Gary observed a moment of silence for a member recently deceased - Arnold ‘Arnie’ Norman
Miller.

State Bar of Texas, Buck Files, President-Elect
Gave update on what the Bar is doing which includes: reporting pro-bono hours, ethics hotline,
looking at expanding TLAP, Veterans Program in Tyler, providing public schools with videos on
22 supreme court cases, making available $50,000 in scholarships for CLE, the Bar needs
authors for Journal articles.

Opinion 611, Robert Pelton
Mr. Pelton, Ethics Committee Chairperson, explained the issue of fee disputes in Opinion 611.

Executive Director Report, Joseph Martinez

Joseph thanks TCDLA staff individually for their hard work and dedication. Jamie Pulaski-
Williams celebrates her second year with TCDLA.
• Membership
Current dues paying membership is at 3,193.
• Complimentary Memberships
Board members have three complimentary memberships to distribute and only half of those
were given out last year.
• Six New T-Shirts Will be Available Soon
• Membership Directory
At March’s meeting discussion will take place regarding next year’s directory format.
• TCDLA Logo
Committee will determine if logo is trademarked and will make recommendations regarding
its use.

Publications and Capital Assistance Report, Rick Wardroup
Approximately half of the publications are at the editors. The Basics of Immigration book is
new and will be a great help. In October 2012, TCDLA will be providing a capital litigation
seminar with funds from the Court of Criminal Appeals and the Federal Department of Justice.

Criminal Defense Lawyers Project, John Ackerman
In the fall quarter, CDLP trained 920 criminal defense attorneys in eight seminars. The Court of
Criminal Appeals has decreased grant funding which will result in cost-cutting measures directly
affecting seminars. John will host a four day Psychodrama Program in Roundtop at the Festival
Institute on January 11-15, 2012. Fifty spots are available. Tuition is $750 per person. Public
Defenders will have travel stipends available.

Budget and Finance Committee, Sam Bassett
TCDLA’s budget is in good shape due in part to recouping part of the rental costs.

MOTION: Cancelling Bank Account and Transferring Funds
TCDLEI bank account had the wrong Tax ID. Motion made by Gary Trichter, seconded by
Adam Kobs. Motion carries.

MOTION: Add Two Signatories to Bank Accounts
Bennie Ray and Marjorie Bachman will assist Sam in signing checks and verifying bank
statements. Motion made by Gary Trichter, seconded by Emmett Harris. Motion carries.

Voice for the Defense, Greg Westfall
Since February 10th and the end of November the Voice for the Defense On-Line has had 434,733
hits. TCDLA’s entire archive is available on-line. Greg would like more members to participate
in the blog. It would help to make TCDLA look good as an organization and attract attention.
Blog on Opinion 611!

Technology Committee, Grant Scheiner
What the committee is working on:

1) Improving the TCDLA smart phone app that currently exists
2) Working on an organizational app

Rusty Duncan 2012, Doug Murphy
Next year’s Rusty is June 7-9, 2012 and is on pace. George Foreman will be speaking on “The
Will to Fight for Others.” We will be focusing on ethics this year – including Rule 611. There is
going to be a fun run and a bike ride. Different this year, there will be two tracks going on at the
same time which will provide more choices. Also, TCDLA would like to develop more
mentoring opportunities for lawyers with five years or less of experience. Board members and
past presidents will be asked to sponsor a new attorney for lunch on Thursday. The attendance
goal this year is to top 1,000 people.

Members Trip - Napa Valley, Stanley Schneider
The trip is scheduled for February 15-19, 2012 at the Meritage Resort. There will be two hours
of CLE each morning. David Moore, Scrappy Holmes, David Guinn, David Botsford, Gary
Trichter and Stan will be speaking. The cost is $1250 per person.

Texas Forensics Science Commission, Bobby Lerma
January 13, 2012 will be the first meeting.

