(A) 102 2 AKTA KASTAM 1967 PERINTAH KASTAM (LARANGAN MENGENAI EKSPORT) 2017 PADA menjalankan kuasa yang diberikan oleh subseksyen 31(1) Akta Kastam 1967 [Akta 235], Menteri membuat perintah yang berikut: Nama dan permulaan kuat kuasa 1. (1) Perintah ini bolehlah dinamakan Perintah Kastam (Larangan Mengenai Eksport) 2017. (2) Perintah ini mula berkuat kuasa pada 1 April 2017. Jadual Pertama Larangan mutlak 2. (1) Pengeksportan barang-barang yang dinyatakan dalam ruang (2) Jadual Pertama ke destinasi yang dinyatakan dalam ruang (3) Jadual Pertama dilarang secara mutlak. (2) Subperenggan (1) hendaklah juga terpakai bagi barang-barang dalam transit. Jadual Kedua Larangan bersyarat kecuali di bawah lesen eksport 3. Pengeksportan barang-barang yang dinyatakan dalam ruang (2) dan (3) Jadual Kedua dilarang, kecuali di bawah suatu lesen eksport— (a) yang dikeluarkan oleh Ketua Pengarah; (b) yang dikeluarkan oleh pegawai kastam yang hak yang dilantik oleh Ketua Pengarah untuk bertindak bagi pihaknya di kementerian, jabatan atau badan berkanun sebagaimana yang dinyatakan dalam ruang (5) Jadual Kedua; atau

P.U. (A) 102 3 (c) yang dikeluarkan oleh kementerian, jabatan atau badan berkanun sebagaimana yang dinyatakan dalam ruang (5) Jadual Kedua, dan tertakluk kepada apa-apa syarat yang dinyatakan dalam lesen eksport. Bahagian I Jadual Ketiga Larangan bersyarat kecuali mengikut cara yang diperuntukkan 4. Pengeksportan barang-barang yang dinyatakan dalam ruang (2) dan (3) Bahagian I Jadual Ketiga dilarang kecuali mengikut cara yang diperuntukkan dalam ruang (5) Bahagian I Jadual Ketiga. Bahagian II Jadual Ketiga Larangan bersyarat kecuali mengikut cara yang diperuntukkan bagi barang-barang yang dikawal di bawah Akta Perdagangan Antarabangsa Mengenai Spesis Terancam 2008 [Akta 686] 5. (1) Pengeksportan dan eksport semula barang-barang yang dinyatakan dalam ruang (2) dan (3) Bahagian II Jadual Ketiga dilarang kecuali mengikut cara yang diperuntukkan dalam ruang (5) Bahagian II Jadual Ketiga. (2) Bagi maksud subperenggan (1), “eksport semula” mempunyai erti yang diberikan kepadanya dalam seksyen 3 Akta Perdagangan Antarabangsa Mengenai Spesis Terancam 2008. (3) Subperenggan (1) terpakai juga bagi barang-barang dalam transit. Penjenisan 6. Bab, kepala atau subkepala yang digunakan dalam Perintah Duti Kastam 2017 [P.U. (A) 5/2017] yang berkuat kuasa bagi suatu butiran dalam Jadual Kedua dan Jadual Ketiga adalah untuk kemudahan rujukan sahaja dan tidak mempunyai kesan mengikat bagi penjenisan barang-barang yang diperihalkan dalam ruang (2) Jadual Kedua dan Jadual Ketiga itu.

