and LGOO II Imi Louda B. Espina, were able to join the 35th and
36th regular sessions of the 6th Sangguniang Panglungsod of the Tandag City as
observers.

They were permitted to conduct the observation after the good Vice Mayor
Eleanor D. Momo approved the letter request sent by CLGOO Olivia P. Bagasbas on
the matter.

The team reviewed the Sanggunian's Internal Rules and Procedures (IRP) as
a preparatory measure for the said observation. The review was for the team to
become conscious of how the Sangguniang Panlungsod Members show decorum and
dispense functions during their session in contrast to their set rules.

The 35th regular session took place on September 14, 2022, while the 36th
regular session was on September 21, 2022. All transpired on a Wednesday, the
designated day of Sangguniang Panglungsod Sessions as stipulated in S.P.
Ordinance No. 014 series of 2022 entitled, "Instituting the Internal Rules of Procedures
of the 65th Sangguniang Panlungsod of the City of Tandag for the Period 2022 –
2025."

A. PROCESS

It was difficult to fault the two regular sessions that the apprentice
witnessed because the Sangguniang Panlungsod of Tandag City demonstrated
faithfulness to their Internal Rules of Procedure both in the conduct of their
sessions and the sheer professionalism exhibited by its members. Also, the
Sangguniang Panlungsod Secretary, stenographers, staff, and the technicians
supervising the audio-visual paraphernalia used in the session hall exuded
professionalism.

As a general impression, the Sanggunian Panlungsod of Tandag City is
a band of knowledgeable and competent legislators who know their duties and
responsibilities and carry them out in a notable manner befitting commendable
public service.

The Regular Presiding Officer

The Sangguniang Panlungsod of Tandag City is led by Vice Mayor
Eleanor D. Momo, wife of the Congressman of the 1st District of Surigao del
Sur, Engr. Romeo S. Momo.

She is a seasoned public servant serving as a former Punong Barangay
in Barangay Telaje, Tandag City, and Sangguniang Panlalawigan Member and
Vice Governor of the Province of Surigao del Sur.

Her wealth of experience as a presiding officer is prevalent as she
presided over the 35th Regular session of the 6th Sangguniang Panlungsod.

The apprentice observed that she strictly ascribes to the rules of
procedure while maintaining a diplomatic approach to upholding order
throughout the session. She was skilled at cutting off rude remarks, unwelcome
interjections, and interruptions from those on the floor.

Without a strong presiding authority, sessions incline to devolve into utter
chaos and disarray. Sessions may become disordered if the presiding officer
lacks even a rudimentary understanding of parliamentary rules and procedures
during discussions or interjections regarding, for example, a measure passed
by a member when everyone is trying to convince others to join the cause.

Her leadership is commendable, and that is integral in a Sanggunian.

The Temporary Presiding Officer

During the 36th Regular session of the 6th Sangguniang Panglungsod of
Tandag City, Vice Mayor Momo was on leave, and a temporary presiding officer
took the lead in the proceedings.

SP Member Al P. Geli was chosen as the temporary presiding officer by
a unanimous majority of the members in attendance. This action complies with
Section 49(b) of the Local Government Code of 1991 and DILG Opinion 104,
Series of 2002, and is within the ambit of their IRP.

As the temporary presiding officer, he demonstrated sound leadership
during the session. He was skillful in dispensing his role and ensured that the
proceeding was as orderly as possible.

Since he is a temporary presiding officer and his committee report has
already part of the order of business, he yielded his seat during his turn of
committee reports. However, he participated in casting votes for a request for
the appearance of a particular resource person for the next session, which the
apprentice finds erroneous.

A temporary presiding officer who merely steps into the shoes of the
presiding officer could not have a greater power that is possessed by a regular
presiding officer (Zamora vs. Caballero, G.R. No. 147767, January 14, 2004,
419 SCRA 384). He can only vote to break a tie. Hence, he cannot rise above
the powers of the regular presiding officer (DILG Opinion 46, s. 2009).