Strike Force Committee, Cynthia Hujar Orr and Robert Fickman
• Congratulations to the Texas Forensics Science Commission. They issued the Willingham

report confirming that junk science led to the conviction and execution of Todd Willingham.
• The Strike Force is still litigating the case regarding the prosecutors who issued a search

warrant for the attorney’s work product during a trial. They are now in a hearing to
determine whether a court of inquiry should be had or a mistrial with prejudice should be
granted. Countless TCDLA members have been participating.
• The Strike Force was called to help a young member in Beaumont who was in trouble by
angering the local prosecutors. Robert Fickman and JoAnne Musick wrote a brief on behalf
of the lawyer and went to Beaumont and were able to get the case dismissed.

Local Bar Affiliates, Bobby Mims
They are currently working with four counties: Nueces, Hidalgo, Bowie and Webb.

Bylaws Committee, Adam Kobs
They are putting together language for publication in the Voice and for June’s meeting that
would address any member, i.e. a student member, being able to be on the Board of Directors.

DWI Committee, Lawrence Boyd
There will be a DWI seminar in Arlington on May 3-4, 2012.

Financial Development, Bill Harris
Pat Ryan will be meeting with the staff and members of the Executive Committee. He will
provide his report prior to the February board meeting—the goal being to become more
financially independent through fundraising.

Federal Law, John Convery
The Federal Criminal Law Seminar will be in New Orleans on March 8-9, 2012. Course
Directors are John Convery and Henry Bemporad.

MOTION: Three Resolutions, Bobby Mims
Bobby is asking the board to approve three resolutions honoring: Dr. David Michael Wood, Thad
W. Davidson and James West Bogerdein for putting their careers and their own money on the
line to free their clients from unjust sentences. Motion made by Sharon Curtis, seconded by
Lawrence Boyd. Motion carries.

MOTION: To Make Justice Shirley Butts an Honorary Member of TCDLA
Motion made by Gary Trichter, seconded by Lydia Clay-Jackson. Motion carries.

• Charlie Butts asks the board to consider his wife, Shirley, as an honorary member of

TCDLA.

Amicus Committee

In my time as Chair of the Amicus Committee, we have worked hard to ensure that TCDLA's views are
heard in those cases and in those tribunals where the committee believes it will do the most good.

We have authorized the filing of amicus briefs in the U.S. Supreme Court in cases involving Brady
violations and due process violations where an expert's testimony essential to the conviction has been
repudiated.

But of equal importance is being able to decline to file amicus briefs, as we have had to do in multiple
cases of late, where there is no compelling legal issue that warrants our intervention.

Significant Developments

On February 9, the Texas Board of Pardons and Parole held their quarterly open meeting
in Huntsville, Texas. The meeting was followed by an afternoon open meeting workshop
attended by all Board members. The workshop continued on Friday morning. The two most
important items included approval of new parole guidelines for computing parole scores,
and the decision to implement deadlines for the submission of written materials to the
Board on behalf of individuals being reviewed for parole.

In their meeting, the parole Board discussed the Report and Modification/Update to Risk
Instrument and Instructions. The Risk Instrument is used to calculate the Parole Score for
inmates being considered for parole. The modification/update was approved. The Board
announced that Institutional Parole Officers (IPOs) will begin implementing the new
Guidelines in April of this year. I attached a copy of the approved new Risk Instrument and
Instructions to an email sent to the TCDLA list-serve.

The changes will result in many more inmates scoring as “low risk” and fewer as “high”
and “highest” risk (There will also no longer be a “highest risk” level for women.) Discussion
included a prediction that current parole approval rates of about 33% may rise to near 40% as a
result of the changes. The changes recognize different risk scoring for males than for females in
the age risk factor. This will result in generally lower risk scores for women, consistent with the
lower recidivism rate for women. Other changes included scoring in the risk factors for “all
property offenses” (2 points), the awarding of 2 points for inmates who belong to a “monitored
clique” and not just a recognized security threat group, scoring for current custody level, and an
overall adjustment in the points associated with each risk level. A list of the security threat
groups and monitored cliques is included in the “Instructions for Completing TBPP Risk
Assessment”. Those instructions were also disseminated on the TCDLA list-serve.

