CHAPTER I

PREFACE

1.0 INTRODUCTION

Practicum I was the core course for Fakulti Undang-Undang dan Hubungan Antarabangsa in order
to fulfill the qualification for Bachelor of Laws. In this courses, the student was placed under
organisation to obtain experience by working related to the programme in the university. Main
objective for the Practicum I is to expose the student with the actual working environment while
gaining experience and understanding on the aspect related to the studies specifically and also
others occupation generally.

To fulfill this courses, I was placed at Mahkamah Majistret and Sesyen Kuala Kangsar for 6 weeks
starting from 17 June 2019 till 26 July 2010. During this period of time, I do some activities as
part of staff in the office. While in practical, I being supervise by supervisor Puan Rohaida Ishak
who was Hakim Mahkamah Sesyen Kuala Kangsar for 6 weeks.

1.1 ORGANISATION BACKGROUND

This organisation was consist of 2 subordinate court which is Magistrate and Session Court.
Currently Magistrate Court matter to hear or trial were tried by Sessions Court Judge due to the
vacant in the position of Magistrate as the judge also has the high hierarchy to hear and tried any
matters in the Magistrate Court. The were 16 staff were served in this court including judge,
interpreter, administration clerk, financial clerk . This organisation were located next to Balai Polis
Kuala Kangsar and in front of Pejabat Tanah Daerah Kuala Kangsar.

CHAPTER II

FULL REPORT ON DUTY EXERCISED DURING PRACTICUM

2.0 INTRODUCTION
In this chapter, i will explained what activity i had done during my practicum.

2.1 THE ACTIVITIES
There were few task designated to me as to expose the actual working environment. First task
given by the supervisor, to understand the hierarchy and jusridiction every court in Malaysia.
The apex of the hierarchy is Federal Court and the lowest is Magistrate Court. Every court has
been assigned is power accordingly to the hierarchy. Second task was given is to identify liability
and quantum in the accident cases before the judge giving decision. The case that has being
assigned to me was an accident cases where i need to decide the liability and the quantum that
need to be awarded to the plaintif or defendant. In this cases , I learned about quantum which is
the damages were divided into special damages and general damages as provided by
compendium. Final task was to giving suggestion on how to overcome drug cases in Kuala
Kangsar, since everyday the drug cases is common and the highest rate in Kuala Kangsar. I give
suggestion for the drug addict needs to be treated as patient not criminals and the possession of
drugs for personal use must be consider to decriminalize.
However, while completing the task given , I also do minor activities such as attend the counter ,
learn on handling photostate machine and do the photocopy things, read file cases. While read
the cases, I find it interesting as I managed to see the exhibit inside the file which is confidential
for public.
In addition, I also do some outdoor activities such as visiting Agensi Anti Dadah Kebangsaan
offices and also attend their programme. The next day, I visited Balai Polis Kuala Kangsar at two
deparment where Narcotics Department and Criminal Investigation. This outdoor programme,
exposed me the reality of the drugs abuse and types of the drugs that commonly consume by the
drug addict and also the rates of drugs addict in Kuala Kangsar.

CHAPTER III

FINDINGS DURING PRACTICUM I

3.0 INTRODUCTION

In this chapter explain the findings after 6 weeks practicum in the Mahkamah Majistret dan Sesyen
Kuala Kangsar

3.1 FINDINGS

3.1.1 WEAKNESS

While in the practicum, I find the environment in the organisation is welcoming even the facilty
are limited as the building are small. However there was a minor flaws that I managed to identify
as follows :

3.1.1.1 The absence for noted machine to calculated the notes. The staff needs to calculate
the money manually and the amount was huge almost RM 150 , 000.00. The
organisation should be provided the proper machine to calculate the notes in order to
avoid error.

3.1.1.2 The absence of Magistrate causing the delay for every cases and matter under the
jurisdiction of Magistrate. The Session’s Court Judge need to exercise the duty as
Magistrate to produce remand and also to hear and giving the decision for the cases at
the Magistrate level. This causing the uneffectiveness for the related staff in exercising
their duties.

