Cardiño The Department of the Interior and Local Government (DILG) 5 coordinated the cascading and full implementation of the Strategic Plan 2024-2028 on March 6, 2024, at the Training Hall, DILG Regional Office 5. DILG Assistant Secretary for Plans and Programs Francisco R. Cruz, CESO III leads the regional cascading of the DILG Strategic Plan emphasizing the effectiveness of implementing the programs, projects, and activities for the Bicol LGUs and its community. Quiapon and Intern Sheila Alamo To start the year right, the Department of the Interior and Local Government 5 (DILG 5) launched its Interfacing initiative with DILG Provincial Operations Offices. This initiative marks the beginning of a series of consultations and strategic planning activities under the C4PEACE program (Consultation and Strategic Planning Activities on Communicating for Perpetual End to Extreme violence and forming Alliance towards positive Change and Enriched communities). The primary objective of this endeavor is to foster an environment of open communication and constructive dialogue between the Regional Management Team and the Provincial Offices. Led by Regional Director Atty. Arnaldo E. Escober Jr., CESO V, and Assistant Regional Director Jhoaden G. Lucero, CESO V, the interface includes discussions on program updates, target settings, and workshops aimed at addressing key concerns from the field. The overarching goal is to enhance coordination, streamline processes, and promote transparency within the Department. Ador I n an event that underscored the agency’s commitment to gender equality and recognition of women’s contributions, DILG Region 5, through its GAD Focal Point System, spearheaded monthlong activities in celebration of the National Women’s Month 2024. The National Launching on March 4 was a significant event that propelled the agency towards its goals and recognized the invaluable contributions of women employees. DILG Region 5 remains committed to fostering an environment of empowerment and inclusive diversity, advancing together towards progress and empowerment for all. Support of RGADC’s First Bicol Regional Women’s Day Celebration The inaugural Regional Women’s Day Celebration at the Negosyo Auditorium in Albay Farmers Bounty Village, Camalig, Albay, saw notable figures like PSR Aurora R. Chavez-De Guzman, RGADC Chairperson, and Hon. Edcel Greco Alexandre B. Lagman, Governor of Albay, expressing strong support. Plenary Talks by Ms. Gilda Gayle R. Abonal-Gomez and Atty. Arlene Q. Alangco were highlights, with a supportive message from USEC. Carlos Bernardo O. Abad Santos. DILG Region 5 personnel/representative also attended to show their support. The ceremony concluded with the symbolic Ceremonial Turnover of Empowering Through Knowledge: Orientation on the LCAT VAWC DILG Region 5 took a step towards creating a safer environment for women and children by holding an online orientation on the Local Committee on Anti-Trafficking and Violence Against Women and their Children (LCAT-VAWC) for their staff. On March 18, 2024, to equip DILG R5 personnel with a comprehensive understanding of the mechanisms in place to address trafficking and violence against women and children. The importance of the orientation was underscored by the attendance of top regional management, including Regional Director Atty. Arnaldo E. Escober Jr. and Assistant Regional Director Jhoaden G. Lucero. Their presence along with other key figures like LGMED Chief Darlyn D. Game on: Interactive Game Show to Celebrate Women’s History The Office celebrated National Women’s Month with a unique online game show, “Guess HERstory.” Held in March, the two-episode event highlighted women’s achievements throughout history through interactive games and storytelling. The episodes aired on March 11 and March 18 via Facebook Live. This engaging format not only entertained viewers but also empowered them by showcasing the triumphs and contributions of women. Prizes for the games are personal contributions from the GAD Focal Persons. r r f r Online Roll-out on the Safe Spaces Act To underscore DILG Region 5’s commitment to combating genderbased violence, like sexual harassment, and fostering a safer, more inclusive environment for everyone, the office conducted an online workshop for the Safe Spaces Monitoring Team (SSMT) on March 19, 2024. Held via Zoom, the initiative aimed to equip SSMT members with the knowledge to effectively implement the law. Assistant Regional Director Jhoaden G. Lucero emphasized the workshop’s importance in raising community awareness and ensuring compliance. LGOO IV Jojimar Bagunu provided