The Board approved some new offense severity rankings also used in computing the
parole guideline score for an inmate. A link to the complete copy of offense severity rankings
can be found on the Board’s web page.

The Board also voted to adopt a new Hearing Officer Training Manual. I have requested
a copy under Open Records and will send it out on the list-serve when received.

Finally, the Board approved a number of proposed amendments to provisions of the
Texas Administrative Code. Most dealt with pardons and restoration of rights for those who
successfully completed a deferred adjudication, and were necessitated by recent legislation
authorizing the governor to grant pardons for those individuals.

After the meeting, the Board participated in a workshop. The primary topic of concern
had to do with Board policies contained in 37 T.A.C. 141.60, Submission and Presentation of
Information, and 37 T.A.C. 141.61, Representation of an Offender. § 141.60 states:

….
(c) In the event that an offender's case is in the review period, copies of all information and
arguments in support of an offender's release may be submitted to members of the parole panel
designated to consider the case. For this purpose, review period shall mean a period greater than
two months but less than six months prior to the month of the next scheduled review.
(d) For the purpose of Discretionary Mandatory Review, the review period shall mean a period
greater than thirty days but less than seventy-five days prior to the projected release date.

§ 141.61 states that “requests for appearances by persons representing offenders shall be
only when the offender's case is under review, during the review period.”

To date, these provisions have not been enforced by the Board for various reasons. The
Board plans to enforce the requirement that for offenders in the parole review process,
materials would have to be submitted to the Board at least two months prior to the month
of their next scheduled review. (For offenders being considered for Discretionary Mandatory
Review the period to submit materials and to request attorney interviews is at least 30 days prior
to the mandatory supervision eligibility date, but not more than 75 days prior to that eligibility
date. While the Board did not discuss strictly enforcing that rule, I believe that is already being
done but, if not, that can be expected when the deadlines for parole submissions become
mandatory.)

Based upon discussions at the Board’s Workshop, they were planning to announce
soon that they would be enforcing the submission deadlines, but indicated they do not
presently plan to begin enforcing the deadlines until six months or more after the
announcement is made. The submission deadlines will not be applied to cases where an inmate
arrives at TDCJ after they are already past their parole eligibility date. Those inmates not past
their parole eligibility date, but within their review date when they enter TDCJ, will be allowed
to submit materials and request attorney interviews, but details about submission deadlines for
those cases were not discussed at the workshop.

The Board Administrator will advise me when the Board decides on a date for
implementation, and I will send out another email on the list-serve at that time. The Board
expects to announce an implementation date by the end of March.

DWI Committee

In meeting the goals of our Mission Statement, the DWI Committee has accomplished the following:

1) The legislature is not in session, so new DWI legislation has not been an issue. I have personally
reviewed every Texas Register through yesterday and no new ALR rules have been proposed;

2) I have monitored all appellate decisions up to the 1/2/12 version of Casemaker Digest. I have printed
several decisions that merit inclusion in my paper for the 5/3-4/12 seminar but none are highly-
significant to DWI practice. The most noteworthy recent case appears to be U.S. v. Jones, which is
getting widespread discussion on the TCDLA list-serve already. I have received the Reader's Digest
version and I intend to read the actual opinion tomorrow. It seems to indicate that the 4th Amendment
is still alive and well. We tried to come up w/some kind of connection to DWI & we thought of the
apparent widespread problem that officers appear to be reading text messages, etc., on client's cell
phones following a stop. That was the only immediate connection that we could come up with at lunch;

3) You already have our list of speakers and topics for our 5/3-4/12 DWI seminar, which draws broadly
on talent throughout the State. Many of our topics are both exciting and up-to-the-minute timely,
particularly the topics covered by Ray McMains, Deandra Grant, and Robert Pelton. Definitely not the
same old stuff.