The Members of the Sangguniang Panglungsod

The 6th Sangguniang Panlungsod of Tandag City is composed of the
following members in order, viz:

3. Alvin C. Ty, Jr.
4. Rosario Ninfa G. Dumagan II
5. Andrei A. Andresan
6. Gay Geraldine G. Tan
7. Philip George S. Azarcon
8. Al P. Geli
9. Albert D. Perez
10. Rebecca N. Avila

Ex-officio members, viz:
1. Rocky Roger M. Pimentel – Liga President
2. Sharie Mae L. Acosta – SK Federation President
3. Cesar A. Bat-ao – IPMR

The apprentice observed that each member of the Sanggunian present
during the 35th and 36th Regular sessions showed tangible professionalism.
Those that were able to speak spoke audibly and intelligibly.

The apprentice particularly noticed the masterful performance of SP
Member Rosario Ninfa G. Dumagan II, who showed how seasoned she was
each time she was allowed to take the floor.

SP Member Dumagan possesses a strong command in parliamentary
procedures as manifested by her substantial committee reports, passionate
discourse during privilege hours, and each time she provides practical inputs
during interpellations. However, there were times that she butts in the
discussion sans proper recognition from the presiding officer.

She is an example for the rest of the members to emulate.

The apprentice noticed that during the 36th regular session, SP Member
Cesar A. Bat-ao took the floor during the privilege hour. He discussed Provincial
Ordinance No. 15-19, dated November 26, 2019, entitled: "Regulating the Entry
of Migrants to Certificate of Ancestral Domain Title (CADT) Areas and Tribal
Communities in the Province of Surigao del Sur." In the middle of his discourse,
the SP Secretary interrupted him, stating that it was still a "privilege hour" and
that his concern was already part of the order of business under the committee
reports.

The presiding officer took note and requested SP Member Bat-ao to
leave the floor and present such concern during his turn of committee reports.
The latter graciously yielded and vacated the floor, apologizing for his misstep.

Overall, the members present during both sessions were courteous to
each other and presented themselves jobwise.

Internal Rules of Procedure

The Internal Rules of Procedure (IRP) of the 6th Sangguniang
Panlungsod of Tandag City was instituted through S.P. Ordinance No. 014
series of 2022 entitled, "Instituting the Internal Rules of Procedures of the 65th
Sangguniang Panlungsod of the City of Tandag for the Period 2022 – 2025."

The apprentice noticed that this move is peculiar since it is stipulated in
Section 50 of the Local Government Code of 1991 that the Sanggunian "on the
first regular session following the election of its members and within ninety (90)
days thereafter, the sanggunian concerned shall adopt or update its existing
rules or procedure" (emphasis added).

While it is not definite, and there is no specific legal basis indicating what
form of legal instrument a sanggunian must pursue relative to the institution of
their rules of procedure. However, the DILG opined that an IRP is a mere
narration of rules that are temporary and must be adopted through a resolution
(DILG Opinion 67 s. 09).

It is good to note that ordinances are municipal legislation passed by the
local legislature that establishes broad, consistent, and uniform standards for
public behavior. Making an IRP into an ordinance is inappropriate in this context

because it only pertains to the Sanggunian's internal proceedings. It was never
meant to be used by the general population. Its application is restricted to one
particular government entity and the way that body must conduct its meetings
and other legislative procedures.

Thus, the apprentice believes that the IRP of the 6th Sangguniang
Panlungsod of the Tandag City should have been sufficiently instituted through
a resolution only.

Further, during the review of the IRP, the apprentice and the team were
drawn to Section 20, Rule IV. It is stipulated therein, "where there is no quorum,
the Presiding Officer may declare a recess until such time a quorum is
constituted, or a majority of the members present may adjourn from hour to
hour, or day to day and compel the immediate attendance to a session of any
member absent without justifiable cause…" (emphasis added).