in-depth information on the Act’s legal framework and the SSMT’s role in enforcing it. The workshop also covered reporting procedures to streamline adherence to the law. Participation by key DILG officials like LGMED Assistant Division Chief Amaline R. Colina further solidified their dedication to this important cause. Another event organized for the occassion is a vibrant “Empowering Women, Empowering Communities” themed fair. This event wasn’t just a celebration, it was a platform for women to showcase their talents and entrepreneurial spirit. The “Serbisyo kay Juana” fair featured a diverse range of products from local women artisans and entrepreneurs. Beyond shopping, the fair offered a unique blend of activities. Those seeking relaxation could indulge in pampering sessions like manicures, pedicures, and reflexology. Foodies had their fill at booths showcasing delectable culinary delights. But the celebration extended further. The event encouraged creativity and fostered a sense of community through a special painting session. This activity wasn’t just for artistic expression; it was a chance for Empowering Women in the Workplace The office is honored to feature in our online wellness talk titled “Embracing Womanhood: Balancing Work and Life.” The session featured Undersecretary for Finance and Internal Management Maria Anthonette Velasco-Allones of Department of Migrant Workers, who shared valuable insights on achieving balance between professional and personal well-being, particularly for women. Attendees from various government units and stakeholders participated in the event. This aimed to empower women and foster a culture of resilience, growth, and support. It also encouraged participants to embrace womanhood and strive for success in all aspects of life. Promoting Overall Wellness In collaboration with healthcare providers, DILG Region 5 offered a pneumonia vaccination drive and a wellness talk for its personnel and interns on March 5, 2024. The consultation by Levi M. Llagas educated participants on early detection and prevention methods for reproductive health issues. LARAWAN Episodes Spotlight LGU Governance Models Embracing Womanhood: Finding Balance in Work and Life Bicol LGRRC and RCIT Collaboration produced Larawan Episodes that showcased local women leaders championing gender and development entitled, “Emerging GAD Good Practices.” The stories of Naga City, Tabaco City, and Sorsogon Province are hope to inspire others foster a culture of excellence and progress within communities. Abarientos I n a bid to honor exceptional service and foster innovation among its workforce, the PRAISE Committee through its Bicol Bida Awards of 2023 introduced a revamped system featuring six distinct performance awards categories: Diamond, Sapphire, Emerald, Ruby, Pearl, and Topaz. This overhaul aligns with the DILG’s commitment to enhancing efficiency through updated guidelines and mechanisms, urging individuals to surpass previous benchmarks. The prestigious event, held at The Pepperland Hotel on December 19, 2023, celebrated the achievements of 110 officials and employees from different positions. The recipients ranged from loyalty and lifetime service awards to recognition for effective performance and innovative leadership. Central to the success of the new award system is the Regional Information and Communication Technology Unit (RICTU), whose diligent efforts have streamlined the automation of the rating process. Held from November 6 to 17, 2023, the program aimed to bolster productivity and efficiency within the public sector, drawing participants from 14 APO member countries, including Cambodia, Fiji, India, Indonesia, Lao PDR, Malaysia, Mongolia, Nepal, Pakistan, Philippines, Republic of Korea, Sri Lanka, Thailand, and Vietnam. Led by experts such as Dr. Brian Marson and Dr. Myung Jae Moon, the program covered a diverse range of topics essential for effective public sector governance. Key areas addressed included e-Government, Regulatory Reform, Leadership, and Citizen-Centered Services. Participants, including Information Technology Officer I Eden S. Lanuza, from the Department of the Interior and Local Government (DILG) Region 5 in the Philippines, gained valuable insights through immersive site visits to institutions like the Philippine Statistics Authority and the Land Bank of the Philippines. Throughout the program, attendees engaged in group analyses and presentations, fostering collaborative learning and discussions on enhancing productivity and service delivery in the public sector. Lanuza’s participation exemplified the commitment to excellence within