PREAMBLE

This Long Range Plan is the institutional guide for TCDLA during the next five years.
The goals of the Long Range Plan are intended to fulfill the purpose of TCDLA which is to
protect and ensure by rule of law those individual rights guaranteed by the Texas and Federal
Constitutions in criminal cases; to resist the constant efforts which are now being made to curtail
such rights; to encourage cooperation between lawyers engaged in the furtherance of such
objectives through educational programs and other assistance; and through such cooperation,
education and assistance to promote justice and the common good.

COMMITTEE FINDINGS AND RECOMMENDATIONS

The Committee has identified the following areas of particularized long range concern for
TCDLA. The Committee believes these areas should be thoroughly discussed and addressed by
the Board. Where appropriate, the Committee has recommended specific actions to implement
the stated goals.

Goal – Work to increase diversity among the membership of TCDLA
including both speakers and organizational leadership.

TCDLA recognizes the importance of the participation and involvement of women and
minorities in all aspects of the organization such as, but not limited to, seminar speakers, course
directors, committee chairs, and top leadership positions in TCDLA. The association will make
a concerted effort to encourage the participation of women and minorities for these positions and
to encourage women and minorities to join and participate in TCDLA. Some members have
expressed concerns about diversity issues within the TCDLA leadership and an objective
analysis of such issues should be considered in the short term along with coordinating such
efforts with the existing committees within TCDLA to implement any necessary changes.

Goal – Strive to increase TCDLA’s presence on law school
campuses across the State.

The majority of future TCDLA members will attend and graduate from a Texas law
school. As the statewide organization for criminal defense lawyers in the State of Texas,
TCDLA must continue to encourage law student interest in the study of criminal law. TCDLA
needs to create and support law school trial advocacy programs, internships, and other criminal

law courses and programs that prepare law students to become professional criminal defense
lawyers. The TCDLA organization involvement with law schools and law students is sporadic,
well meaning but not at all well organized. TCDLA should consider and create an institutional
framework and create and designate specific programs for law student participation in the
TCDLA. Will a TCDLA Law Student Division, Section or Committee work best for TCDLA?
Should a law student be a regular or ex officio member of the TCDLA Board of Directors? If so,
should the law student member be elected by other TCDLA law student members? Or, should
selection of a law student Board Member position rotate yearly between the Texas law schools,
with the President or Chair of the law school criminal law organization affiliated with TCDLA
filling the position for a year? Should TCDLA encourage existing law school criminal law
associations to affiliate with TCDLA to create a law student division or section? Would this be
best accomplished with TCDLA and the local affiliate closest to the law school? TCDLA should
create a committee, and consider whether the committee should become a standing committee to
address the framework for future law student participation in TCDLA. The committee should
investigate and report on current and future law student programs for law student participation in
the TCDLA, including trial advocacy programs and TCDLA sponsored internships.

Goal - Keep TCDLA at the forefront of breakthroughs in technology
to provide the most current advance to our membership.

TCDLA has a Technology Committee which is currently involved in the following six
projects:

1. Organizational App – TCDLA plans to build an organizational app for smartphones and
other mobile devices. The app will be distinguishable from the TCDLA Legal App, which
contains federal and state criminal codes, rules and statutes. The organizational app may include
an online directory of TCDLA members, a system for registering for CLE, a method for
purchasing publications and merchandise, a system for renewing TCDLA membership, plus an
Amazontype “suggestions” feature for suggesting additional CLE and purchases to TCDLA
members. The Technology Committee estimates that TCDLA has budgeted up to $15,000 for an
organizational app. (It may be possible to use CDLP grant money to off-set as much as 40% -
67% of the cost of the organizational app.). Additional maintenance fees would be expected in
the years ahead. The Technology Committee is in the process of securing bids for developing
the organizational app, will study the bids, and report back to TCDLA leadership. The
Technology Committee hopes to have the construction well underway, if not completed, by June
2012.

