52 | LSC-TOMBALL STUDENTS DISCIPLINE GUIDE Appendix G Criminal Trespass Warning Primer What is a Criminal Trespass Warning? A Criminal Trespass Warning is a verbal or written communication by the actual property owner or an apparently authorized actor instructing an individual to leave the property or forbidding the individual property entry. An individual may receive a Class B misdemeanor criminal offense if they remain or enter the subject property violating a Criminal Trespass Warning. A Criminal Trespass Warning is not the same as or part of a period of disruption, suspension, or expulsion. Can the College issue a Criminal Trespass Warning? The College can issue Criminal Trespass Warnings. The Texas Education Code explicitly allows the College to refuse persons having no legitimate business entry to College property and to eject any undesirable person if the person does not leave peaceably. Further, the College may require any person’s identification, and the person must provide that identification. Please note that lawfully exercising one’s First Amendment Rights is “legitimate business.” Who can authorize or sign a Criminal Trespass Warning? A police officer with the Lone Star College Police Department may issue a verbal Criminal Trespass Warning requiring individuals to leave the College’s property. The Chief Operating Officer or the Chancellor may issue and sign written Criminal Trespass Warnings forbidding an individual from entering the College’s property. All Criminal Trespass Warning requests must be directed to the Chief Operating Officer or the Chancellor.

Written Criminal Trespass Warnings forbidding an individual’s entry to the College’s property do not have an expiration. Some counties or courts, however, may refuse to prosecute Criminal Trespass Warnings violations after a time. Therefore, the best practice is to assume that a Criminal Trespass Warning will not be effective after 12 months. A Criminal Trespass Warning may be re-issued after those 12 months. How does a Criminal Trespass Warning affect First Amendment Rights? As noted above, a Criminal Trespass Warning can not prevent an individual from lawfully exercising their First Amendment Rights in any public forum, such as the College’s common outdoor areas. Please submit a ticket through ServiceNow OGC Services or contact the Office of the General Counsel directly with any questions.