P.U. (A) 102 4 Pengecualian 7. Perenggan 3 dan 4 tidak terpakai bagi— (a) barang-barang yang dieksport oleh atau bagi pihak Kerajaan Malaysia atau Kerajaan mana-mana Negeri kecuali barang-barang yang tersenarai dalam Bahagian I Jadual Ketiga dan Bahagian II Jadual Ketiga yang dikawal selia oleh— (i) Perkhidmatan Kuarantin dan Pemeriksaan Malaysia (MAQIS); (ii) Jabatan Pertanian di Semenanjung Malaysia; dan (iii) pihak berkuasa yang berkenaan di Sabah dan Sarawak; (b) barang-barang yang dimuatkan sebagai barang-barang stor kapal atau pesawat udara sebagaimana yang diluluskan oleh pegawai kastam yang hak; (c) barang-barang kegunaan sendiri atau barang-barang keperluan seorang pengembara bona fide, kecuali bagi tumbuh-tumbuhan dan barang-barang yang dinyatakan dalam butiran 28, subbutiran 37(2) dan 37(3) Bahagian I Jadual Ketiga; (d) sampel dagangan bona fide apa-apa barang yang diterima sebagai bona fide oleh pegawai kastam yang hak kecuali bagi tumbuh-tumbuhan; (e) barang-barang dalam transit kecuali barang-barang yang dikawal selia oleh— (i) Perkhidmatan Kuarantin dan Pemeriksaan Malaysia (MAQIS);

(A) 102 5 (ii) Jabatan Pertanian di Semenanjung Malaysia; (iii) Bahagian Keselamatan dan Kualiti Makanan di bawah Kementerian Kesihatan Malaysia; dan (iv) pihak berkuasa yang berkenaan di Sabah dan Sarawak; (f) barang-barang yang dieksport untuk diperbaiki, diselaraskan atau digantikan yang akan dikembalikan ke Malaysia; (g) hadiah dalam bentuk barangan makanan yang dieksport melalui bungkusan pos, yang nilainya tidak melebihi dua ratus ringgit bagi setiap bungkusan, kecuali bagi edible birds' nest yang dinyatakan dalam butiran 7 Bahagian I Jadual Ketiga; dan (h) barang-barang yang dieksport untuk pameran atau ujian kecuali: (i) tumbuh-tumbuhan; (ii) binatang dan produk dari binatang; (iii) unggas dan produk dari unggas; (iv) hidupan liar, produk, bahagian dan terbitan hidupan liar; (v) ikan hidup;

P.U. (A) 102 6 (vi) tanih; dan (vii) mikroorganisma. Masa apabila lesen eksport atau dokumen lain hendaklah dikemukakan 8. Lesen eksport dan apa-apa dokumen lain yang dikehendaki untuk dikemukakan di bawah Perintah ini hendaklah dikemukakan pada masa pengeksportan. Pindaan dan pembatalan lesen 9. Ketua Pengarah boleh membatalkan atau meminda mana-mana lesen eksport yang dikeluarkan di bawah Perintah ini pada bila-bila masa sebelum pengeksportan barang-barang yang berhubungan dengan lesen itu. Pemakaian peruntukan undang-undang lain 10. Pengeluaran suatu lesen eksport di bawah Perintah ini hendaklah tanpa menjejaskan peruntukan mana-mana undang-undang yang pada masa ini memperuntukkan kawalan atau pengawalseliaan mata wang dan pertukaran, atau mana-mana undang-undang lain yang pada masa ini memperuntukkan kawalan atau pengawalseliaan pengeksportan barang-barang. Pembatalan 11. Perintah Kastam (Larangan Mengenai Eksport) 2012 [P.U. (A) 491/2012] dibatalkan (selepas ini disebut sebagai “Perintah yang dibatalkan”). Kecualian 12. Apa-apa lesen eksport yang dikeluarkan di bawah Perintah yang dibatalkan dan berkuat kuasa sebaik sebelum Perintah ini berkuat kuasa hendaklah berkuat kuasa mengikut cara seolah-olah lesen eksport itu telah dikeluarkan di bawah peruntukan Perintah ini yang bersamaan dan hendaklah terus berkuat kuasa sehingga tempoh yang diluluskan bagi lesen eksport itu tamat atau lesen eksport itu dibatalkan di bawah Perintah ini.