2. Online CLE – TCDLA is exploring offering “Online CLE.” Many organizations,
including TCDLA’s competitors for CLE, offer online “streaming” of live or archived lectures.
The streaming may include audio or video with audio. The Technology Committee estimates
that TCDLA has budgeted approximately $1,000 for implementing a system. Additional funding
from CDLP may be possible. TCDLA is considering two basic options. The first option is to
develop our own system, which would allow TCDLA members to register online and pay
through a service such as PayPal. Upon payment, members would be emailed “viewing links” to
allow immediate access to CLE. A second option would be to contract out the entire process.

Some services may be available, which would handle payment collection and online storage of
audio and video lectures. The service would presumably take a portion of the proceeds of each
CLE sale. All TCDLA would need to do is digitally recorded CLE lectures to the service. The
Technology Committee will meet with counterparts at the State Bar of Texas and ask which
system(s) the State Bar uses. TCDLA’s goal is to have a system in place by spring 2012.

3. E-Books for Publications – TCDLA is exploring offering select publications in “e-book”
1 format, for use on reader devices and tablet devices, such as Kindle, Nook and iPad. TCDLA
does not currently have a budget for this project. However, it is clear to the Technology
Committee that it is only a matter of time before the majority of TCDLA’s publications will be
offered in e-book or similar format. In fact, TCDLA may one day dispense with most or all of
its paper publications. In wading into this project, TCDLA could begin by offering three to five
of its best-selling publications on Amazon. The Technology Committee believes that Amazon
may charge as little as $39.99 per month, per publication. (Amazon also takes approximately
15% of the proceeds for each sale.). Supplying digital material to Amazon would not likely be a
problem, because TCDLA already offers many publications in .pdf format on cd-rom. (Although
our cd-roms contain digital material in suitable formats, cd-roms cannot be played on Kindles,
Nooks, iPads or any of the most popular mobile devices.). TCDLA does not have a target date
for completion of this project.

4. Video Conferencing – TCDLA is exploring video conferencing for TCDLA meetings.
This project has great potential for improving the quality of communication among and between
TCDLA staff, officers, board members and general members. It also has the potential to save the
organization significant money in travel costs. The Technology Committee estimates that $2,400
could be budgeted for a video conferencing project during 2011-12. However, at this point,
TCDLA is facing several hurdles to implementing a system. The first hurdle is deciding which
type of video conferencing method to use, as well as when and how to use it. Video
conferencing can either be “one way” or “two way.” One way video conferencing is a fairly
straightforward system in which a meeting location has a video camera and a microphone. The
speaker stands in front of the camera and talks into the microphone. A digital signal is uploaded
to the internet. Viewers can tune in from their desktop computers and (in the not-too-distant
future) their mobile devices. Remote viewers who do not attend meetings can only participate
via telephone. Two-way video requires a video camera and microphone at the meeting location,
as well as the locations for every remote viewer. Usually, two-way video participants in remote
locations have small video cameras and microphones mounted to their desktop computers. The
quality of the video can vary, depending on the sophistication of the system and the speed of the
internet connection. Although live, two-way video is a superior method for communication
among participants, very few (if any) systems allow more than several users in several different
locations at a time. Such limited systems would be impractical for large TCDLA committee
meetings or board meetings. Additionally, it could prove initially difficult to teach the
participants how to install and use their systems. Because the price for video conferencing
systems is supposed to drop over time, while the quality and ease-of-use are supposed to
increase, the Technology Committee recommends that it continue to study this issue as a long-
term project with no current target date for completion. The Technology Committee believes a
patient approach may yield the best result for this important project in the long run.

5. Imus – The Technology Committee has overseen updates to the “Imus” software tasking
system for TCDLA. The Imus system performs many automated tasks, such as sending TCDLA
membership renewal notices and discount coupons on members’ birthdays. According to the
Technology Committee, TCDLA purchased the software, with a 67% off-set of the purchase
price by CDLP. This project is essentially completed.

