New Department of Labor, Wage and Hour Division regulations for Exempt (no Overtime)
Employees. Major points as follows:

1. Salary Threshold Changed to $913/week ($47,476 per Year)
This threshold doubles the current salary threshold level. While this level is slightly lower
than the threshold in the proposed rule, it still encompasses many employees that are
currently classified as exempt.

2. Automatic Salary Threshold Increases Every 3 Years (Not Annually) to
Maintain Level at 40th Percentile in Lowest-Wage Census Region
DOL reduced the frequency of the automatic increases in response to concerns. Instead of
annual increases, the threshold will be adjusted every 3 years to maintain the level at the
40th percentile of full-time salaried workers in the lowest-wage Census region.
Automatically updating the salary threshold, however, does not allow the government to
take into account changing economic conditions, specific impact on certain industries, or
regional differences. It also denies the public the ability to have input on the threshold as
required by the regulatory process.

3. Duties Test is Unchanged
The absence of a duties test change is a significant win. DOL did not make changes to the
standard duties test.

4. Effective Date is December 1, 2016.
The final rule provides additional time for employers to prepare. With the rule going into
effect on December 1, 2016, Employers and HR professionals should review their current
workforce immediately to determine which employees are affected, whether to re-classify
those employees, and execute a communications strategy. Employers and their HR teams
should keep in mind the periodic adjustments and set a regular review process.

SOUTHWEST FLORIDA REGIONAL
ECONOMIC INDICATOR REPORT

Dear Friend of the Lutgert College of Business,

Southwest Florida’s economy continued to exhibit monthly growth consistent with established seasonal
trends. These included a 3-percent increase in seasonally-adjusted regional taxable sales in January
2016 over January 2015, and an 11-percent increase in passenger activity for the three Southwest
Florida airports in February 2016 over February 2015. The coastal counties saw a 4-percent increase in
seasonally adjusted tourist tax revenues during the same period. Employment in the region increased by
10,198 since March 2015, while the number of unemployed has dropped by 3,507. Lee registered the
largest percentage increase in employment during this time period with 2.7 percent, followed by Charlotte
(2.1 percent), and then Collier (0.6 percent). Employment data is seasonally adjusted by the RERI. Other
highlights from the April 2016 report:

• Existing single family home sales by a Realtor® decreased by 16 percent in the coastal counties from
March 2015 to March 2016, although there were substantial increases in median prices.

• Single family building permits rose 1.6 percent for the coastal counties despite continued negative
13-month linear trends observed for Collier and Lee counties.

• The seasonally-adjusted unemployment rates were 4.5 percent for Lee County, 4.8 percent for Collier
County, 5.4 percent for Charlotte County, 6.2 percent for Glades County, and 9.0 for Hendry County. The
4.8 percent unemployment for the five-county region in March 2016 was well below the 5.5 percent rate
observed in March 2015. Unemployment for the state of Florida was 4.9 percent.

• The Florida Consumer Sentiment Index saw a 1.6 point increase in March 2016 over the prior month, but
a decrease from March 2015. In contrast, the national index fell for the third straight month.

• The Consumer Price Index for Miami-Ft. Lauderdale increased 1.6 percent for February 2016 compared
to February 2015. For the same time period, the CPI for the U.S. Southern Region and the nation increased
0.7 percent and 1.0 percent, respectively. The RERI’s staff extends its sincere thanks and appreciation

Development Organizations of Charlotte, Collier, and Lee Counties, the Convention and Visitors Bureaus
