Can we sell the real property during probate?

Yes. Selling the real property during the probate case allows the heirs to sell the
property in "As-Is" condition with no warranties and no repairs made by the
heirs to the buyer. This provides more protection to the heirs from liability since
the heirs are not expected to know much about the condition of the probate
property. The same is not true if the heirs choose to sell AFTER the probate case
is over.

Should we sell the real property after probate?

It is an option to sell the real property after the probate case. However, often
times, the property has to be sold to satisfy creditors, to divide assets among the
heirs, or because costs of maintenance and management of the property creates a
burden to the family. The Personal Representative should follow the advice of a
probate lawyer.

What if neither I nor the family has the money to get the house
ready for sale?

Often times, the estate does not have the funds to address major issues (i.e. mold
remediation; junk hauling) or even, cosmetic issues (i.e. paint; yard cleanup). We are
able to advance funds necessary to clean, market, and sell the probate property.
There is no interest charge for this.

Can you help sell the property remotely?

Yes. Many of our clients live outside of San Diego or in other states. We are
committed to serving our out-of-town clients by preparing the probate property
from the cleanout stage to the close of escrow of the sale.

I am overwhelmed with cleanup, selling the personal property,
remediating/rehabbing, or simply painting. Can you help with