6. Facebook & Twitter – TCDLA is considering recruiting volunteers to send “gossipy” and
fun information and material to our members via Facebook and Twitter social networking.
TCDLA needs people who are somewhat computer literate and who have discretion and
common sense when it comes to knowing what to post and what not to post. The Technology
Committee believes that social networking will become a vital tool in attracting and retaining
younger lawyers to TCDLA.

Goal - Develop alternative methods of fundraising to help insure
the long term financial stability of the organization.

Numerous opportunities exist to raise funds in a strategic fashion for TCDLEI or any
other entity that may come into existence to handle the strategic funding of TCDLA. Most of
these are tried and true fundraising methods that foundations, large and small, use to raise funds.
TCDLA would require the employment of a full time person for successful strategic fundraising.
The following comprise areas of strategic fundraising which could be pursued by TCDLA.

Planned Giving could be used for strategic fundraising. Planned giving includes several
avenues for a benefactor to leave a legacy. The downside with this approach is that it will
require a dedicated fundraiser to make the initial contacts with the benefactors and see that the
gift comes to fruition. The upside is that a good fundraiser, within a couple of years, will more
than pay for itself. First and perhaps easiest are stocks and bonds that someone has purchased in
the past and do not plan on using for retirement. This usually will include smaller amounts of
stock that may have been purchased over the years that the person may have even forgotten they
had purchased. The stocks or bonds are simply turned over to TCDLA and sold, placing the
funds in the foundation. The idea is not to play the stock market, but to liquidate immediately
and realize the benefits for the entity. In the same vein, old parcels of real estate can be donated
and liquidated for the proceeds. Again, someone has to be in charge of acquiring these
properties and liquidating them as well. Although they may not be worth a great deal, the person
may be happy to get rid of them so they can stop paying taxes on them. A common fundraising
plan is to get members to purchase insurance policies naming the entity as the beneficiary. The
gift can be in any increment depending on how much of a gift the donor wants to leave. This,
again, requires a full time fund raiser to coordinate on following through with these donors.
Again, the gift in the will can be cash, stocks, bonds, real property or anything of worth that can
be liquidated.

Grants could be used for strategic fundraising. There are private law firms across the
country (Texas Defender Service is an example) who depend almost entirely on private grants
for their funding. In addition, the Innocence Project receives grants for its operations outside the

state grant it has received in the past. The TCDLA forensics program could be billed as an
innocence-based project and could readily tap into grant funding. It still makes sense to utilize
any outside funding as TCDLA seeks to grow its strategic funds.

Other fundraisers include a golf tournament such as the annual golf tournament at Rusty
Duncan. Sponsors for each hole allow all (or most of the) entry fees to be turned over to the
entity. The fact that it is a fundraiser could increase the attendance to that event. The Pachanga
party could be used as the membership party and the Friday night party could be a black tie affair
again, turning it into a fundraiser. These Galas usually include a silent auction and perhaps a
gambling night in addition to the food, drink and dancing. Sponsors (Lexis, West, etc.) are
usually utilized to offset the costs of the party so all proceeds from sales of tickets can go to the
fund. This would be a good opportunity for “older” lawyers to purchase extra tickets and invite
younger lawyers to introduce them to the “club.” Since this party has a history, the conversion to
it as a fundraiser will be made less difficult.

Nonprofit fund raising professionals are today every bit as much a profession as are
attorneys. They have a professional organization and a code of ethics. TCDLA should employ a
development officer who can widen our financial base.

Goal – Increase dialogue with other sections of the Bar, identify areas
of common interest, and collaborate with those other sections
to promote the interest of TCDLA and its members.

