The Board also seemed to concur with the MVMA that the
lower license fee ($5,260) would be more appropriate for
veterinary drug only manufacturers. The Board indicated
that they will be putting together a guidance document in the
next few weeks that provides further clarification on these new
laws and provisions. In addition, Dr. Cody Wiberg (Board of
Pharmacy Executive Director) has agreed to participate in two
MVMA lunch webinars on this topic to help veterinarians better
understand these new pharmacy law changes. The MVMA sent
out a notice to members with the dates and times for these
sessions.

During the last legislative session, several laws passed that Executive Director

information. Both bats tested positive for rabies! The Minnesota Department of Health (MDH) issued a
press release that afternoon in hopes of identifying the woman and finding out if there were any human or
animal exposures to the bats. At 8 am the next morning, Century Animal Clinic in Maplewood, Minnesota
called the MDH rabies line with information that it could be one of their clients. The client had called the
clinic the previous day with questions about risk to her cats from playing with two bats on her neighbor’s
driveway. And, yes it was the person! Luckily, there were no human exposures, and her cats were
currently vaccinated. The cats were given a rabies booster as required by law.

Capitol Report

The 2019 Minnesota legislative session was very active this year with
several bills enacted into law while other legislative proposals were held
over for next year. The MVMA lobbying team of Cory Bennett and Cullen
Sheehan provided the following summary of legislation they were tracking
this year.

Chronic Wasting Disease (Special Session SF7)
Three weeks of negotiating while the conference committee awaited budget targets resulted in a
number of policy provisions being adopted. Chief, and perhaps most intensely negotiated, were
provisions relating to the state response to chronic wasting disease, the fatal neurological disease
that has spread into Minnesota white-tail deer herds.
The compromise resulted in the following:
· $320,000 over two years to Board of Animal Health for CWD related activities
· $230,000 to Board of Animal Health from fees collected from cervid farms
· New farms are required to fence their perimeters with high-tensile fencing at least 96 inches high,

effective upon passage;
· Install redundant gate access by Dec. 1, 2019;
· Tag white-tail deer before Oct. 31 of the year they are born, and elk and other cervids by Dec. 31 of

the year they were born;
· Require annual physical inspections of farms, including an inspection of all perimeter fencing and

verification of tagging of all animals;
· Set inspection fees based on livestock use and composition;
· Deny future registration to permit holders whose registration has been revoked without a Board of

Animal Health determination that future escapes are unlikely;
· Require all dead farmed cervids over 1 year old be tested for chronic wasting disease; and
· Require all farms testing positive for chronic wasting disease to depopulate the farm after an

appraisal for federal indemnification, or in a reasonable time determined by the Board of Animal
Health and Department of Natural Resources, and to maintain fencing with biohazard signs for five
years thereafter.
The bulk of the additional funding included in the agreement will fund the board and department’s
efforts relating to chronic wasting disease. The agreement would also increase the Aquatic Invasive
Species surcharge to help fund ongoing control efforts and studies.

Large Animal Vet Loan Forgiveness Program (SF2515)
Permanent funding of $375,000 annually was authorized in 2016, the 2019 legislature reauthorized
the funding the regular legislative session Each year up to five veterinarians are selected to receive
funds. Applications routinely exceed the amount of available funding.
The Minnesota Rural Veterinarian Loan Repayment Program provides up to $15,000 per year for
five years for University of Minnesota veterinary medicine graduates who serve five years as a
veterinarian in a designated rural area and are involved at least 50 percent of the time with the care
of food animals.

Veterinarian Immunity (SF1167/HF787)
This bill would provide civil and criminal penalty immunity to a licensed veterinarian who (1)
reports suspected animal cruelty, or (2) determines that an animal is suffering, unable to be cured
through reasonable care and treatment, and may be immediately put down when the animal was
seized by law enforcement, animal control, or a humane agent because the animal was at risk of
death due to exposure or the lack of suitable food or water.

Great Bodily Harm to Companion Animals (SF932/HF1053)
The bill would provide criminal penalties for certain acts resulting in death or great bodily harm
to a pet or companion animal. A person who intentionally hurts a companion animal that results
in death or great bodily harm to a pet or companion animal, and the act causes extreme pain
or prolonged suffering, may be sentenced to imprisonment for not more than eight years or to
payment of a fine of not more than $10,000, or both.