the Philippine government and highlighted the nation’s dedication to promoting productivity in public service. LGMED Division Chief, LGOO VII Darlyn D. Ayende, presented a brief overview of the SGLGB, its assessment criteria under DILG MC 2023-103 and the objectives for conducting the activity. This provided participants with a clear understanding of the standards and expectations for achieving the SGLGB recognition. During the knowledge-sharing session, ARS Section Chief, LGOO V Roma Santa C. Miranda presented the designed SGLGB MOV Uploading Template. She provided a detailed walk-through on the indicators of each governance area under the SGLGB, guiding all participants on the proper uploading and packaging of MOVs. The Interfacing initiative represents a proactive approach towards building stronger relationships between the Regional Management Team and Provincial Offices, laying the groundwork for more efficient and transparent operations within the department. As DILG Region 5 continues to forge ahead with its commitment to excellence and service, these interfacing sessions serve as a testament to the department’s dedication to fostering collaborative efforts and driving positive change in the communities it serves. In addition to the informative presentations, Mr. Ree-Jay M. Mago, Barangay Secretary of Motherlode, Jose Panganiban, Camarines Norte, shared valuable insights and best practices of their barangay. Barangay Motherlode is one of the fourteen barangays that successfully passed all governance areas in the 2023 SGLGB Regional Assessment. Mr. Mago’s knowledge-sharing session provided participants with innovative approaches and strategies for SGLGB assessment preparation. His experiences served as an inspiration for other barangays to improve their governance practices. With the guidance of experienced officials and the sharing of successful experiences from a model barangay, the event saw an impressive turnout, with a total of 962 participants from different barangays in the Bicol region. The activity was adjourned by LGMED Assistant Division Chief Amaline R. Colina, with the hope that the knowledge gained will contribute to the overall improvement of governance practices in the region. DILG R5 Conducts 10-day ‘RESET’ Training Program By ADAS II Mary Ann P. Abarientos, Intern Julianne Aurea R. Llanera, and Intern Jayrah Mae Odiña The path towards excellence and development is a product of perseverance and willingness to learn. The DILG R5, spearheaded by Assistant Regional Director Jhoaden G. Lucero, with the support of Regional Director Atty. Arnaldo E. Escober Jr. and the assistance of FAD Chief LGOO VII Rico E. Gaurino, conducted a Personnel Development Program entitled ‘Reinventing Employee Strategy to Excel in Tasks’ (RESET). This 10-day training program, which ran from January 15 to January 26, 2024, is geared towards preparing DILG 5 personnel for future challenges, particularly in rapidly changing environments. Gearing Up for Future Readiness The first day commenced with setting the tone of the activity delivered by RD Escober, supported by the TOP (Towards Optimizing Productivity) and RESET Program overview in connection with the 2024 DILG Outcome Framework. Interactive sessions were facilitated by ARD Lucero about change and adaptation strategies of the VUCAD and BANI World, aiming to help the participants create a Re-Entry Action Plan (REAP) after the training. The program was structured around five gears: Sword, Shield, Vest, Helmet and Combat Shoes wherein it aims to rediscover talent, skills and enrich the participants’ passion for service. Additionally, RICTU and the Legal Unit represented the ORD, providing an online skill enhancement workshop focusing on the efficient use of Google services and Canva, discussing legal updates on laws and issuances for better guidance on roles and obligations. Participants actively engaged in skillbuilding activities, demonstrated punctuality, and submitted daily journals and reflections, reflecting their commitment to enhancement. Vest for Protection This gear emphasizes physical and psychological wellness, nutrition, and stress management, led by ARD Lucero, a wellness advocate. She shared her journey and stressed the importance of self-education and listening to one’s body. The Helmet segment focused on fostering progressive mindsets through creative stimulation and introduced the Silva Method for manifestation meditation and goal setting. Participants acknowledged the importance of holistic well-being in creating a productive, stress-free workplace. Shield for Spiritual Strength The fourth gear, Pastor