Criminal defense lawyers have often been unaware and/or unwilling to seriously consider
the impact of other practice areas. Other areas of practice are increasingly influencing policy and
practice of criminal defense. From a policy standpoint, the criminalization of conduct that used
to be considered “civil” in nature has increased. As this has occurred, it is critical for a criminal
defense lawyer to be educated and aware of developments in areas of the law that could impact
the representation of those accused, both in the investigative and litigation phases of criminal
defense practice.

The strategic planning committee has identified three areas of practice where TCDLA
should consider collaborative continuing education events. It is important to have increased
communication with leadership for purposes of informing and influencing policy, as well as
keeping lawyers up to date on changes in the law. The committee felt that the areas of Family
Law, Immigration Law and Bankruptcy Law were areas in which TCDLA should specifically
target for collaboration over the next five years. The following is an example of why an area
such as Family Law should be the subject of collaboration.

Family Law and Criminal Law are areas where coordination between TCDLA and the
leaders of the Family Law Bar is a necessity. Many attorneys only practice in one of the above
areas and yet are consistently involved in litigation which can impact each area of any given
case. For instance, many family law practitioners are making decisions to conduct hearings on a
protective order application following their clients’ arrest for assault in the context of a pending
or potentially pending divorce case. Another example of this scenario occurs when a child abuse

allegation has been made and there are civil proceedings relating to the termination of the parent
child relationship in which hearings are being held and discovery is being instituted. In these
and other situations, it is critical for the civil/family law attorney handling the matter to be
educated on at least some of the basic principles of criminal defense so that the client may be
properly advised. In many instances, the best advice is to decline to participate in the process
altogether. The strategic planning committee has made initial contact with leaders of the Family
Law Bar and there is definitely an interest in a potential continuing education event taught by
both criminal and family law practitioners. Such an interdisciplinary seminar may open the eyes
from “both sides of the aisle” when it comes to handling cases that have both criminal and family
law aspects. It is hoped that TCDLA will work with the leadership of the Family Law Bar to
institute an initial continuing education event in 2012 or 2013. Another arena for linkage
between criminal and family law is in the area of policy influence. Both areas of practice are
governed largely by “code.” Thus, it is critical that communication and potential collaboration in
the area of lobbying the Legislature be strongly considered.

The practices of many TCDLA members include both criminal and family law. It is
important to remember that TCDLA should assist those members as much as those who have
more specialized practices. Regardless of this factor, even a specialized criminal defense lawyer
who handles cases involving child or spousal abuse allegations should be educated to a certain
extent on the family law perspective of such situations. Further, the impact on policy cannot be
underestimated either. After all, the family law lobby may carry more weight with certain
legislators than TCDLA. Teaming together may help to produce optimal results in any given
situation.

Recent Supreme Court decisions relative to the impact of convictions for certain crimes
on a person’s immigration status in the U.S. have made it imperative for most criminal defense
attorneys to at least have a rudimentary understanding of immigration issues in criminal cases. A
regular effort should be made to keep criminal defense attorneys up to date on developments in
immigration law. These impacts are constantly changing and being revised. It will be a
continuing project and should be a regularly scheduled continuing education component for
TCDLA.

BYLAWS

ARTICLE I - NAME AND STATUS

The name of this organization shall be the Texas Criminal Defense Lawyer Association (“the Association”). It shall be
a nonprofit corporation organized under the laws of the State of Texas.

ARTICLE II - PURPOSES

The purpose of the Association shall be: To protect and ensure by rule of law those individual rights guaranteed by
the Texas and Federal Constitutions in criminal cases; to resist the constant efforts which are being made to curtail
these rights; to encourage cooperation between lawyers engaged in the furtherance of these objectives through
educational programs and other assistance; and through this cooperation, education, and assistance to promote
justice and the common good.

ARTICLE III - MEMBERSHIP

Sec. 1. Regular Membership.
An attorney who is actively engaged in the defense of criminal cases, is eligible for membership in the Association.
Upon ceasing active engagement in criminal defense, the membership is revoked except for those who retire from the
practice of law.

