of South Portland Excavation License must take out the permit.

REQUIREMENTS FOR DRIVEWAY ENTRANCE-WIDENING-CURB CUT
PERMIT APPLICATIONS

1. $20.00 APPLICATION FEE (Cash or Check to “City of South Portland”)

2. RESIDENTIAL DRIVEWAY MAXIMUM WIDTH – 20’
(where driveway meets City street, including turning radii)

3. RESIDENTIAL DRIVEWAY MINIMUM WIDTH – 10’

4. MAXIMUM DRIVEWAY ENTRANCES PER RESIDENCE – TWO (2)

5. COMMERCIAL DRIVEWAY WIDTHS – See attached Ordinance..

6. PRE-MARK AREA WITH FLAGS OR PAINT.

7. An inspector will visit your site and view the pre-marked area.

8. Allow one week to hear back from us as to approval or denial.

9. “Entrance to Public Ways” ordinance is attached. (Please note that the
Director of Public Works is no longer involved in issuing the driveway
location permit.)

Distinction between DRIVEWAY ENTRANCE-WIDENING-CURB CUT
PERMITS v. STREET EXCAVATION PERMITS FOR DRIVEWAYS

AKA “Curb Cut” Permits, DRIVEWAY ENTRANCE-WIDENING-CURB CUT PERMITS
differin purpose from “Street Excavation” permits for driveways.

The $20 Driveway Entrance-Widening-Curb Cut permit can be taken out by the property
owner or the contractor and does not require an excavator’s license, because it is not
for the actual excavation that might be involved in creating the driveway. Its purpose is
to permit the location of a new driveway opening along a street for a particular property
or to permit the widening of an existing driveway opening, regardless of the existence of
actual curbing along the street. The Driveway Entrance-Widening-Curb Cut application

is designed to request information required per Article III of Chapter 23, particularly of
Sec. 23-37 and Sec. 23-38 of the Code of Ordinances, which addresses standards and
criteria for the driveway or curb cut location, width, distance from an intersection,
potential for obstruction of view, and number of curb cuts per lot.

A separate Excavation permit may be required in addition to the Driveway Entrance-
Widening-Curb Cut permit application, if the proposed driveway involves any digging by
machinery in the City right of way, as noted below.

The purpose of the $50 Excavation Permit for driveways is to permit the actual
excavation in the City right of way relative to driveway construction or reconstruction.
The driveway may be proposed or already existing. As long as excavation (digging with
machinery) in the City right of way is involved in the driveway work, a $50 Street
Excavation permit for driveways must be taken out by an Excavator licensed in the
current calendar year by the City of South Portland through this department. The
“Excavation Permit” application form is used for driveway right-of-way excavations as
well as for excavations for utilities, poles, or any other street excavation.

$50 is the fee for driveway Excavation Permits, whereas all other Excavation Permits
are $290 each. The Excavator License annual fee is $300, which is paid in addition to
any fees for Excavation Permits. The Excavator License expires on December 31 of the
year of the license and must be renewed prior to obtaining new Excavation Permits the
following year.

Contractors developing new subdivisions will not have to get “Driveway Entrance-
Widening-Curb Cut” location permits, because potential driveway locations are drawn
on the site and subdivision plans submitted for Planning Board approval. Excavation
permits are obtained for the installation of utilities in a street or for connecting lots to
existing utilities if the lot is on a City accepted street, but if the street is not yet City-
accepted, the permit is not required, as it is not yet City property.

For development of infill lots, the sketch plan on the Excavation Permit application for
installation or connection of utilities should also indicate the driveway location and size.
The $290 Excavation Permit would likely be adequate to include the okay for driveway
location in that situation.

way in the city without first having secured a permit to do so….