Jessie Torres and Pastora Kimberly Torres talked about strengthening one’s inner drive for service. Looking back and seeing how they’ve grown over the years and how their inner drive contributed to their growth, the participants have come to realize that Spiritual Strength contributes to developing themselves holistically. Self-reflection was one of the methods used to find their inner drive which helped the participants to intensify their motivation to serve and recognize their capabilities. Combat Shoes for Goal Parallelism The last gear, Combat Shoes for Goal, spoke about Parallelism Aligning Personal and Organizational Goals. PD Arnel Renato L. Madrideo shared that giftedness springs from within --- not what you have to do or is coerced to do but what you love to do. He highlighted that it is found in what you do and how you do it. The participants realized that their giftedness is something they have within but to be able to use it, they must hone it and use it for a good purpose. Action Planning (REAP) and Commitment Building For the last day of the program, FAD Chief LGOO VII Rico E. Gaurino shared what it takes to create a good REAP title. In the afternoon, LGOO VI Excelsis Eligio B. Berango presented his REAP Presentation, paneled by ARD Jhoaden G. Lucero, FAD Chief LGOO VII Rico E. Gaurino, LGCDD Chief Ma. Ruthel P. Gigantoca and LGMED Chief Darlyn D. Ayende. The remaining participants presented their REAP Presentation a week after the program via Zoom. The participants proceeded to write their commitments to use the knowledge they’ve gained in the program when they go back to their respective LGUs. Ways Forward The 10-day in-house learning program ended on January 26, 2024, with participants expressing gratitude for its implementation. They felt more prepared, perceptive, and enthusiastic about their roles. Reflecting on their journey, they emphasized the camaraderie formed and essential lessons learned. After their in-house program, their performance will be evaluated within six months to a year to ensure implementation of their learnings. Casaul Barangay Newly Elected Officials (BNEO) Towards Grassroots Renewal and Empowerment for Accountable and Transparent (GREAT) Barangays Program (BNEO Towards GREAT Barangays Program) commenced its provincial implementation on February 2024 in Bicol Region. BNEO Program is a term-based capacity development program for barangay officials. The Local Government Academy (LGA), as the training arm of the DILG, and in collaboration with the DILG Regional Offices, oversees the implementation of the BNEO Program and its courses. Prior to its implentation, the LGA facilitated a Program Manager’s Orientation for the BNEO in DILG Region 5. Held on January 16, 2024, at the Marison Hotel in Legazpi City, the event gathered regional and provincial teams to delve into the program’s framework and implementation strategy. In line with this thrust, the Bicol Local Governance Regional Resource Center (LGRRC) has unveiled its latest endeavor, the BNEO Starter Kit. This comprehensive kit comprises five key areas meticulously crafted to furnish newly-elected barangay officials with essential knowledge and skills in Barangay Administration and Governance. From policy-making and sound planning to budgeting, mechanisms, and structures of barangays, the kit aims to equip officials to navigate their roles effectively and steer their communities towards a more promising future. 2,424 NEWLY BARANGAY OFFICIALS CAPACITATED Embracing Kalinisan: DILG Region 5 Leads the Change Towards a Greener Future DILG Region 5 spearheaded the simultaneous launching of KALINISAN (Kalinga at Inisyatiba para sa Malinis na Bayan) Program held Saturday, January 6, 2024, at Barangay 57 – Dapdap, Legazpi City as the regional showcase barangay. Regional Director Atty. Arnaldo E. Escober, Jr, CESO V acknowledged the efforts of barangays, the city and municipal local governments, and partner agencies for their participation in the activity and underscored the significance of convergence among stakeholders. He also sought their commitment to providing continuous support for the program. This initiative aims to consolidate efforts to ensure a healthy and safe environment, with a focus on empowering local government units and fostering community involvement, inspired by the spirit of “bayanihan.” In line with the vision of a “Bagong Pilipinas,” characterized by sweeping changes across all sectors, the event was participated by 3,162 barangays across Bicol Region. The drill served as a crucial opportunity for personnel to simulate real-life earthquake scenarios and evaluate