Sec. 2. Charter Membership.
The charter members of the Association shall consist of members who, prior to December 31, 1971, signified their
intention to join the Association as charter members and whose membership applications were subsequently
approved by the Board of Directors.

Sec. 3. Sustaining or Voluntary Sustaining Membership. A regular or charter member is eligible for such
membership by the payment of dues established for such membership.

Sec. 4. Honorary Membership.
A person who has made an outstanding contribution to the welfare and has aided the achievement of the goals of this
Association may be elected an honorary member of the Association. An affirmative vote of a majority of the Board of
Directors is required to elect any honorary members. Honorary membership shall extend for an indefinite period.

Sec. 5. Student Membership.
A person who is enrolled in school of law in this state is eligible for student membership in the Association.

Sec. 6. Affiliate Membership.
A person active in a field which contributes regularly to the defense of criminal cases and the goals of the Association
is eligible for affiliate membership in the Association. Examples include full-time professors of law or criminal justice,
legal assistants and other support staff persons working for regular members, investigators, technical experts, law
librarians, out-of-state lawyers and other persons approved by the Board of Directors.

Sec. 7. Public Defender Membership. A full-time member of a federal, state or local public defender organization
actively engaged in the defense of criminal cases is eligible for public defender membership in the Association.

Sec. 8. Application for Membership.
(a) Each application for membership must be endorsed by one member of the Association.

(b) All applications shall be subject to approval by the president or executive director acting for the Board of Directors.

(c) At the discretion of the Board of Directors, an attorney who does not meet the requisites of Article III, Section 1
may be admitted as a regular member if he or she is otherwise qualified. Any such decision of the Board of Directors
shall be final and not appealable to the general membership.

Sec. 9. Voting. All members except honorary, affiliate and student members are entitled to vote as provided in Article
VI, Section 6.

Sec. 10. Revocation of Membership. May be revoked for cause by vote calling for such revocation by three-
quarters vote of the total members of the Board of Directors after notice and hearing.

Sec. 11. Membership Areas. The following are the membership areas of this association; 1 - West Texas; 2 -
Permian Basin; 3 - Panhandle; 4 - North Texas; 5 - Tarrant County; 6 - Dallas County; 7 - Northeast Texas; 8 - Central
Texas; 9 - Travis County; 10 - Bexar County; 11 - South Central Texas; 12 - South Texas; 13 - Gulf Coast; 14 - Harris
County.

ARTICLE IV – AFFILIATE ASSOCIATION MEMBERSHIP

Sec. 1. Other Associations. The Board of Directors may establish procedures and requirements by which other
voluntary bar associations may affiliate with this the Association.

Sec. 2. Qualifications of Affiliate Associations. To be eligible to become an affiliate association, a voluntary bar
association must:

(a) Be composed of persons of professional competence, integrity, and good moral character, who are actively
engaged in the defense of criminal cases, and who would otherwise qualify for membership in this association.

(b) Have objectives and purposes, as part of its own bylaws or operating rules, which are consistent with the by-laws,
objectives, and purposes of the Association, as determined by the Board of Directors.

(c) Not accept or allow members who are employed by any city, state or federal government or other entity as a
prosecutor of the criminal law, or who work in any other capacity which is in conflict with the objectives and purposes
of the Association. Notwithstanding this provision, affiliate associations may accept or allow members who accept an
appointment as a temporary prosecutor or as a temporary police legal advisor, so long as their acceptance of that
position is not inconsistent with the objectives and purposes of this association as set forth in Article II of these
bylaws. This provision shall not place a more restrictive membership requirement on an affiliate association than the
association places on itself under Article III, Sections 1-7 of these bylaws.

Sec. 3. Application for Affiliation.
(a) Voluntary bar associations may request affiliation with this association by submitting an application, on a form
available from the Texas Criminal Defense Lawyers Association Executive Director.

(b) An application for affiliation shall be referred by the Executive Director to the executive committee, which shall
review it and make a recommendation for approval or denial to the Board of Directors.
