ORDINANCE NO. 16-1257 DATE: _February 17, 2016_

An Ordinance Approving a Special Use Permit for a Clean
Construction and Demolition Debris (CCDD) Facility for Hanson

Material Service

WHEREAS, Hanson Material Service, represented by Randall J. Boisvert (hereinafter referred to as
“Developer”) has requested the approval of a Special Use Permit for a Clean Construction and Demolition
Debris (CCDD) facility on the east side of the Des Plaines River; and,

WHEREAS, said request is for the filling of approximately 20 acres; and,

WHEREAS, said request for a Final Development Plan includes the following exhibits:

 Map of facility attached as Exhibit A; and,
 Hanson Material Service description to meet Village requirements attached as Exhibit B; and,
 IEPA permit issued June 4, 2008 attached as Exhibit C; and,

WHEREAS, said request has met all of the procedural requirements of the Village of Romeoville, Village
Board of Trustees, Planning & Zoning Commission, Development Review Committee, and the Code of
Ordinances, as amended; and,

WHEREAS, the Planning & Zoning Commission held a Public Hearing on February 9, 2016 to discuss the
proposal as outlined in the PZC Report attached as Exhibit D; and,

WHEREAS, said request meets with the approval of the Village of Romeoville and hereby authorizes
Developer to proceed according to the Development Regulations, Zoning Code and various requests
made by the Development Review Committee, Planning & Zoning Commission, and Village Board of
Trustees.

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES FOR THE
VILLAGE OF ROMEOVILLE, WILL COUNTY, ILLINOIS:

Section 1: That the above recitals and referenced reports are hereby incorporated and made a part
Section 2: of this Ordinance;

That approval of the Special Use Permit for a CCDD facility is hereby granted by the
Village, in which the Village President is hereby authorized to sign, and the Village Clerk
attest thereto, that the said CCDD facility has met all of the requirements as herewith
attached and is authorized to proceed at the site legally described as follows:

OF THE CHICAGO SHIP AND SANITARY CANAL IN TOWNSHIP 36 NORTH, RANGE
10 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN WILL COUNTY, ILLINOIS.

THAT PART OF THE SOUTHEAST QUARTER OF SECTION 10 LYING EASTERLY OF

THIRD PRINCIPAL MERIDIAN, IN WILL COUNTY, ILLINOIS.

Section 3: That the approval of the special use permit set forth in this Ordinance shall be specific
and personal to the Applicant as the owner and occupant of the above described site,
and shall not run with the above described property or in any way be transferable to or for

Section 4: the benefit of any grantee, lessee, assignee or successor of the Applicant, and provided,
further, that the approval of the special use permit set forth in this Ordinance shall
terminate without the requirement of any further action by the Village in the event of any
conveyance, transfer, lease, or other change in the identity of the ownership or
occupancy of the above described site from the Applicant to any other entity or person.

That the special use permit granted by this Ordinance is specifically limited to the parcels
listed in section 2. Any additional areas or parcels proposed for CCDD filling must apply
for and receive a separate special use permit.

Section 5: That this Ordinance shall become effective upon its passage, approval and publication as
provided by law.

Debris (CCDD) Facility for Hanson Material Service

TO: Village President, Village Clerk & Board of Trustees
Village of Romeoville, Will County, Illinois

Hanson Material Service has applied for a Special Use Permit to operate a Clean Construction and
Demolition Debris (CCDD) Facility on their property.

On February 9, 2016, the Planning & Zoning Commission held a Public Hearing to discuss and consider
the request various requests. The application was evaluated according to the requirements and
regulations outlined by the Comprehensive Plan - Chapter 157, Development / Subdivision Regulations -
Chapter 158, and Zoning Code - Chapter 159.

Testimony and presentations were heard from the staff, the applicant, and the Commission. The
following issues and opinions were discussed.

Nathan Darga, Senior Planner, read the staff report. He reported that Hanson Material Service has
operated a CCDD facility on the east side of their property since 2002. Their current IEPA permit was
issued in 2008 and runs through 2018. In 2011, the Village made CCDD facilities a special use in the M-
2 zoning district. When that happened, the Hanson facility became a legal non-conforming use. Hanson
is now coming forward to obtain a special use permit to keep the facility in compliance with local
ordinances.

The facility is located east of the Des Plaines River in one of the old quarry pits. It is approximately 1.5
miles off IL 53 along their access road and ¾ mile from the nearest residential property. The facility is
permitted by the IEPA and inspected by the IEPA and Will County. To date, they have never had a
Notice of Violation for the CCDD facility.

Village code for CCDD lists nine specific criteria in addition to the general special use criteria. Hanson
has prepared a response detailing how they will comply with these criteria. It has been included in your
packet. Hanson is not requesting any variances but will follow all of these rules. Also included is a copy
of their current IEPA permit with all of the conditions the State has on CCDD facilities.

Randall Boisvert from Hanson Material Service was sworn in. He stated that Hanson intends to follow all
the Village rules and is not seeking any variances.

The Commission did not have any questions. No one from the public wished to speak.

From the testimony and presentation made by the Petitioner / Applicant, Witnesses, General Public, and
Staff recommendation on the request, the Commission hereby finds the following:

1. The application complies with the provisions of the Comprehensive Plan (Chapter 157).
2. The application complies with the provisions of the Development Regulations (Chapter 158).
3. The application complies with the provisions of the Zoning Code (Chapter 159).

THEREFORE, the Planning & Zoning Commission of the Village of Romeoville hereby recommends to
the Village President and Board of Trustees the Approval of ORD 16-1257.