The said provision takes cognizance of Section 53 (b) of the Local
Government Code of 1991 save to the specificity of the Philippine National
Police to be coordinated with, and the added "hour to hour" statement.

The additional statement implies that the presiding officer or a majority
of the members can adjourn multiple times in a single day. It is directly
contradictory to Section 52 (c) of the Local Government Code which expressly
states that "…No two (2) sessions, regular or special, may be held in a
single day" (emphasis added).

The Proceeding
The apprentice observed that in comparison to the 18th Regular session

of the City Council of Marikina on June 24, 2019, which served as material for
local legislation observation under Module 2: Dynamics in Local Governance in
Component I of the Apprenticeship Program, the sessions he witnessed in the
Sangguniang Panlungsod of Tandag City were not as lengthy and significantly
more orderly.

It is good to note that the Sangguniang Panlungsod of Tandag City
strictly accords with their rules and to Section 52 (a) of the Local Government
Code, "…the minimum number of regular sessions shall be once a week for the
sangguniang panlalawigan, sangguniang panlungsod, and sangguniang
bayan…." Their expedience results in order of businesses being tackled more
swiftly. Hence, a relatively faster session.

B. CONTENT

For the two sessions, the apprentice and his team were given copies of
the orders of business for the day. Such documents enabled them to chart the
progress of the session.

The apprentice observed that the structure of the order of business is
consistent with the commonly accepted template in a parliamentary procedure.

What is commendable is that starting Item VIII. First Reading and
Referral to Committees, the secretariat made sure that substantial annotations
were present so that the august body would know whether or not to opine on
an item. The entries under Item IX. Committee Reports also have notations, as
well as the dates of their first reading, and so forth.

While the apprentice could not secure copies of the committee reports,
he noticed that each sanggunian member was given access to soft documents
where they browse through their designated laptops.

As to the matters discussed, it is notable that most of the standing
committees regularly conduct hearings to address issues that affect the general
welfare of the constituency of Tandag City as reflected in the number of reports
embedded in the order of business.

On each privilege hour, the apprentice observed that some SP members
are passionate about pressing concerns in Tandag City.

For example, during the 35th regular session, SP Member Al P. Geli,
during his privilege hour, conveyed his observation on the Tandag City Water
District bill. He compared his two water bills, dated September 2019 and 2022.
According to his observation, the 2019 water only states "metered water bill,"
whereas the 2022 water bill now has a "franchise tax," which he purports
confuses the consuming public.

To that effect, the general manager of the Tandag City Water District
appeared before the Sangguniang Panlungsod during the 36th regular session
to enlighten the august body regarding the franchise tax. He reasoned that the
Local Water Utilities Administration regulates such tax; therefore, adjustment is
not within the confines of his power.

However, SP Member Dumagan seized the opportunity to ask the
general manager to reduce the burden of disconnected consumers for not
paying on time. She expressed it is too much of a burden to add to the bill 500
pesos for the reconnection fee plus a 10% surcharge. She empathically lobbied
to the general manager that those that got disconnected already struggled
finding a means to pay their bill on time much more to secure payment for the
reconnection fee. She suggested that the board can look into the disconnection
scheme of Surigao Del Sur Electric Cooperative as a benchmark.

The general manager left the session promising to bring the concerns to
their board for consideration.
At the close of the two observations, the apprentice is reduced to concur that
the Sangguniang Panlungsod of Tandag City is scrupulous in dispensing their duties
and responsibilities. The careful attention they have given in the formulation of each
order of business, as well as the crafting of resolutions and ordinances, the timely
committee hearing they conduct, and their nimble approach to issues is reflective of
their sincere commitment to providing sound and just legal measures that will uplift the
quality of living of Tandag City.

III. RECOMMENDATIONS

As a local legislative body, the 6th Sangguniang Panlungsod of Tandag City is
characteristic of professionalism and commendable public service. Their rules and
procedures are well within the ambit of what is deemed constitutional and attuned to
national statutes.