3.1.2 STRENGTH
3.1.2.1 The environment of the organisation are welcoming. All the staff including my

supervisor very attentive and helping each other regardless their position in the organisation.

This vibe should be taken an example to have positive working environmient and producing the
good results while working despite of limitation.

3.1.3 SUGGESTION
3.1.3.1 The machines notes should be provide for the financial department staff to calculate

the money in convenient and also to avoid miscalculation. The money receives mostly from fine,
summon and also filing. If the fine consume a huge amount the cash would cause difficulty to
calculate due to the amount and the quantity of the cash.

3.2 OPPORTUNITY
Honestly , 6 weeks for Practicum are not enough to gain an experience as some of the court
procedure are not able to conduct due to the limited of time. But I managed to learn on , how the
procedure on stay of execution while waiting for appeal for the high court to review the
reasonableness of the punishment to the accused. Also, I learn on the procedure for adoption of
children during this period. Hence, during practical I have being exposed with court system by
the organisation called “e-SISPIM”and this system was new and being using by few of the court
in Perak such as Mahkamah Majistret Sungai Siput, Mahkamah Majistret Lenggong, Mahkamah
Majistret Gerik, Mahkamah Majistret Pengkalan Hulu, Mahkamah Majistret Kampar, and
Mahkamah Majistret Parit. On 9th July 2019, “Kursus Pemantapan e-SISPIM” was held and
Mahkamah Majistret and Session Kuala Kangsar as the host of the programme. This programme
objective to exposed the staff on how to optimise the usage of the system.

Moreover , i also managed to learn and watch how the prosecution was conducted during trial.
Also how the chief examination counduct during the trial and cross examination by the counsel
to the witness. It such a priceless moment watching this during trial because it is involved with
public who was layman and did not have the knowledge how the courts or trial being conducted.
The witness sometimes could be excited in giving his testify, some of the witness did not
understand the question asked by the counsel or prosecutor and also some of the witness anxious
while giving their their testify in the court.

For this period, I managed to see the real life happen in my society. In this court I learned how to

interact with public and approach them to make them understand the procedure of the court.
Hence, I was given chance by Agensi Anti Dadah Kebangsaan staff to hand flyers about the
dangerous of drug and educate the public how the drugs could harm them. Surprisngly, the
public giving their positive and full cooperation by spend their time to listen on explaination
regarding the flyers and also some of the public share the information where the activities of the
drug addict spot in Kuala Kangsar. From what I found , the awareness of the public on the harm
of drugs was at the exciting level and hopefully will reduce the drug abuse among the society.
Almost 80% of the drug cases especially drug addict was Malay, unemployed and the age
between 18 to 40 years old and man based on the information by Agensi Anti Dadah Kebangsaan
and Polis Diraja Malaysia. What I anxious is the drugs addict cases now involving teen around
13 years until 17 years old, at the young age they should go to school study and also they were
young generation that needs to be preserved and they were served to the nation , religions and the
society. If they have consume the drugs at this young, it is an alarm for society to wake up and
do something to curb this situation from keep happening.

CHAPTER IV

CONCLUSION

4.0 INTRODUCTION
In this chapter, elaborate the conclusion for the whole 6 weeks during practicum. The conclusion
including the contribution for me as a practical student, organisation and also for the Faculty and
UniSZA.

4.1 CONTRIBUTION FOR TRAINEE
During this duration , Im trying to gain as many as possible the experience in this organisation.
Truthfully, I did not manage to learn some of the procedure of court due to the jurisdiction of the
court itself and also the duration of practicum was limited. However, this limited time exposed me
to the actual working reality and applying the knowledge that i had learned in the class.
In addition , I learn to interact with public and improving my softskill when interacting with them.
Usually, when attend at the counter its required me to learn how to interact with the public and
watching how the staff attend them at the counter.

While practicum, I had been exposed the actual civil and criminal procedure in the court. I learn
how remand being produced and how many days remands can be produced. Hence, I have being
explained by prosecutor on types of bailment. In this practicum, teach me how to do administration
work, therefore in future career i already being exposed by the actual situation in administration
department.