P.U. (A) 102 7 CUSTOMS ACT 1967 CUSTOMS (PROHIBITION OF EXPORTS) ORDER 2017 IN exercise of the powers conferred by subsection 31(1) of the Customs Act 1967 [Act 235], the Minister makes the following order: Citation and commencement 1. (1) This order may be cited as the Customs (Prohibition of Exports) Order 2017. (2) This Order comes into operation on 1 April 2017. First Schedule Absolute prohibition 2. (1) The exportation of goods specified in column (2) of the First Schedule to destinations specified in column (3) of the First Schedule is absolutely prohibited. (2) Subparagraph (1) shall also apply to goods in transit. Second Schedule Conditional prohibition except under export licence 3. The exportation of goods specified in columns (2) and (3) of the Second Schedule is prohibited, except under an export licence— (a) issued by the Director General; (b) issued by the proper officer of customs appointed by the Director General to act on his behalf at the ministry, department or statutory body specified in column (5) of the Second Schedule; or

P.U. (A) 102 8 (c) issued by the ministry, department or statutory body specified in column (5) of the Second Schedule, and subject to such conditions specified in the export licence. Part I of the Third Schedule Conditional prohibition except in the manner provided 4. The exportation of the goods specified in columns (2) and (3) of Part I of the Third Schedule is prohibited except in the manner provided in column (5) of Part I of the Third Schedule. Part II of the Third Schedule Conditional prohibition except in the manner provided for goods controlled under the International Trade in Endangered Species Act 2008 [Act 686] 5. (1) The exportation and re-export of the goods specified in columns (2) and (3) of Part II of the Third Schedule is prohibited except in the manner provided in column (5) of Part II of the Third Schedule. (2) For the purpose of subparagraph (1), “re-export” has the meaning assigned to it in section 3 of the International Trade in Endangered Species Act 2008. (3) Subparagraph (1) shall also apply to goods in transit. Classification 6. A chapter, heading or subheading used in the Customs Duties Order [P.U. (A) 5/2017] which is in force for the item in the Second Schedule and Third Schedule are for ease of reference only and has no binding effect on the classification of goods described in column (2) of the Second Schedule and Third Schedule.

P.U. (A) 102 9 Exemption 7. Paragraphs 3 and 4 shall not apply to— (a) goods exported by or on behalf of the Government of Malaysia or the Government of any State except for goods listed in Part I of the Second Schedule and Part II of the Third Schedule which are regulated by— (i) the Malaysian Quarantine and Inspection Services (MAQIS); (ii) the Department of Agriculture in Peninsular Malaysia; and (iii) the appropriate authorities in Sabah and Sarawak; (b) goods loaded as ship's or aircraft’s stores as approved by a proper officer of customs; (c) personal or household effects of a bona fide traveller, except for plants and goods as listed in item 28, subitems 37(2) and 37(3) of Part I of the Third Schedule; (d) bona fide trade samples of any goods accepted as such by a proper officer of customs except for plants; (e) goods in transit except for goods regulated by— (i) the Malaysian Quarantine and Inspection Services (MAQIS); (ii) the Department of Agriculture in Peninsular Malaysia;

(A) 102 10 (iii) the Food Safety and Quality Division of the Ministry of Health; and (iv) the appropriate authorities in Sabah and Sarawak; (f) goods exported for repairs, adjustment or replacement which are to be returned to Malaysia; (g) gifts in the form of foodstuff exported by parcel post, the amount of each must not exceed two hundred ringgit per parcel, except for edible birds' nest as specified in item 7 of Part I of the Third Schedule; (h) goods exported for exhibition or test except for: (i) plants; (ii) animals and animal products; (iii) birds and birds products; (iv) wildlife, wildlife products, parts and derivatives; (v) live fish; (vi) soil; and (vii) microorganism. Time when export licence or other documents to be produced 8. The export licence and any other documents required to be produced under this Order shall be produced at the time of export.

P.U. (A) 102 11 Amendments and cancellation of licence 9. The Director General may cancel or amend any export licence issued under this Order at any time before the exportation of the goods to which such licence relates. Application of other laws 10. The issuance of an export licence under this Order shall be without prejudice to the provision of any law which for the time being provides for the control or regulation of currency and exchange, or any other law which for the time being provides for the control or regulation of the exportation of goods. Revocation 11. The Customs (Prohibition of Export) Order 2012 [P.U. (A) 491/2012] is revoked (hereinafter referred to as “the revoked Order”). Savings 12. Any export licence issued under the revoked Order and in force immediately before the coming into operation of this Order shall have effect in the like manner as if the export licence had been issued under the corresponding provision of this Order and shall continue to remain in force until the period approved for the export licence expires or the export licence is revoked under this Order.