Given their evident professionalism, finding an issue with their current setup is
tricky. Therefore, in agreement with his teammates, the apprentice can only suggest
these easily implementable recommendations to enhance their already excellent
performance, viz:

1. Redefine the Filipino Time as one that is "on time." Schopenhauer once
said, "the common man is not concerned about the passage of time, the man
of talent is driven by it." And the apprentice believes that the men and women
comprising the 6th Sangguniang Panlungsod of Tandag City are supposed to
be persons of talent who are conscious of the value of each time that passes
by. Since their constituency entrusted them with the weighty responsibility of
framing the direction of the city through top-quality legislation, they must ensure
that each time counts.

Specifically, this means they must start their sessions on time. Section 12 of
their Rules states that sessions shall be every Wednesday starting at 09:00
a.m. Also, this covers their use of privilege hours, committee reports, and other
functions that require their timeliness.

Moreover, the apprentice believes that redefining the Filipino time as "on time"
starts with community leaders, especially those sitting in seats of power, such
as the 6th Sangguniang Panlungsod of Tandag City.

2. Encourage participatory legislative process. The apprentice believes that
corollary to the first recommendation, the Sanggunian should ensure that each
member will have the opportunity to express their opinions on pressing
concerns and not leave them to a select few to dominate the discussion. After
all, the Sanggunian is a collegial body, and each member is expected to have
a say in the matters brought before them.

Also, it is high time to ensure that Section 14 of their rules is taken a
notch. It is stated in the section that "Sanggunian Panlungsod sessions or
meetings of any committee thereof shall be open to the public."

One aspect of participatory governance, and perhaps the most
fundamental, is ensuring that active people participation is encouraged and full
disclosure of public matters is observed.

Hence, the apprentice's humble recommendation is that the Sanggunian
make their sessions welcoming to the general public who wishes to observe
their proceedings. With their current setup, they should at least make their glass
door visible. It is also recommended that they explore the use of social media
in broadcasting their sessions, as is the current practice of some sanggunians

in the country. They can also ink MOA with the local television and radio
providers to ensure that their proceedings will be seen and heard by their
constituency. After all, their constituency is directly affected by their actions.
What better way to assess that the Sanggunian indeed attends to their general
welfare is by letting them be more aware of it.

The apprentice further suggests that committees should strengthen
partnerships with Civil Society Organizations such that their recommendations
will be balanced in terms of interest to pressing concerns that need their
legislative output.

3. Repeal Section 20 of their Rules. As discussed in the observation on internal
rules and procedure, the apprentice recommends that the Sanggunian should
repeal Section 20. Precisely, they should remove the words "hour to hour" to
make it in conformity with the Local Government Code of 1991.

4. Invest in top-quality audio-visual equipment. The apprentice observed that
the acoustic of the session hall is not entirely auditory appealing. The
microphones in the hall sometimes do not pick up the words that come out of
speakers, so they register as if mumbling. There are also moments when white
noises are heard, indicating that work must be done on the quality of audio
equipment. Also, one of the projectors is already yellowish, suggesting that it
has lived well beyond its lumen's capacity.

While this recommendation does not constitute their performance as
legislators per se, yet they significantly impact the quality of proceedings,
especially during interpellations where speakers need to be audible. These also
help the secretary and the stenographers pick up the correct statements to
include in the minutes.

To circle things up, the recommendations of the apprentice are minimal and do
not require a magnanimous effort to implement. And looking into the caliber of the 6th
Sangguniang Panlungsod of Tandag City, it is well within their personality and capacity
to cut loose ends and better their current stature.

Overall, the apprentice believes that in the course of the two sessions observing
the Sanggunian, he was able to ascertain that, indeed, they are a corps of professional
legislators who feels and acts for the general welfare of their constituency.

Further, the apprentice believes the activity's objective has emboldened his
capacity as a Local Government Operations Officer, especially on matters relating to
the specificity of the procedures of the local legislature.