their preparedness levels. The HR Manual is a compendium of all updated policies and processes for the implementation of the HR Core Systems (Recruitment, Selection, and Promotion, Performance Management, Learning and Development, and Rewards and Recognition) and other mechanisms. The activity highlighted the compelling information and conclusions based on the data collected by the PEOs during the completed Impact Assessment on the 32 selected projects under the 2021 SBDP, spanning over the three provinces in the Bicol Region. Despite facing challenges, Bicol Region consistently achieved a Capable level, attributed to its strengths and areas for improvement discussed during the meeting. Issues and concerns were addressed through collaborative problemsolving, with the team proposing various strategies to enhance LGRRC effectiveness. Additionally, upcoming activities for FY 2024, including BNEO Orientation and the distribution of BNEO Starter Kits, were outlined, ensuring continued momentum in regional governance initiatives. Facility members and sub-LGRRC representatives were encouraged to engage in proactive discussions to optimize the implementation of activities outlined in the LGRRC Business Plan. Lucero, EnP, MM, CESO V, the activity served to further the gains and discussions which emanated from the Regional Directors’ Conference which was also held last March 2024. The discussion focused on the upcoming LGA PPAs for implementation for FY 2024 with DILG Region 5 expressing its intent to host the following capacity development interventions which shall be implemented in the second and third quarters of this year: 1. Training on Operation Listo: Disaster Preparedness Manuals for LGUs 2. Training on Local Climate Change Action Planning 3. Training on Management of the Dead and the Missing 4. Training on LGU Capacity Development Agenda Formulation 5. Training on DRRM Wemboree and Peace Wemboree for LGUs 6. Training on Public Service Continuity Plan Moreover, the status of downloaded LGA funds per region was also discussed during the Conference as well as concerns on the utilization of BNEO funds. Since most of the provinces have already conducted their BNEO Basic Orientation Course through their respective sub-LGRRCs, the funds may also be allocated for the conduct of the following priority activities: Barangay Development Planning with Barangay CapDev Agenda or Barangay DRRM Plan, Barangay Administration, Barangay Legislation, Barangay Procurement and SK Planning and Budgeting. Apart from the PPAs mentioned, DILG Regional Offices were also encouraged to submit proposals for demand-driven capacity development under the Enhancement of Local Government’s Capacity on Disaster Risk Reduction and Management (DRRM) - Climate Change Adaptation and Mitigation (CCAM) Program: Operation Listo. Francisco I n a proactive move towards enhancing local governance and fostering collaboration between government agencies and local government units (LGUs), the Department of the Interior and Local Government (DILG) Camarines Sur Provincial Operations Office, through its Cluster 1 Operations Office, recently concluded a series of Synergy Building Activities in partnership with 18 LGUs within its jurisdiction. The primary objective of these Synergy Building Activities was to facilitate stronger cooperation and synergy between the DILG and its LGUs. The events were specifically planned to address the outcomes of the 2023 Assessment, covering vital areas such as the Seal of Good Local Governance (SGLG), Child-Friendly Local Governance Audit (CFLGA), Peace and Order Council (POC) Audit, Anti-Drug Abuse Council (ADAC) Audit, and Local Legislative Awards (LLA). The activities encompassed a broader scope of local governance areas, such as transparency, accountability, service delivery, and community development. The goal of the presentation and evaluation of results was to give LGUs a more comprehensive picture and deeper understanding of their areas of strength and identify action areas to up their performance on the various assessments. More importantly, the activities provided the venue for the DILG and the local government units to work together more effectively and cooperatively in preparation for the 2024 evaluations. The Synergy Building Activities went beyond merely presenting findings; they were designed to actively engage local government officials and stakeholders in a constructive dialogue. This approach allowed LGUs to voice their perspectives on the assessment results, openly discuss challenges encountered during the evaluation process, and collaboratively explore viable