Minnesota Companion Animal Board (SF1860/HF2024)
The bill would establish the Minnesota Companion Animal Board, provide duties, responsibilities

Board of Animal Health membership increased (HF2794/SF2783)
The bill would increase the Board of Animal Health to 11 members appointed by the governor.

member who produces dairy in Minnesota;
(4) one member who produces poultry in
Minnesota; (5) one member who produces
deer or elk in Minnesota; (6) one member
who is a practicing large-animal veterinarian
licensed in Minnesota; (7) one member who
is a practicing swine veterinarian licensed in
Minnesota; (8) one member who is a practicing
poultry veterinarian licensed in Minnesota; (9)
one member who is an agricultural instructor
from a state college or university in Minnesota;
(10) the chair of the house of representatives
committee with jurisdiction over agricultural
policy or a designee; (11) the chair of the
senate committee with jurisdiction over
agricultural policy or a designee.

Opioid Bill (HF 400) 
The opioid bill did finally pass after three
years of legislative wrangling. It raises money
from the pharmaceutical companies and
wholesalers by drastically raising registration
rates and fees. We were successful in removing

language that would have forced veterinarians to participate in the human prescription monitoring
program. The bill does include language stipulating that a veterinarian must check a photo ID for
anyone purchasing a scheduled II-V drug. The person purchasing does not need to be the patient
and you do not have to check the ID if the person is known to you. See more about this new law
elsewhere in this newsletter edition.
Vet PMP (HF 1731)
Rep. Kurt Daudt and Sen. Matt Klein introduced the Vet PMP bill this year. There was one hearing
in House Judiciary. Several questions were asked regarding the need, the process for setting this
up and the cost to consumers. Chair Rep. Lesch deleted veterinary immunity language from the bill.
The MVMA is re-evaluating this bill for the 2020 session. 
Fee Splitting and Drug Compounding (SF 12)
The Board of Pharmacy, following negotiations with the MVMA, successfully achieved agreed upon
language included in the passed Health and Human Services omnibus bill at the end of session.
Fee Splitting:
(iii) any arrangement through which a pharmacy, in which the prescribing practitioner 
does not have a significant ownership interest, fills a prescription drug order and the 
prescribing practitioner is involved in any manner, directly or indirectly, in setting the price 
for the filled prescription that is charged to the patient, the patient’s insurer or pharmacy 
benefit manager, or other person paying for the prescription or, in the case of veterinary 
patients, the price for the filled prescription that is charged to the client or other person 
paying for the prescription, except that a veterinarian and a pharmacy may enter into such 
an arrangement provided that the client or other person paying for the prescription is notified, 
in writing and with each prescription dispensed, about the arrangement, unless such 
arrangement involves pharmacy services provided for livestock, poultry, and agricultural 
production systems, in which case client notification would not be required;
Emergency Drug Compounding:
Subd. 4. Emergency veterinary compounding. A pharmacist working within a pharmacy licensed by
the board in the veterinary pharmacy license category may compound and provide a drug product
to a veterinarian without first receiving a patient-specific prescription only when:  
(1) the compounded drug product is needed to treat animals in urgent or emergency situations,
meaning where the health of an animal is threatened, or where suffering or death of an animal is
likely to result from failure to immediately treat; 
(2) timely access to a compounding pharmacy is not available, as determined by the prescribing
veterinarian; 
(3) there is no commercially manufactured drug, approved by the United States Food and Drug
Administration, that is suitable for treating the animal, or there is a documented shortage of such
drug; 
(4) the compounded drug is to be administered by a veterinarian or a bona fide employee of the
veterinarian, or dispensed to a client of a veterinarian in an amount not to exceed what is necessary
to treat an animal for a period of ten days; 
(5) the pharmacy has selected the sterile or nonsterile compounding license category, in addition to
the veterinary pharmacy licensing category; and 
(6) the pharmacy is appropriately registered by the United States Drug Enforcement Administration
when providing compounded products that contain controlled substances.
The MVMA was generally pleased with the outcome of the legislative session but knows there is
more work ahead in seeking further clarification from the Board of Pharmacy on laws passed
as well as visit with legislators concerning bills that did not get approved in 2019 such as the
veterinary immunity bill. We encourage MVMA members to support the VET-PAC program when
they pay their membership dues, and we also urge members to consider a legislative clinic visit that
can be arranged by the MVMA in having your legislator visit your clinic or place of business.

