His agency approached the second captive.
The agency represents about 20 carriers,
most of them based in Louisiana. The
captive has grown from a total of 50 carriers
from all states when he joined to about 80.
His rates have declined since joining it.

“It took the agent getting a relationship
with the captive, its principals, and we
basically had to prove ourselves one carrier
at a time,” he said.

Guillot noted that in his captive, the
Louisiana-based carriers’ premiums were
twice as much per unit as members from
other states. In the last renewal in March
2022, Louisiana members’ premiums
remained the same while premiums for
other members increased.

Carriers can take steps to protect
themselves. Satawa said they can leverage
their workers’ compensation insurance,
which can be profitable for insurance
carriers, to obtain better rates for
commercial auto liability. Companies that
successfully keep down their rates should
partner with an insurance provider that
understands what they face and doesn’t
simply treat it as a transaction.

Satawa strongly recommended that
motor carriers install cameras in their trucks,
saying they are “the best attorney you can

hire first and foremost.” Not only can they
protect a trucking company that’s involved
in an accident, but they also can help
monitor driver behavior for areas that need
coaching or perhaps make it clear when
they need to be terminated.

Guillot has cameras in all of his trucks.
“If we get involved in an accident
and we’ve done wrong, and we see it
on camera, let’s rectify the problem,” he
said. “If we get involved in an accident
and we’re doing all the right things
and didn’t do anything wrong, let’s
defend ourselves. And I am not bashful
to defend ourselves.”
In one accident, his driver was holding
steady in the right-hand lane and
completely following the law when a
car approached from the on-ramp on
the passenger side and hit the truck.
Fortunately in this case, the Guillot’s
company had video evidence from the cab
of the truck making their driver’s innocence
clear. Without that evidence, these false
claims would have resulted in an enormous
settlement to be paid out even though in
truth they weren’t at fault, or, if not settled
beforehand, an even larger judgement
resulting from a jury trial.