solutions. This participatory approach is essential to fostering among LGUs a sense of commitment and responsibility with respect to the challenges that have been highlighted. The DILG aims to enable LGUs to adopt a proactive stance in addressing issues by promoting an open exchange of ideas, thereby strengthening local governance. The accomplishment of these synergy building activities creates a favorable precedent for teamwork in raising the standard of local government and service delivery. This endeavor is a positive step toward a more responsive, transparent, and responsible local government in Camarines Sur as the preparations for the evaluation are underway. Santos A significant milestone was reached as a total of eight SBDP 2023 Projects were completed, inaugurated, and officially turned over on Friday, March 15, 2024. Spearheaded by the dedicated efforts of the DILG Catanduanes Provincial Operations Office, under the leadership of Provincial Director Uldarico S. Razal., Jr. CESO V, the inauguration ceremony was conducted seamlessly through the Project Development and Management Unit (PDMU). The ceremony commenced with a sense of accomplishment as seven (7) remarkable projects were unveiled in the Municipality of San Miguel, while one (1) noteworthy endeavor was inaugurated in the municipality of Virac. These projects stand as symbols of progress and development, representing a collective effort to enhance the infrastructure and livelihood opportunities within the province. As the ceremony unfolded, it was graced by the esteemed presence of distinguished guests, including Regional Director Atty. Arnaldo E. Escober, Jr., CESO V, and Assistant Regional Director Jhoaden G. In the municipality of San Miguel, the projects included the Opening with Concreting of Road and Rehabilitation of Farm-to-Market Road in Barangay Balatohan, Rehabilitation/Improvement of Level III Water System in Barangay J.M. Alberto, Rehabilitation of Farm-toMarket Road in Barangay Kilikilihan, Upgrading of Farm-to-Market Road and Rehabilitation/Improvement of Level III Water System in Barangay Pagsangahan, and Upgrading of Farm-to-Market Road in Barangay San Marcos. Meanwhile, in the municipality of Virac, the project entailed the Construction of a Health Station in Barangay Danicop. Beyond celebrating the physical completion of these projects, the ceremony served to highlight the collaborative spirit and commitment of various stakeholders involved in their planning and execution. It underscored the importance of effective project management and community engagement in bringing about tangible improvements to the lives of Catandunganons. As these projects are officially turned over to their respective communities, it is with great optimism that the people of Catanduanes embrace the positive impact they will bring, paving the way for a brighter and more prosperous future for generations to come. On the ROAD to SGLG: Masbate’s Pursuit of the Elusive Seal of Excellence LGOO II Martha May M. Gallego Just like some dreams, some seals can be elusive too. In recent years, the Seal of Good Local Governance (SGLG) has been elusive for most of the Local Government Units (LGUs) in the Province of Masbate. Numbers show that in the five-year trend of SGLG-LGU passers in the province, the City of Masbate is the only CLGU to consistently attain the SGLG. Last year, the City of Masbate once again aced the seal, leaving the 20 other LGUs in the entire province under the 95.2% of those that did not make it to the 2023 SGLG Audit. With this, the Department of the Interior and Local Government (DILG) Masbate Provincial Operations Office initiated the Revitalizing Organizational Advancement and Dynamism of LGUs towards achieving SGLG (ROAD to SGLG), a roadmap that aims to improve the performance of LGUs and to increase the number of SGLG potential passers in the province. The ROAD, as the PO calls it, utilizes SGLG Tracking for Enhanced Performance System (STEPS), an online tracking system that yields initial results during the preassessment conducted in the LGU, paving the way as this crucial step gives LGUs the chance to gauge their readiness for the audit and provide them ample time to prepare their lacking documents from across governance areas, and improve their performance as well. During the rollout, two teams-- one for Cluster 1 and another for Cluster 2, conduct the pre-assessment or the pre-audit phase. They also provide technical assistance to the LGU functionaries and their partner agencies, guiding them as they navigate every nook and cranny of the SGLG. This step not only helps the LGUs; it also fosters