Marissa Milstein, ‘18 DVM, PhD candidate, was walking her dog this winter near Lake Elmo
when she heard the distressed cries of what she suspected were two German shepherd dogs
she had encountered earlier on the trail. Milstein crashed through the woods to find the dogs
had fallen through thin ice on the lake. After a quick 911 call, Milstein and a Washington
County Sheriff’s officer plus others pulled the dogs to shore. Both were suffering from
hypothermia but recovered quickly thanks to Milstein’s quick action. In April, she received a
Letter of Appreciation from the sheriff’s office.
Long-time veterinary library staffer retires
After nearly 45 years serving veterinary students, Lisa Berg retired from the University of
Minnesota Libraries. Over the years her duties in the Veterinary Library included reference
services, worldwide gift exchange, student supervision, course reserves, government
documents, and binding. She was awarded the Minnesota Veterinary Medical Association’s
President’s award in 2009, and in 2014 the University of Minnesota President’s Award for
Outstanding Service.
Dairy Education Center re-named for John Fetrow
Professor emeritus John Fetrow, DVM, PhD, was the driving force behind creation of the
Dairy Education Center at Davis Family Dairies near Nicollet, Minn. Therefore, it is only
fitting that the facility be re-named the John Fetrow Dairy Education Center. In 2013
the United States Department of Agriculture designated the facility a National Center of
Excellence in Dairy Veterinary Medicine Education—the first of its kind in the country.

Ben and Vera (Olson) Hass. His mother was a school teacher and his father was a farmer. Dr.
Hass graduated from Blackduck High School in 1955. He married Carol Quam on September
17, 1960 in Albert Lea, MN. He graduated from the University of Minnesota School of
Veterinary Medicine in 1961. He practiced Veterinary Medicine for 41 years in Milaca, MN
where he founded the Mille Lacs Veterinary Clinic with Dr. Dick Richards. He loved working
with farmers and horses were his favorite animals. Dr. Hass was an active member of Trinity
Lutheran Church in Milaca and Bethesda Lutheran Church in Malmo. He loved sports and
was active in football, baseball and basketball, with basketball being his favorite. He also
loved hunting, fishing, golfing and most of all, spending time with his family.

MVMA lifetime member, Donald W. Johnson, DVM, PhD. age 89, of Green Valley, AZ, passed
away on April 4, 2019. He married Rose Marian Nolte in 1950, earned his DVM in 1953 from
the U of M, and served for two years in the USAF in Germany during the Korean Conflict
until 1955. He then returned to the U of MN Veterinary College and trained senior veterinary
students in a large animal practice based in Maple Plain, MN, while completing his own PhD
in immunology and microbiology (1963), remaining active in his church, and adopting his
two children, Scott and Heather. In 1967, he moved to the University of Missouri Veterinary
School and returned to the U of M in 1969 as a full professor. In 1981, he became the team
leader for the MN Project, a USAID program in Rabat Morocco, which supported L’Institut
Agronomique et Vétérinaire Hassan-II. The project helped over 50 students receive advanced
training in the U.S. and graduate degrees from IAV. A two year contract became a 23 year
adventure, extending after his retirement from the U of M, including the creation of a startup
chicken vaccine business. While in Morocco, he helped reestablish the Village of Hope
orphanage in Ain Leuh. He returned to Minnesota in 2004, at first snow-birding to Arizona,
before settling there year-round as dementia slowly extended its grasp before finally taking
him away. He is survived by his wife, his two children and many grandchildren. A memorial
service was be held at the Church of the Redeemer in Arden Hills on June 8, 2019. Memorial
donations may be sent to Compassion Corps, PO Box 103, Chester Heights PA 19017; and
please include a note specifying Village of Hope.

high-tech exhibits, famous wildlife dioramas, outdoor

their guests met on June 13 to enjoy a tour, planetarium
feature and lunch at the museum. It’s fun to see this great
group get together and all new faces are welcomed!