collaboration among them to better promote good governance in their respective jurisdictions. As of writing, 17 out of 21 LGUs have already been provided with technical assistance. With this, DILG Masbate hopes to change the figures and numbers and attain that elusive seal, one LGU at a time. 1st Quarter PPOC Meeting in Sorsogon LGOO II Samantha De Vera The inaugural Quarterly Meeting of the Provincial Peace and Order Council (PPOC) and Provincial Anti-Drug Abuse Council (PADAC) convened at the People’s Mansion, Capitol Compound, Sorsogon City, on February 26, 2024. This gathering provided a platform for key stakeholders to engage in substantive discussions and collaborative efforts addressing pivotal peace and order concerns in Sorsogon Province. Throughout the session, the DILG Sorsogon Provincial Operations Office delivered comprehensive presentations, covering the outcomes of POC and ADAC audits, updates on infrastructure projects under the Support to Barangay Development Program, and an overview of the implementation progress of the Retooled Community Support Program for 2024. These insights facilitated informed decision-making and strategic planning to enhance the province’s peace and security initiatives. Looking ahead, it was collectively acknowledged that sustainable progress requires unified action. Therefore, the participants agreed on several ways forward, including intensified community engagement through grassroots initiatives, enhanced coordination among law enforcement agencies, and the prioritization of preventive measures against drug abuse. Camille Astrid O. Britanico For this department, the conclusion of local elections does not signify an end. Alas, elections, as are its consequences, are never simple. Often, it heralds a whole set of predicaments for us to navigate. One of which, and arguably among the most common, is the propriety of appointing losing candidates to government positions. The Constitution clearly states that, “no candidate who has lost in any election shall, within one year after such election, be appointed to any office in the Government or any governmentowned or controlled corporations or in any of their subsidiaries.”2 This rule is likewise echoed in the Local Government Code (LGC), particularly in Section 94 (b), which provision affirms the applicability of the one-year appointment ban to the losing candidates of an immediately preceding election, save for those who lost during the barangay elections. For the longest time however, it was unclear whether such prohibition was strictly confined to appointing losing candidates to plantilla positions. Finally, through the case of Raul F. Macalino v. Commission on Audit (G.R. No. 253199, 14 November 2023), we now have an answer. The case involves a Petition for Certiorari under Rule 64 of the Rules on Civil Procedure, in conjunction with Rule 65, against the Commission on Audit on account of its disallowance of the payment of Petitioner’s wages and allowances as Legal Officer II. Facts show that petitioner Macalino ran for mayor of Municipality X during the May 2013 elections, but was unsuccessful. Come July 2013, he entered into a contract of service with Municipality Y, which contract provides that he was to serve as Municipality Y’s Legal Officer II from June 1, 2013 to July 30, 2014. Petitioner contends that the one-year appointment ban is not applicable to him as (a) the same does not cover contracts of service; and (b) he was appointed as Legal Officer II in Municipality Y, and not in Municipality X, where he ran as mayor. In denying Macalino’s petition, the high court, speaking through Associate Justice Jose Midas P. Marquez, declared that “the subject prohibition applies to all losing candidates regardless of the position and the place or jurisdiction of the office in which they will be appointed.”3 The Supreme Court emphasized that the Constitution and the LGC are clear in their use of the phrase, “any office in the Government or any [GOCCs] or in any of their subsidiaries.” It stressed that when the law does not distinguish, the courts likewise cannot distinguish. Therefore, there is no room for selective interpretation and application of the said rules. To rule otherwise would in turn denigrate the will of the electorate, for the said rule is “a recognition of political will—it means that the people rejected the losing candidate and did not want him or her to occupy a public office. Thus, the electorate’s volition will be flouted if a candidate is immediately appointed to an office in the government after losing an election bid.”4 --------------- 1 Raul F. Macalino v.