We can’t thank Dr. Dick Olson enough for planning these
great outings that get our senior veterinarians together to
catch up, continue to learn and give us something to look
forward to.

The Latest MOVE Event

On Thursday, June 20, the MOVE
(Minnesota Opportunities for Veterinarian
Engagement) team held its third event
this year. The event was held at Can Can
Wonderland in St. Paul. Member and
Nonmember DVMs along with students were
encouraged to attend with their families.
MOVE provided food, refreshments, arcade
game cards, and rounds of mini golf.
The event had a great turn out and was able to facilitate
conversations around liability and disability. Thanks
to our event sponsors, North Star Resource Group,
Boehringer Ingelheim, AVMA PLIT, VHA, and Worker B.,
attendees were able to learn more about this topic in one
of the most entertaining places in the Twin Cities.
MOVE’s next event will be in conjunction with the WeGive
CE Committee. They are putting on a Women’s Veterinary
Medicine Leadership Conference on October 11th. The
conference will feature a combination of strong women leaders
as speakers with a panel and small group discussions.
MOVE’s last and final event of the year will be with MVMA’s
POTL (Power of Ten Leadership group). The event will be held in
December, more details to come.

Harmful Algal Bloom (HAB) Season is Upon Us Again

Whether it’s taking a dip in the local pond to cool
off in the heat of summer or going to the cabin to
relax around the lake, Minnesota is known for its
recreational waters. As the weather starts to warm
and we begin enjoying the water, the Minnesota
Department of Health (MDH) advises veterinarians
to be on the lookout for possible illnesses and
deaths related to harmful algal bloom (blue-green
algae) exposure.

The MDH explains that the symptoms animals
experience from illness due to algal blooms varies
depending the type of toxin present in the water
and the means by which the animal was exposed to
the toxin. Exposure could be through several ways
including ingestion, inhalation, and direct skin contact. Common symptoms to be on the lookout for
include vomiting, diarrhea, rash, breathing difficulties, weakness, liver failure, and seizures. Death
is also possible. Symptom severity can be dependent on the number of algal cells in contact with,
and the size and sensitivity of the animal.

HABs are often described as looking like pea soup or spilled green paint but can take on a variety
of colors and forms. While not all blooms are harmful, cyanobacteria can produce toxins like
microcystins and anatoxins that can affect animals and humans. People and animals should avoid
contact with water with a blue-green algal bloom and any algal debris that may wash up on shore,
as there is no way to tell if an algal bloom is harmful or not. The MDH advises to always remember,
“When in doubt, stay out!” To reduce the risk of HAB exposure, advise clients to not let animals
drink or swim in water that is discolored or where
there is scum or foam. Do not let pets lick the
algae off themselves. And lastly, if they think
their animal has been in water with a HAB,
immediately rinse them off with clean water.

MVMA Volunteers NEEDED!!

Thursday, August 22 - Monday, September 2, 2019 (Labor Day)

The MVMA will once again be involved at the Minnesota State Fair!
The MVMA Surgery Suite is going into its 28th year of doing surgery at the Fair. Surgeries are performed at
10:00 am, 12:00 noon, 2:00 pm, and 4:00 pm. This is a great chance to give back to your profession by giving
the public an up-close view at the work you do, while educating them about the importance of spaying and

neutering their pets. Veterinarian volunteers are needed as surgeons and moderators.
DVM students needed as assistants and student moderators.

The Miracle of Birth Center is celebrating its 19th year and is staffed by volunteer veterinarians from the
Minnesota Veterinary Medical Association, veterinary students from the Veterinary Teaching Hospital at
the University of Minnesota, and members of the National FFA organization. This display, the most popular
attraction at the fair, educates the public on the vital role that animal agriculture and veterinary medicine
plays in the state of Minnesota. With live births and newborn farm animals, including cows, pigs, chicks,
sheep and ducks, the display highlights the importance of animals to our economy, health, and quality of life.

Volunteers are needed to answer questions and you do not need to be a large animal practitioner.
Small Animal practitioners are needed! Many of your clients visit this exhibit, and they would be
excited to see “their” veterinarian at work. This is also an excellent opportunity for large animal
veterinarians to interact with students and the public, and recruit them into the large animal field.

Each year our volunteers remark that this is an experience they will never forget!
